BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain contract by and between the City of Pearland and Stantec Consulting Services, Inc., a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. COKER CITY ATTORNEY TOM REID MAYOR _0 1111111,, - �y= /1111!1 O`` Resolution No. R2018-67 Exhibit "A" CONTRACT FOR PROFESSIONAL SERVICES THIS CONTRACT is entered into upon final execution by and between the City of Pearland ("CITY") and Stantec Consulting Services Inc. ("CONSULTANT"). The CITY engages the CONSULTANT to perform professional services for a project known and described as Surface Water Plant — Package 3 ("PROJECT"). (Project # WA 1605) SECTION I - SERVICES OF THE CONSULTANT The CONSULTANT shall perform the following professional services to CITY standards and in accordance with the degree of care and skill that a professional in Texas would exercise under the same or similar circumstances: A. The CONSULTANT shall perform Preliminary Engineering. See Exhibit A, attached, for a detailed SCOPE OF WORK and PROJECT schedule. The PROJECT schedule shall be submitted in digital and hard copy form in the Microsoft Project for Windows format. B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost of the PROJECT. C. The CONSULTANT acknowledges that the CITY (through its employee handbook) considers the following to be misconduct that is grounds for termination of a CITY employee: Any fraud, forgery, misappropriation of funds, receiving payment for services not performed or for hours not worked, mishandling or untruthful reporting of money transactions, destruction of assets, embezzlement, accepting materials of value from vendors, or consultants, and/or collecting reimbursement of expenses made for the benefit of the CITY. The CONSULTANT agrees that it will not, directly or indirectly; encourage a CITY employee to engage in such misconduct. D. The CONSULTANT shall submit all final construction documents in both hard copy and electronic format. Plans shall be AutoCAD compatible and all other documents shall be Microsoft Office compatible. The software version used shall be compatible to current CITY standards. Other support documents, for example, structural calculations, drainage reports and geotechnical reports, shall be submitted in hard copy only. All Record Drawings electronic files shall be submitted to the CITY in TIF format. E. The CONSULTANT recognizes that all drawings, special provisions, field survey notes, reports, estimates and any and all other documents or work product generated by the CONSULTANT under the CONTRACT shall be delivered to the CITY upon request, shall become subject to the Open Records Laws of this State. The CONSULTANT shall procure and maintain for the duration of this Agreement, insurance against claims for injuries to persons, damages to property, or any errors and omissions relating to the performance of any work by the CONSULTANT, its agents, employees or subcontractors under this Agreement, as follows: (1) Workers' Compensation as required by law. (2) Professional Liability Insurance in an amount not less than $1,000,000 in the aggregate. (3) Comprehensive General Liability and Property Damage Insurance with minimum limits of $1,000,000 for injury or death of any one person, $1,000,000 for each occurrence, and $1,000,000 for each occurrence of damage to or destruction of property. (4) Comprehensive Automobile and Truck Liability Insurance covering owned, hired, and non -owned vehicles, with minimum limits of $1,000,000 for injury or death of any one person, $1,000,000 for each occurrence, and $1,000,000 for property damage. The CONSULTANT shall include the CITY as an additional insured under the policies, with the exception of the Professional Liability Insurance and Workers' Compensation. Certificates of Insurance and endorsements shall be furnished to the CITY before work commences. Each insurance policy shall be endorsed to state that coverage shall not be suspended, voided, canceled, and/or reduced in coverage or in limits ("Change in Coverage") except with prior written consent of the CITY and only after the CITY has been provided with written notice of such Change in Coverage, such notice to be sent to the CITY either by hand delivery to the City Manager or by certified mail, return receipt requested, and received by the City no fewer than thirty (30) days prior to the effective date of such Change in Coverage. Prior to commencing services under this CONTRACT, CONSULTANT shall furnish CITY with Certificates of Insurance, or formal endorsements as required by this CONTRACT, issued by CONSULTANT'S insurer(s), as evidence that policies providing the required coverage, conditions, and limits required by this CONTRACT are in full force and effect. The CONSULTANT shall indemnify and hold the CITY, its officers, agents, and employees, harmless from any claim, loss, damage, suit, and liability of every kind for which CONSULTANT is legally liable, including all expenses of litigation, court costs, and attorney's fees, for injury to or death of any person, for damage to any property, or errors in design, any of which are caused by the negligent act or omission of the CONSULTANT, his officers, employees, agents, or subcontractors under this