GILBERT AND ASSOCIATES, INC., APPLICANT FOR ASHTON SOUTHERN TRAILS JOINT VENTURE, OWNER, PROVIDING FOR AN AMENDMENT OF THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT. WHEREAS, Kerry R. Gilbert and Associates, Inc., applicant for Ashton Southern Trails Joint Venture, owner, filed on January 24, 2005, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A"; and WHEREAS, on the 21st day of February, 2005, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of 1 ORDINANCE NO. 509-768 Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached thereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 17th day of March, 2005, the Planning and Zoning Commission of the City submitted its report and recommendation to the City Council regarding the proposed amendment application by Kerry R. Gilbert and Associates, Inc., applicant for Ashton Southern Trails Joint Venture, owner, whereby the Commission recommended denial of the change of classification for the described property from its existing classification of Planned Unit Development District (PUD) to Planned Unit Development District (PUD), and amendment to the existing PUD for Southern Trails; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and the recommendation of the Planning and Zoning Commission at a regular meeting on March 28, 2005; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Kerry R. Gilbert and Associates, Inc., applicant for Ashton Southern Trails Joint Venture, owners, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I . The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Planned Unit Development District 2 ORDINANCE NO. 509-768 (PUD) is hereby zoned to Planned Unit Development District (PUD), an amendment to the existing PUD for Southern Trails, such property being more particularly described as: 522.62 acres of land, situated in the H.T. & B.R.R. Company Survey, Section 80, Abstract 564, and Section 84, Abstract 538, being all of a called 120.134 acre tract of land described in a deed recorded Volume (90) 820, Page 217, Volume (91) 866, Page 357 and Volume (92) 994, Page 172 all of the Brazoria County Deed Records, and Lots 3 through 8, 11 through 18, 20 through 26, 27 through 34, Lots 37 and 38 and the west one-half of Lot 39, all of Lots 42, 43, 44, 45, 52 through 55, and 8.11 acres of Lot 56 of the Allison Richey Gulf Coast Home Company subdivision recorded in Volume 2, Page 98 of the Brazoria County Map Records, City of Pearland, Brazoria County, Texas (Generally Located o, the South Side of Broadway Street (CR 92), on the North Side of County Road 59, and on the East and West Sides of County Road 48) II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is. a proper valid exercise of the City's police powers. IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, 3 ORDINANCE NO. 509-768 such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. VI. The Gity Secretary is hereby directed to cause to be prepared an amendment to-7 the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. 509 and consistent with the approval herein granted for the reclassification of the herein above described property. The motion to approve was a tie vote of 3 — 3. Commission Members Ransom, McWhorter, and Dumont voted for the approval, and Commission Members West, Iocco, and Chairperson Sanders voted against the approval. The tie vote signifies a denial. The Commissioners voting against the approval stated the following reasons for the denial: 1. The Commission believes that the signage and monumentation should comply with the applicable ordinances. 2. The Commission stated that they have not approved any similar amendments (regarding signage) in the past. 3. The applicant was not proposing masonry fencing between the residential lots and the church tracts. 4. The Commission was concerned with setting a precedent for other properties if they should approve these larger signs. INTRODUCTION The Southern Trails Planned Unit Development Supplement Number One is prepared on behalf of Ashton Southern Trails Joint Venture in accordance with the City of Pearland regulations. This supplement is intended to further define and expand solely two sections of the. original Southern Trails Planned Unit Development, hereinafter referred to as (P.U.D.) which was codefined under Ordinance Number 509-695 by the City of Pearland City Council on February 9, 2004. A complete copy of the initial P.U.D. is contained within Appendix "A" of this supplement. II. INTENT OF SUPPLEMENT The purpose of this supplement is twofold. The first is to further define and expand the signage section of the. original P.U.D. to address primary project monumentation, secondary project "monumentation and internal project monumentation which is being proposed to serve Southern _ Trails Development. The second is to establish overall project fencing for the Southern Trails P.U.D.: III. SIGNAGE The overall project signage for Southern Trails will incorporate three specific types of project identity signage which will be located within Southern Trails. These identity signs areto be.. described as Primary Entry Monument, Secondary Identifier Monument and Internal Section Entry Monument accordingly. Exhibit "B" reflects the proposed locations of the abovestated project signs within Southern Trails. PRIMARY ENTRY MONUMENT Two Primary Entry Monument signs are proposed for Southern Trails. The materials and style of > the primary entry will establish the theme for the entire monument system for Southern Trails._ Exhibit "C" illustrates the proposed primary entry monument in both plan view and elevation. Each sign will be located adjacent to Southern Trails Drive approximately one hundred four (104) feet from the future south right-of-way line of Broadway Street; the principal entry for the first. phase of development of Southern Trails. ' The development theme of the Primary Entry Monuments locates these signs adjacent to and beyond the right-of-way of Southern Trails: Drive:_ extending into amenity lakes proposed to the east and west of Southern :Trails . Drive. The Primary Entry Monument: contains three elements which will continue throughout the Southern Trails project. A pylon anchors the Primary Entry Monument and transitions into a blade -wall which extends outward within.the adjoining lake system. Both pylon and blade wall will be,_; constructed with stone veneer with the pylon containing a metal roof and the 'blade: well containing precast concrete in which the project name will be reflected. The overall dimensions of the Primary Entry . Monument is approximately- seventy-three feetin length with the overall height ranging from twenty feet for the pylon- down to twelve feet for the blade wall. The area of the blade wall containing the project names contains approximately_two_hundred 'twenty-four square feet with a lettering height of: three feet and extending approximately _fifty-one feet in length. SECONDARY -IDENTIFIER MONUMENT The Secondary Identifier. Monument is to be implemented along the perimeter boundary and 'a key intersections within theoverall project. A total of four Secondary Identifier Monuments are proposed to be constructed within Southern Trails. The locations of the Secondary Identifier Monuments are reflected on Exhibit "B" accordingly. The Secondary Identifier Monuments are identical to the Primary Entry Monument except the overall dimensions are reduced. The pylon feature of the secondary sign achieves a height of ten feet with an overall length of approximately twenty-three feet for both pylon and blade wall. The precast concrete which reflects the project name contains approximately twenty-six square feet and extends a distance of fourteen feet with lettering one foot in height. INTERNAL IDENTIFIER COLUMN Two Internal Identifier Columns are proposed for the intersection of Southern Trails Drive and the collector street adjacent to the recreation center site as depicted on Exhibit "B These columns will have no signage .associated with them and serve primarily to carry the character of the community over to this key intersection point. These columns will have an overall height of ten feet and a _width of six feet at their base and are an adaptation of the secondary identifier monuments which occur at other key intersection and perimeter locations. Exhibit "D" illustrates the proposed identifier column with both plan and elevation views. INTERNAL SECTION ENTRY MONUMENT The Internal. Section Entry Monuments represents the remaining monument signs proposed within Southern Trails. Based on the current overall plan for the project as illustrated on Exhibit "B", a total of fifteen pairs of Internal Section Entry Monuments•will be established at the point of entry to each residential neighborhood, as well as, at the intersection of future local street with abutting major thoroughfares and perimeter property lines. Exhibit "D" reflects the proposed Internal Section Entry Monument in both plan view and elevation view. The overall length of this monument is approximately sixteen feet with the overall height of the pylon reaching approximately eight feet. Individual neighborhood village narnes will be represented on a mounted stone blade wall panel containing approximately twenty square feet in area with lettering nine inches in height. As with the Primary and Secondary Monuments, each Internal Section Entry Monument will be located beyond the right-of-way of future public streets. All Primary, Secondary, and Internal Section Entry Monuments will be permitted through the City of Pearland and reviewed for adjacent sight line distance, separation and other features to ensure that the overall public health, safety, and welfare is maintained. Overall ' maintenance will be the responsibility of the Southern Trails Homeowners Association...: In accordance with establishing an overall .theme for Southern Trails with the proposed entry monument features along the transportation system which -serves- the Southern Traits development, it is equally important to continue this theme by developing an overall fencing -Plan.- ' that compliments and continues the established theme throughout the_community Exhibit "E" reflects .a comprehensive overall fencing plan for the development.-: The exhibit identifies three primary fence types to be utilized within. Southern Trails. A six foot upgrade wood fence system with six .foot -six inch stone columns is- proposed to::be. -constructed along Broadway=.Street, Kingsley, -Kirby Drive and=along-one-side -of-the.--internal collector street serving Southern Trails. The fencing will be located along the common line of the • - proposed single family residential lots and future landscape / open space reserves which wi•ll abut the above -described public streets. In those instances where an internal local street abuts the future landscape / open space reserve, a six foot tubular steel fence will be implemented to provide view corridors and pedestrian access from the residential villages to the landscape / open space and the pedestrian trail system contained therein. In addition, the six foot tubular steel fencing will be utilized on all single family lots which back onto the proposed lake features as indicated on. Exhibit "E". A six foot stone veneer thinwall fence will be integrated with the upgraded wood fence with stone veneer at the point of entry to the residential