AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN
DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR
THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL
PROPERTY LOCATION BEING 104.89 ACRES OF LAND, OUT OF TRACTS
83, 84, 85 AND 86, OUT OF THE ZYCHLINSKI SUBDIVISION OF SECTION 3
AND 4, H.T. & B.R.R. COMPANY SURVEY AND R.B. LYLE SURVEY,
ABSTRACTS 232 AND 543, AS RECORDED IN VOLUME 29, PAGE 43, DEED
RECORDS OF BRAZORIA COUNTY, TEXAS, CITY OF PEARLAND,
BRAZORIA COUNTY, TEXAS (LOCATED AT 4501 KNAPP ROAD) (SPECIFIC

AT THE REQUEST OF JOHN ANDREWS, APPLICANT FOR SHAWCOR PIPE
PROTECTION LLC, OWNER, PROVIDING FOR AN AMENDMENT OF THE
LAND USE DISTRICT `'MAP; CONTAINING A SAVINGS CLAUSE, A
SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS
RELATED TO THE SUBJECT.
WHEREAS, John Andrews, applicant for Shawcor Pipe Protection, LLC, owner,
filed on January 24, 2005, an application for amendment pursuant to Section 28 of
Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for
approval of a change in the land use as provided for in said Section 28, said property
being legally described in the original applications for amendment attached hereto and
made a part hereof for all purposes as Exhibit "A"; and
WHEREAS, on the 21st day of February, 2005, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached thereto and made a part hereof for all
purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of
Section 28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 17th day of March, 2005, the Planning and Zoning
Commission of the City submitted its report and recommendation to the City Council
regarding the proposed amendment application by John Andrews, applicant for

Shawcor Pipe Protection, LLC, owner, whereby the Commission recommended
approval of a Specific Use Permit for a Pipe Processing Facility in the Light Industrial
District (M-1(S)); and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on March 28, 2005; and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises, finds that in the case
of the application of John Andrews, applicant for Shawcor Pipe Protection, LLC, owner,
presented which, in the judgment of the City Council, would justify the approval of said
application; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Light Industrial District (M-1) is
hereby zoned for a Specific Use Permit for a Pipe Processing Facility in the Light
Industrial District (M-1(S)), such property being more particularly described as:
104.89 acres of land, out of Tracts 83, 84, 85 and 86, out of the Zychlinski
Subdivision of Section 3 and 4, H.T. & B.R.R. Company Survey and R.B. Lyle
Survey, Abstracts 232 and 543, as recorded in Volume 29, Page 43, Deed
Records of Brazoria County, Texas, City of Pearland, Brazoria County, Texas
(Located at 4501 Knapp Road)
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been

accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.

VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

Thank you for the time you and Nick took to guide us through the process of bringing the
ThermoFloTM pipe coating factory to our current operation in Pearland. We are excited to begin
the process and we hope that the permitting process allows us to make a Pearland decision and
that we do not have to continue on with our other options of remaining in Mobile, Al or Veracruz,
Mexico.
Attached is our application form together with the required metes and bounds, drawings and
method statements.
Our current range of pipe coating activities in Pearland covers a broad spectrum of work
activities such as;

The addition of the ThermoFloTM process would complement our existing services and double
our current revenue and current local impact to the economy. When we operate we would add
approximately 37 line personnel and 11 support personnel over and above our current
employment in Pearland. We have engaged an Environmental Engineering firm (Argent
Consulting Inc) to review TCEQ/EPA permitting requirements. Their analysis is complete and
all ThermofloTM activites would be covered under our existing TCEQ permits. Emissions from

this process (particulates, VOCs, etc.) are negligible and will will continue to remain under our
emissions caps established by current permits. The installation has a very small footprint and
nuisance environmental impacts (notably noise) will be well below what the current plant
generates. Engineering analysis of compliance with current permits is available for your review
at any time.
We look forward to working with your team and hope that we can gain approvals in time to allow
us to start breaking ground on the 14 of March so we could begin operations for the first critical
project in July. We will prepare a full powerpoint presentation for the upcoming public hearings
to show the many benefits to Pearland of this additional process.