CONTRACT. H. All parties intend that the CONSULTANT, in performing services pursuant to this CONTRACT, shall act as an independent contractor and shall have control of its own work and the manner in which it is performed. The CONSULTANT is not to be considered an agent or employee of the CITY. SECTION II - PERIOD OF SERVICE This CONTRACT will be binding upon execution and end May 31, 2020. SECTION III - CONSULTANT'S COMPENSATION A. The total compensation for the services performed shall not exceed the total noted in Section B. B. The CITY shall pay the CONSULTANT in installments based upon monthly progress reports and detailed invoices submitted by the CONSULTANT based upon the following: 1. Basic Services (Lump Sum) $1,047,071.00 2. Additional Services shall require independent and specific authorization and shall be billed as (Lump Sum): 3. Bid Phase Services (Hourly Not to Exceed) 4. The CITY shall make payments to the CONSULTANT within thirty (30) days after receipt and approval of a detailed invoice. Invoices shall be submitted on a monthly basis. Design 3 of 7 D2 Revised 2018 SECTION IV - THE CITY'S RESPONSIBILITIES A. The CITY shall designate a project manager during the term of this CONTRACT. The project manager has the authority to administer this CONTRACT and shall monitor compliance with all terms and conditions stated herein. All requests for information from or a decision by the CITY on any aspect of the work shall be directed to the project manager. B. The CITY shall review submittals by the CONSULTANT and provide prompt response to questions and rendering of decisions pertaining thereto, to minimize delay in the progress of the CONSULTANT'S work. The CITY will keep the CONSULTANT advised concerning the progress of the CITY'S review of the work. The CONSULTANT agrees that the CITY'S inspection, review, acceptance or approval of CONSULTANT'S work shall not relieve CONSULTANT'S responsibility for errors or omissions of the CONSULTANT or its sub- consultant(s) or in any way affect the CONSULTANT'S status as an independent contractor of the CITY. SECTION V - TERMINATION A. The CITY, at its sole discretion, may terminate this CONTRACT for any reason -- with or without cause -- by delivering written notice to CONSULTANT personally or by certified mail at 580 Westlake Park Blvd, Suite 1000, Houston, TX 77079- 2662. Immediately after receiving such written notice, the CONSULTANT shall discontinue providing the services under this CONTRACT. B. If this CONTRACT is terminated, CONSULTANT shall deliver to the CITY all drawings, special provisions, field survey notes, reports, estimates and any and all other documents or work product generated by the CONSULTANT under the CONTRACT, entirely or partially completed, together with all unused materials supplied by the CITY on or before the 15th day following termination of the CONTRACT. C. In the event of such termination, the CONSULTANT shall be paid for services performed prior to receipt of the written notice of termination. The CITY shall make final payment within sixty (60) days after the CONSULTANT has delivered to the CITY a detailed invoice for services rendered and the documents or work product generated by the CONSULTANT under the CONTRACT. D. If the remuneration scheduled under this contract is based upon a fixed fee or definitely ascertainable sum, the portion of such sum payable shall be proportionate to the percentage of services completed by the CONSULTANT based upon the scope of work. In the event this CONTRACT is terminated, the CITY shall have the option of completing the work, or entering into a CONTRACT with another party for the completion of the work. F. If the CITY terminates this CONTRACT for cause and/or if the CONSULTANT breaches any provision of this CONTRACT, then the CITY shall have all rights and remedies in law and/or equity against CONSULTANT. Venue for any action or dispute arising out of or relating to this CONTRACT shall be in Brazoria County, Texas. The laws of the State of Texas shall govern the terms of this CONTRACT. The prevailing party in the action shall be entitled to recover its actual damages with interest, attorney's fees, costs and expenses incurred in connection with the dispute and/or action. CONSULTANT and CITY desire an expeditious means to resolve any disputes that may arise between under this CONTRACT. To accomplish this, the parties agree to mediation as follows: If a dispute arises out of or relates to this CONTRACT, or the breach thereof, and if the dispute cannot be settled through negotiation, then the parties agree first to try in good faith, and before pursuing any legal remedies, to settle the dispute by mediation of a third party who will be selected by agreement of the parties. SECTION VI — ENTIRE AGREEMENT This CONTRACT represents the entire agreement between the CITY and the CONSULTANT and supersedes all prior negotiations, representations, or contracts, either written or oral. This CONTRACT may be amended only by written instrument signed by both parties. SECTION VII — COVENANT AGAINST CONTINGENT FEES The CONSULTANT affirms that he has not employed or retained any company or person, other than a bona fide employee working for the CONSULTANT to solicit or secure this CONTRACT, and