villages to provide .a comprehensive and consistent theme of the fencing and entry monumentation. .A six-foot masonry "sliding panel" type fence will be provided along the common boundary line of single family residential Tots and abutting non-residential tracts contained within the approved conceptual land use plan for Southern Trails. This _ application principally applies. to the Southwest intersection of Broadway and Kingsley Road. Company DESCRIPTION: Survey, Section 80, Abstract 564, and Section 84, Abstract 538, being all of a called 120.134 acre tract of land described in a deed recorded Volume (90) 820, Page 217, Volurhe (91) 866, Page 357 and Volume (92) 994, Page .172 all of the Brazoria County Deed Records, and Lots 3 through 8, 11 through 18, 20 through 26, 27 through 34, Lots 37 and 38 and the west one- half of Lot 39, all of Lots 42, 43, 44, 45, 52 through 55, and 8.11 acres of Lot 56 of the Allison Richey Gulf Coast Home Company subdivision recorded in Volume 2, Page 98 of the Brazoria County Map Records, City of Pearland, Brazoria County, Texas GENERAL Generally Located on the South Side of Broadway Street (CR LOCATION: 92), on the North Side of County Road 59, and on the East and West Sides of County Road 48 APPROVAL PROCESS: After this Joint Public Hearing, the requested zone change application will be considered as follows: Planning and Zoning Commission: February 21, 2005 City Council for First Reading: March 21, 2005 City Council for Second Reading: March 28, 2005 SUMMARY: The applicant has submitted the proposed amendment to the Southern Trails ZCA No. 1217 Page 1 Planned Unit Development District (PUD), in order to provide more details relating to entry monumentation signs in terms of overall size, placement, and total number, as well as the location, placement, and type .of fencing within the overall development. This Southern Trails development is over 500 acres in size, and is located on the South Side of County Road 92 (Future Broadway Street), on the North Side of County Road 59, and on the East and West Sides of County Road 48. The subject property was zoned to a PUD on February 23, 2004. PREVIOUS WORKSHOP. DISCUSSION: The Council and Commission held a joint workshop on January 17, 2005, to discuss the proposal for the entry signs and overall fencing. At the time of the workshop, the applicant was proposing the following: • two internal signs (not allowed in the ordinance) and signage in excess of 130 square feet • fencing that is not masonry where commercial and residential districts abut COUNCIL/COMMISSION WORKSHOP COMMENTS: The Council and Commission offered the following comments to the applicant at the joint workshop in January: • Wooden fencing between residential and non-residential uses is a lesser standard from the current ordinance • Durability and maintenance of wooden fencing • Appearance of wooden fencing along Broadway Street • Size and purpose of the two internal signs APPLICANT'S REVISED PROPOSAL: Based on the comments received from the previous workshop, the applicant has revised the proposal as follows: • The wooden fencing between the residential and non-residential zones at the intersection of Kingsley Drive and Broadway Street has been revised to a 6 foot ZCA No. 1217 Page 2 high masonry fence. The fencing along the church properties fronting Broadway Street has not been changed. • Two of the originally proposed six identifier monuments have been changed from secondary identifier (23' 6" wide) monument to 6 foot wide internal identifier columns (no signage). The remaining 4 have been retained as secondary identifier signs. SURROUNDING ZONING AND LAND USES: Due to the size of the property, the adjacent zoning districts are shown on the attached Zoning Map. CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The Land Use Ordinance permits the following: (1) One builder/subdivision sign may be located at the main entrance of any new subdivision. Four (4) additional directional signs may be located off -site at appropriate locations. (2) The -maximum area of a builder/subdivision sign shall not exceed 130 square feet (two sides maximum). (3) (5) ' [Proposed: 2 signs, each of 224 square feet (primary entry monument)]' The maximum area of a subdivision directional sign shall not exceed 32 square feet (two sides maximum), with a length to width ratio not to exceed 3:1. Such sign(s) shall be removed after a period of five years or when the subdivision is sold out, whichever occurs first. Subdivision identification sign or signs not exceeding one hundred twenty (120) square feet per sign face and containing no more than the name of the subdivision may be permitted at the entrance to subdivisions. Subdivision signs shall not be located on public rights -of -way and shall not exceed two (2) per entryway. [Proposed: 4 secondary identifier monuments 26 square feet each; 2 internal identifier columns (no signage) 30 signs, 19 square feet each] PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners within 200 feet of the subject property under consideration. A legal notice of public hearing was published in the local newspaper, and a Zoning Sign was placed on the subject property. ZCA No. 1217 Page 3 STAFF RECOMMENDATION: Staff. recommends approval of the amendment to the Southern Trails PUD, as proposed by the applicant, for the following reasons: 1. The proposed signage is in keeping with the permitted signage within the subject area for other nearby subdivisions. 2. The applicant has revised the fencing between residential and non-residential uses to a 6 foot high masonry fence. 3. The proposed amendment does not change any other requirements of the original and approved PUD.
