Ord. 1204 02-28-05ORDINANCE NO. 1204 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ESTABLISHING MULTI -WAY STOP SIGNS WITHIN THE CORPORATE LIMITS OF THE CITY OF PEARLAND AT THE INTERSECTION OF ORANGE STREET AND LINWOOD OAKS; PROVIDING A PENALTY FOR VIOLATION; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE AND A REPEALER CLAUSE; PROVIDING AN EFFECTIVE DATE, FOR PUBLICATION, AND FOR CODIFICATION; AND DECLARING AN EMERGENCY BECAUSE THE NEED TO ESTABLISH STOP SIGNS AT INTERSECTIONS INURES TO THE BENEFIT OF THE TRAVELING PUBLIC AND, THEREFORE, BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE CITIZENRY. WHEREAS, Section 544.003 of the Transportation Code provides, in part, that local authorities may, with reference to highways under their jurisdiction, designate any intersection as a stop intersection; and WHEREAS, a multi -way stop sign warrant analysis for the intersection at Orange Street and Linwood Oaks has been prepared; and WHEREAS, based on the available data, installation of a multi -way stop sign is warranted; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. Pursuant to the grant of authority contained in the preamble hereof, the following intersection is designated as a stop intersection: Orange Street at Linwood Oaks. Section 2. Penalty. Any person who shall violate the provisions of this section shall be deemed guilty of a misdemeanor and shall, upon conviction by a court of competent jurisdiction, be punished by a fine in any sum not exceeding Two Hundred Dollars ($200.00). ORDINANCE NO. 1204 Section 3. Declaration of Emergency. The Council finds and determines that the need to establish stop signs inures to the benefit of the traveling public and, therefore, bears directly upon the health, safety and welfare of the citizenry; and that this Ordinance shall be adopted as an emergency measure, and that the rule requiring this Ordinance to be read on two (2) separate occasions be, and the same is hereby waived. Section 4. Savings. All rights and remedies which have accrued in favor of the City under this Chapter and amendments thereto shall be and are preserved for the benefit of the City. Section 5. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 6. Repealer. All ordinances and parts of ordinances in conflict herewith are hereby repealed but only to the extent of such conflict. Section 7. Codification. It is the intent of the City Council of the City of Pearland, Texas, that the provisions of this Ordinance shall be codified in the City's official Code of Ordinances as provided hereinabove. Section 8. Publication and Effective Date. The City Secretary shall cause this Ordinance, or its caption and penalty, to be published in the official newspaper of the City 2 ORDINANCE NO. 1204 of Pearland, upon passage of such Ordinance. The Ordinance shall then become effective ten (10) days from and after its publication, or the publication of its caption and penalty, in the official City newspaper. (713)772-2541 FEBRUARY 2005 TRAFFIC ENGINEERING EVALUATION INTRODUCTION The availability of roadway network in our communities has provided several positive qualities that have contributed to high standard of living. At the same time, however, several problems related to the roadway network have developed. These problems include roadway -related accidents, speeding, parking difficulties, congestion, and delay. To reduce the negative impact of roadways, it is necessary to collect adequate information that describes the extent of the problems and identifies their locations. Such information is usually collected by organizing and conducting relevant traffic surveys and studies. PURPOSE: The purpose of this study is to evaluate traffic demand at the intersection of Orange Street and Linwood Oaks to determine if a multi -way stop should be considered, and document 24-hour speed of vehicles along Orange Street to determine if a speeding problem exist. For the purposes of this study, a speeding problem is indicated on a residential street when the 85th percentile speed is at least 10 miles per hour over the posted speed limit. (i.e. at least 15% of the drivers travel more than 10 miles per hour over the speed limit.) Improvements, if any will be recommended as part of this report. The evaluation is based on field observations during the critical AM and PM peak period and data collected by Traff Data and associates, Inc. (TDAI). Information on accidents obtained from the City of Pearland Police Department. Speed Data: A 24-hour speed data was conducted along Orange Street within the immediate vicinity of Linwood Oaks to determine the 85th percentile speed of traffic in both eastbound and westbound directions. The speed data was collected on February 3, 2005. On the basis of the speed data, the 85th percentile speed of the eastbound and westbound vehicles on Orange Street are 36.6 mph and 35.6 mph respectively. Results of TDAI February 2005 1 TRAFFIC ENGINEERING EVALUATION the 24-hour speed survey are shown in the Appendix. An in-depth review of the speed data shows that the percentage of total traffic volume traveling above the posted speed limit on the eastbound and westbound directions of Orange Street are 60% and 53% respectively. Figure 1 shows the location of the speed study. FINDINGS AND RECOMMENDATIONS: Based field investigation and traffic data collected as part of this evaluation, it is apparent that the existing stop signs located approximately 1000 feet east and west of Linwood Oaks are not providing adequate gaps for northbound traffic from Linwood Oaks, ,and adjacent properties with direct access to Orange Street. The City of Pearland Police Department accident reports did not show any accident in the last 12 months on record at the intersection of Orange Street and Linwood Oaks. However, there have been three recorded accidents between Old Alvin Road and Schleider Drive, and numerous complains of near -misses by residents of the subdivision due to lack of critical gap. The average daily traffic along Orange Street is 3581 vehicles per day. While the average 8 hours volume is 288 vehicles per hour (total of both approaches for any 8 hours of an average day). Therefore, in order to minimize the potential for turning movement conflicts while providing adequate gaps for turning vehicles, a multi -way stop should be installed at the intersection of Orange Street and Linwood Oaks.