that he has not paid or agreed to pay any company or person, other than a bona fide employee, any fee, commission, percentage brokerage fee, gift, or any other consideration, contingent upon or resulting from the award or making of the CONTRACT. For breach or violation of this clause, the CITY may terminate this CONTRACT without liability, and in its discretion, may deduct from the CONTRACT price or consideration, or otherwise recover, the full amount of such fee, commission, percentage brokerage fee, gift, or contingent fee that has been paid. The work is separated into the following three phases. Only Phases 1 is included in this authorization: PHASE 1 - PRELIMINARY ENGINEERING SERVICES PHASE 2 - DESIGN SERVICES PHASE 3 - CONSTRUCTION AND START-UP SUPPORT SERVICES The City of Pearland (CITY) is proposing to construct a new Surface Water Plant (Plant), intake, finished water storage and pumping, and transmission line which will be designed under three packages. This Scope of Services is directed towards Package 3 (Project), and includes Ground Water Storage Tanks, a Potable Water Pumping Station / administrative building, site security, and approximately 60,000 linear feet of potable water distribution and supply line, and approximately 6,000 linear feet of sanitary sewer force main to serve the new surface water plant. The following is a summary of the proposed facilities: Pump Station & Ground Water Storage Tanks 1. A Pump Station (capacity to be determined by Master Plan update, by others) including pumps, motors, piping and valves with electrical equipment room, pump mechanical room, reception area, visitors center, restrooms, control room, and other rooms as reasonably required by the CITY in one common, multi- purpose structure. 2. Pump station building shall have Heating, Ventilation and Air Conditioning (HVAC), architectural, structural, civil, mechanical, electrical and plumbing (MEP). To be coordinated with I&C and SCADA design completed by Package 2 (CDM). 3. Ground Storage Tanks (capacity, as determined by Master Plan update to be completed by the CITY's owner's representative (Ardurra)) size, and type to be verified under the scope of this Project. 4. Location of chemical disinfection injection points and coordination with finished water quality modeling (by others). 5. Site piping including control and isolation valves, meters, and other appurtenances. 6. Based on comments received on the Preliminary Engineering Report, a final version of the Preliminary Engineering Report will then be compiled and provided to the CITY. A review of the data will be undertaken, the result of which will be reported to the CITY. Additional Survey data may be recommended and requested under Additional Services to complete the route analysis and require ROW/Easement acquisitions. • CITY shall assign a single point of contact to serve as the Project Manager. • CITY will provide any existing survey, geotechnical, and other reports, data, and studies to CONSULTANT. CONSULTANT is not responsible for the accuracy or completeness of reports, data, or studies completed by others. CONSULTANT has the right to rely upon previously completed documents as a basis for performance of work. CONSULTANT will review information provided and inform the CITY if inadequate for performing the work. • Tasks 1 through 7 will be completed on a lump sum basis, and invoiced based on the percent complete of each task. "Task 8 Additional Services" are to be provided on an as needed basis. • The CONSULTANT shall review and evaluate available background information, and conduct interviews with CITY staff from Engineering and Operations to confirm existing documentation and to develop a full understanding of the existing operational/system limitations and the ultimate design requirements. Additional data may be requested as the project proceeds. CITY shall use best effort to provide all requested data within five (5) working days whenever possible. Meetings. and Scheduling This task includes project management, control systems and tools, and coordination activities recommended to execute services to be provided. Activities include project setup and planning, establishment and maintenance of project controls tools, development of the project schedule, coordination of internal and CITY meetings, sub - consultant management, review of project schedule and budget, invoicing, and CITY communications. Project management activities also will involve coordination of the production of deliverable work items, including: 1.1 Regular Project Reporting, Invoicing, and Scheduling CONSULTANT will prepare monthly progress reports for the duration of the project (one per month based on the project schedule) that will be used to monitor performance. The report will be produced and updated, as reasonably required, and will include the following information: • Master PROJECT Schedule • Key PROJECT Milestone Summary • Look -ahead Schedule • Regular Progress Report (monthly) • Project Risk Summary • Project Change Log The report will be stored on the Project Collaboration Portal (SharePoint Site). CONSULTANT will Track the progress of the Project and Prepare a Microsoft Project schedule (Schedule) and provide updates including revisions to bring the Project back on schedule if behind. The updated Schedule will be provided to the Owner at monthly meetings during the Project. CONSULTANT will prepare monthly invoices that reflect the services completed each month that aligns with the information provided in the monthly reports. Invoices will present information consistent with the reimbursement terms of the contract. The format for invoices will be CONSULTANT'S selected format that complies with all finding agency requirements. 