Project Description

Bredero Shaw is currently evaluating where to move its existing glass syntactic polyurethane pipe coating
plant (ThermoFlo @) from Mobile Alabama. The current candidates are as follows;
i) Leave the plant in Mobile, Alabama
ii) Move to our existing Veracruz, Mexico facility
iii) Move the plant to our existing Pearland, Texas facility
Due to upcoming offshore projects and mobilization times we must select the location very soon.
Product/Process
ThermoFlo is a coating system which is used to insulate pipe carrying oil from very deep water regions in
the Gulf of Mexico and other regions. The system is made up of polyurethane materials and insulation
additives which are then mixed and pumped onto the pipe. Please refer to the attached Method
Statement in Appendix 1 for a graphic review of the process.
Future Site Improvements
We provide the attached draft site layout in Appendix 2. The main site improvements would be to bring in
additional power, water and install building and coating equipment.
Business Operations
The coating process is laid out in Appendix 1. We are a contracting company and tender to win coating
projects from all the major oil companies, steel mills, and offshore installation contractors. The normal
business process is that once we win a contract the Client would free issue the bare steel pipe to us and
we would apply a anti -corrosion coating to the pipe using the existing Pearland coating facilities. The pipe
would then be brought to the ThermoFlo facility and the ThermoFlo material is mixed and pumped into a
mold on the pipe. After the pipe is cured and quality control tests are performed the pipe will be stacked
into the existing pipe storage yard. When the offshore installation process begins the pipe will be trucked
from the yard to be loaded onto barges (or ships for export work) to be taken to the installation vessel
offshore.

We forecast a market of approximately $20M per year in GoM and export projects. If we obtain a 50%
market share (our historical share in Deepwater has been closer to 70%) we could expect the following

detection and all holidays will be marked and recorded. Any necessary repairs will be carried

3. Cleaning
The scope of the FBE Coated pipe shall be abraded to provide a clean, new surface for the
application of the GsPU.

Prior to transportation to the preheat station, the washed surface shall be examined.

The pipe is then loaded onto a transport buggy and preheated, using induction coils to the
required temperature. The pipe is then transferred to the polyurethane application station.

7. Mould Preparation, Plastic Spacer Installation
To maintain concentricity, prior to the installation of the preheated pipe into the mould, a
permanent plastic spacer will be located in the lower mould segment. This spacer (designed
to have minimal contact with the pipe surface) shall be fixed in the centre of the lower mould
segment.

The polyurethane components are machine mixed to the required ratio of Polyol and
Isocyanate.

10. GsPU/sPU Injection
Once the pipe has been inserted into the mould, polyurethane is injected through the mould
port. During the polyurethane injection the mould is inclined at an angle of 30o-45o to the
horizontal. On completion of polyurethane injection the mould will be left inclined for a
minimum of eight minutes to allow for the initial coating cure.

On completion of coating cure the pipe is de -moulded.

The pipe is transferred to a controlled holding area and held for a further four hours to allow
curing to be completed. During this time any necessary surface repairs are carried out. The
pipe will then be subjected to quality control testing and cutback / end formation checks.
After the doubler pad attachment area is cleaned, further repairs will be made if necessary.
End caps will be re -fitted and color coded pipe identification bands will be applied prior to
handling to stockpile or prior to load -out.

Development Ordinance, and this type of facility is permitted by the approval of a Specific
Use Permit in the M-1 district.

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
subject property is currently zoned M-1. Any proposed buildings or modifications to
existing buildings will need to comply with all requirements of the M-1 district, such as
building setback requirements.
The subject property consists of multiple lots. The applicant may be responsible for
submitting a subdivision plat to combine all lots into one lot for one building site.
CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004
update adopted on July 26, 2004) recommends "Light Industrial" for the subject property
and for many of the surrounding properties. The Comprehensive Plan further indicates
that the appropriate zoning districts for "Light Industrial" is the Light Industrial District (M-1).
Therefore, since the proposed specific use permit provides for light industrial uses, the
proposed specific use permit does not conflict with the Comprehensive Plan.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on Knapp Road, a minor collector street with a right-of-way width of 60 feet.
The subject property also has a small amount of frontage on State Highway 35 (Main
Street), a major thoroughfare with an ultimate right-of-way of 120 feet.
No other roadways affect the subject property.

IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The applicant has submitted
documentation describing the industrial process that occurs on the subject property (see
attached). The applicant has indicated that the pipe coating process involves the
application of an anti -corrosion coating which occurs at the existing facility. After the
coating process, the pipes will be stacked into the existing pipe storage yard until removed
for installation at another facility.
The applicant has also indicated that the process described in the attached documentation
would not cause an increase in emissions.
The subject property is located within an industrial area, and the applicant is proposing
additional industrial processing on the subject property. The proposed pipe processing
facility should not have a negative impact on any surrounding properties.
The subject property is located on a dead end street and is not visible by any principal city
streets and therefore, outside storage would not have an adverse visual effect.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of the specific use permit for
pipe processing, as proposed by the applicant, for the following reasons:
1. The proposed specific use permit provides for "Light Industrial" as recommended by
the Comprehensive Plan.
2. The proposed specific use permit is consistent with existing industrial processes
that currently occur on the subject property.