1.2 Project Execution Plan CONSULTANT will review the Program Project Execution Plan (PXP) (completed by Ardurra) and develop a specific Package 3 PXP that will guide the project work. The PXP will include a work breakdown structure (WBS) that will be used as the basis for the development of the project schedule and identification of the critical path. Communications protocols will be developed as part of the PXP and will identify key communication pathways and serve to facilitate effective communications amongst key team members and stakeholders. The majority of the PXP input will be developed as part of the PXP subtask. In general, unless otherwise noted in this SOW or agreed upon by CONSULTANT and the CITY, meeting agenda and materials will be provided by CONSULTANT to the CITY a minimum of 24 hours in advance of the meeting, and CONSULTANT will provide meeting summaries within five (5) working days of meetings. The PXP will be provided to the CITY, and updated as needed throughout the life of the project. The CONSULTANT will load and maintain the current PXP on the Project Collaboration Portal site. Page 8 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 Deliverables: • Draft Project Execution Plan and updates as reasonably required 1.3 Project Kick-off Meeting CONSULTANT will conduct a project initiation meeting with CITY Staff within 10 working days following notice to proceed. The purpose of the kick-off meeting will be to identify success factors, obtain equipment and process preferences, identify previously studied alignments, brainstorm potential design solutions, and establish a clear set of objectives for the project based on CITY input and consultation with senior technical staff. In addition, the Project Kick-off meeting will address the following items: • WBS review • Project deliverables • Project schedule • Project team member responsibilities and authorities • Project management protocols • Communications protocols • Risk Management • Initial Project Delivery Framework • Project Working Groups composition, charters, and meeting schedules • Initial technical tasks to be accomplished • Guidelines to be applied during field activities • Coordination needs between CONSULTANT and CITY • Other topics identified by CONSULTANT or CITY The CONSULTANT Project Manager will facilitate the Project Kick-off meeting. CONSULTANT will prepare and distribute a meeting agenda and information 24 hours in advance of the meeting and prepare a meeting summary. A project responsibility assignment matrix (RAM) will be prepared that documents who is responsible and authorized to make PROJECT decisions. 1.4 Project Meetings & Workshops CONSULTANT will prepare supporting materials to provide additional background and context to be discussed at monthly progress meetings, coordination meetings, and workshops. CONSULTANT will prepare and distribute a meeting agenda and materials 24 hours in advance of each meeting, facilitate the meetings, and prepare meeting summaries to be submitted to Protrack. The level of effort is as follows: 1. Project meetings as follows: o Initial coordination meetings (up to 5) during the first 12 weeks to fast track conceptual design. o Monthly progress meetings with the CITY, provide meeting materials, agenda, and meeting minutes with action log. o Project progress/coordination conference calls between the monthly meetings as reasonably required. These reviews shall be performed on plans, specification, calculations, reports, and technical memorandum prior to CITY review. The CONSULTANT's QA/QC plan shall be provided in the PXP, and results of the completed reviews and responses shall be provided to the CITY. CONSULTANT shall work with the CITY Project Manager, and other designed CITY personnel, to coordinate CITY review of final reports. Develop Preliminary System Curves. b. Establish pump flows and head design conditions and preliminary pump options, including pump size, pump type (horizontal or vertical, number of pumps, fixed speed or VFD, and pump phasing), and pump motors. The evaluation will look at pump capital and operating costs, including performance, maintenance costs, parts availability, reliability, life cycle and CITY preferences). c. Establish ground storage tank hydraulics, configurations, and mixing options. Consider height to meet hydraulic and aesthetic requirements. Coordinate with package 2 for disinfectant contact time needs. d. Evaluate pump control valve and isolation valve options for type of valve, actuator, and back-up power requirements. e. Evaluate preliminary surge control options and control equipment. f. Determine Instrumentation and Control and develop process and flow diagrams (PFD). g. Identify required appurtenances, based upon code requirements, maintenance, and CITY preference. 3.1.2 Site Layout a. Develop a Package 3 Site Layout of the pump station including ground storage tanks, parking, energy efficient LED area lighting, access roads and other appurtenances within the confines of the public access area of the site; tank layout for constructability, maintenance, and serviceability; pump, electrical, and control room layouts; bridge crane layout for access and serviceability; develop security and fencing requirements. Develop preliminary layout of security and site fencing. b. Develop a Yard Piping Plan for Package 3 facilities (pump station and ground storage tanks) including piping and valve layout options for ease of operations and maintenance; site piping, valves, meters, and appurtenances layout; material and equipment recommendations; Coordination of Chemical injection locations within the ground storage tanks (GSTs) and the pump station with Package 2. c. Develop a Drainage Plan including site grading, site drainage, flood control, tank overflow drainage within the public access areas of the site. Coordinate with Package 2 for overall site drainage. d. Develop a Horizontal Control and Grading Plan including layout of site roads, parking and paving, including fire lanes to meet Fire Code requirements within the Page 12 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 public access area of the site. Coordinate with Package 2 for overall site access, paving, and grading. e. Determine and incorporate site development regulatory requirements utilizing the Unified Development Code (Chapter 4). f. Coordinate with and utilize system security requirements provided by Package 2 to determine locations for video surveillance and access control for the public areas. h. Recommend best practices for equipment and layout. Consultant shall conduct a Pump Station Layout and Pump Selection workshop with the CITY to establish pump station design criteria. Deliverables: • Pump Station and Ground Storage Tanks Design Criteria and Layout Technical Memorandum 3.2 TM 2: Architectural Requirements & Renderings CONSULTANT shall complete the following tasks and summarize in a technical memorandum the following: 3.2.1 Initial Architectural Criteria for Program Workshop Coordinate and conduct workshop with CITY and other consultants to develop architectural criteria to be applied across required elements. 3.2.2 Architectural Exhibits, Renderings, and Drawings Develop architectural Plans, elevations, sections, and finish schedule for an administration/pump building, including: a. Develop unified Architectural design criteria for the pump station and treatment plant site. b. Develop space relationship diagram exhibits using CITY standards and preferences on material selections, appearance, maintenance and life cycle cost. Evaluate options for improved daylighting while minimizing glare and other architectural features. c. Develop a preliminary landscape layout and narrative of the plant site including perimeter fencing and access gates. d. Develop a Preliminary Code Analysis / Zoning Research/ Narrative. e. Develop 3D architectural renderings for interior and exterior public access areas of the site that meet the requirements of the Uniform Development Committee for use for Predevelopment Review Approval by the CITY. f. Conduct a Workshop with CITY to present renderings and incorporate CITY's recommendations. Workshop will be conducted using Stantec's VR technology. g. Conduct Architectural Criteria Adoption for Program workshop with the CITY to establish design criteria. Consultant shall conduct an Initial Architectural Criteria for Program and a Architectural Criteria Adoption for Program workshop with the CITY to establish architectural design criteria. Deliverables: • Architectural Requirements & Renderings Technical Memorandum 3.3 TM 3 HVAC, Plumbing, and Building Automation Services CONSULTANT shall complete the following tasks and summarize in a technical memorandum the following: 3.3.1 Develop Preliminary Design Criteria and Calculations for the following: a. Sanitary sewer, drainage, electrical, HVAC system, fire suppression, and natural gas (if needed). b. Develop criteria and preliminary calculations for heating and cooling the facility accounting for building code requirements and the CITY Standards. Provide input to the architectural criteria for exposed ductwork. Utilize modeling software to establish cooling demands to facilitate HVAC equipment selection. Incorporate a building automation system utilizing the CITY Standards. 3.3.2 Preliminary Exhibits and Drawings a. Prepare preliminary space layouts, floor plans, and control schematics for the pump station building HVAC & Plumbing equipment & fixtures. b. Identify specifications for inclusion in the specification table of contents. c. Preliminary Diagrams and Schematics, HVAC & automation control schematics, Preliminary Schedules, HVAC equipment schedule, and Plumbing equipment & fixture schedules Consultant shall conduct an HVAC, Plumbing, and Building Automation Standardization workshop with the CITY to establish pump station design criteria. Deliverables: • HVAC, Plumbing, and Building Automation Services Technical Memorandum 3.4 TM 4 Electrical, Instrumentation, and Control Requirements CONSULTANT, in conjunction with the CITY's operations staff, shall develop Electrical, Instrumentation, and Control design criteria for the site and summarize in a technical memorandum the following: 3.4.1 Preliminary Calculations (Power & Site lighting) a. Prepare preliminary power model and illumination calculations Page 14 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 b. Estimate power loads based upon the Pump Selection and power loads of other equipment to be provided to Package 2 consultant for power feed design. Power drops, backup power, and electrical building to be designed by others c. Evaluate power systems options. Evaluate starter types (across the line, soft starter, variable frequency drives) and coordinate with other packages for consistency. Develop one -line diagrams. The evaluation will review and analyze equipment capital costs, performance, maintenance costs, availability of parts, reliability, and CITY preferences. 3.4.2 Coordinate Integration Requirements a. Coordinate Integration Requirements for the components associated with Package 3 and the plant's proposed supervisory control and data acquisition (SCADA) system being designed by others. 3.4.3 Preliminary Exhibits and Drawings a. Development of control hierarchy and amount of monitoring and control at local and remote levels. b. Type and redundancy needs for analyzers and instrumentation as reasonably required for operations and maintenance, and mandated by permit requirements. c. Prepare preliminary space layouts for site and building electrical equipment sizes and locations. d. Coordinate lighting and building automation with CITY's preference. e. Prepare preliminary floor plans for the pump station building electrical equipment. f. Prepare preliminary electrical, controls and security schematics. Assumptions for Electrical, Instrumentation, and Controls: 1. Electrical equipment manufacture and type will be consistent between the three packages. 2. Site and building lighting will be consistent between the three packages and will utilize energy efficient LED lighting sources. 3. Site and building access control and intruder detection will be consistent between the three packages and may include site perimeter. 4. The pump station capacity will be initially designed for 10 MGD flow with space for 30 MGD buildout, but will be controlled by pressure algorithms. Consultant shall conduct an Electrical, Instrumentation, and Controls Standardization workshop with the CITY to establish pump station design criteria. Deliverables: • Electrical, Instrumentation, and Controls Requirements Technical Memorandum Page 15 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 Task 4: Waterline Conceptual Design & Route Study The CONSULTANT shall complete a route study for the waterline and documents findings, conceptual design, and recommendations in a technical memorandum (TM). The following activities are included in this Task. 4.1 TM 5: Water Transmission Route Study Evaluate and establish routes for the proposed waterline. The study shall take into consideration the outcomes and conclusions presented in Task 3.1.1: Pump Station and Ground Storage Tanks Design and Hydraulics, Task 6: Permitting and Environmental Requirements, and Task 8: Real Estate and Easement Acquisition Task. 4.1.1 Data Collection and Review Collect and review existing data associated with the Project alignment survey, design and easements. Review previous studies and reports and any other documents associated with the Project. Perform field walks of potential alignments. 4.1.2 Route Study The following alignments are the basis for the Route Study: 1. Segment 1: From the Surface Water Plant (SWP), the waterline exits the SWP at Airline Rd and continues east along GCWA American Canal for approximately 28,100 LF to a connection point at Masters Rd. 2. Segment 2 extends from the SWP and continues north along Airline Rd for approximately 8,100 LF to a take point just south of Broadway St. 3. Segment 3 will continue from Segment 2 at the intersection of Airline Rd and Dallas (County Rd 48) and continue east to Kirby Rd for approximately 5,800 LF where the water line turns north for approximately 900 LF to a take point just south of Carson Ave. 4. Segment 4 will continue from Segment 2 at the intersection of Airline Rd and Dallas (County Rd 48) and continue west for approximately 10,000 LF to Almeda (FM 521). From Almeda (FM 521), the water line will turn north and continue along Almeda (FM 521) for approximately 6,000 LF to a take point at Broadway St. The route study will evaluate Segments 2, 3 and 4 at a desktop level to identify fatal flaws. However, the segments are considered to be set within the defined corridor and alternate routes will not be considered. The route study will evaluate various routes for Segment 1 at a desktop level and conduct a Waterline Transmission Route Study Alternatives Definition workshop with the CITY to establish up to two (2) alternatives in addition to the described corridor for further investigation. The selected Segment 1 alternatives will be further evaluated based on the available data and developed selection criteria including, constructability, cost, traffic/community Page 16 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 impacts, environmental impacts, right of way needs, obstructions, and serviceability. The following items will be considered in the evaluation: 1. Potential design complications (utility conflicts, traffic impacts, public impacts, existing wetlands, pipe material, crossing requirements, O&M issues) 2. Easement/parcel analysis (Task 8) 3. Permitting/coordination issues (Task 6 and 8) 4. Environmental clearances (Task 6 and 8) 5. Coordination with Stakeholders to identify requirements and review feasibility of line locations within the following jurisdiction: a. City of Pearland Staff & Owner's Representative b. Gulf Coast Water Authority c. Brazoria County d. Texas Department of Transportation e. Franchise Utilities 6. Develop ROW restriction and preliminary boundary conditions along proposed Alignment a. Prepare list of properties requiring easements and an estimate of easements costs. Consultant shall conduct a Transmission Route Study Alternatives Evaluation workshop with the CITY to evaluate waterline routes and establish recommended alignments for the preliminary design. Deliverables: • Water Transmission Route Study Technical Memorandum 4.1.3 TM 6: Hydraulic Analysis and Modeling Collect and review existing data associated with the Project alignment survey, design and easements. Review previous studies and reports and any other documents associated with the Project. 1. Coordinate with Owner's Representative to review water masterplan update. Masterplan demand projections will be used as the basis for hydraulic calculations performed. 2. Provide proposed improvement information to Owner's Representative to update/finalize water system Hydraulic Model. 3. Perform Hydraulic steady state and transient calculations/model for Pumps, GSTs, and Transmission lines for ultimate and interim demands. 4. Size and Phase GSTs, Pumps & Transmission Lines. 5. Coordinate with Other Consultants on GST's and Pumps to improve efficiencies and operations. 6. Obtain and review existing studies and reports. Attend meetings with CITY to identify goals, objectives, constraints, and other issues that may impact the system operation and design. Coordinate with CITY to estimate operating flows and Page 17 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 pressures and operating protocol for the Pump Station, Ground Storage Tanks and line work. 7. Based upon data provided, calculate pumping demands (minimum, average, and maximum) over the design period at each delivery point. 8. Evaluate and develop operating protocols for associated delivery points. Evaluation shall include pumping rates, power consumption, storage requirements, ease of operations, and regulatory requirements. In coordination with Package 2 for secondary and final treatment requirements. 9. Coordinate with Owner's Representative for updating hydraulic model of system to assist in evaluation of hydraulics, power costs, and storage requirements. Deliverables: • Hydraulic Modeling Technical Memorandum 4.2 TM 7: Water Quality Study CONSULTANT shall complete the following tasks and summarize in a technical memorandum the following: 1. Coordinate with CITY and Other Consultants to review water quality data, treatment outcomes, and proposed blended water profile. System water quality analysis and design is by others. 2. Evaluate storage tank mixing and water quality control requirements, including active and passive systems. 3. Evaluate alternate chemical injection locations, sampling points and online analyzers with capabilities to trim chlorine on real-time basis, and space to incorporate future passivating chemical (e.g., caustic, orthophosphate). 4. Document requirements for appurtenances for water quality control and monitoring. 5. Develop Instrumentation and Control and process flow diagrams (PFD). Deliverables: • Water Quality Technical Memorandum 4.3 TM 8: Pipeline Design Criteria CONSULTANT will evaluate pipe materials to establish pipeline design criteria, CONSULTANT shall complete the following tasks and summarize in a technical memorandum the following: Evaluation criteria will consist of: • Diameter (Evaluation may result in different materials for large or small diameter pipe) • Cost • Corrosion resistance and active/passive corrosion protection system, if needed • Production availability • Compatibility with existing installations and operation selected Page 18 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 • Compatibility with trenchless installation (if reasonably necessary) • Material Appurtenances to be evaluated consist of: • In-line valves and spacing Access manways and spacing (if reasonably necessary) • Air valves • Blow -offs • Vaults and manholes • Cathodic protection • Trench zone backfill • Thrust restraint • Fire hydrants CITY standards or CONSULTANT standards will be used wherever possible. Recommendations made under this phase may be further refined under future design phases. The CONSULTANT will meet with the CITY once to evaluate, rank the alternatives and select alternatives for implementation. Documentation of the selections will be compiled and submitted in a draft Technical Memorandum. Deliverables: • Pipeline Design Criteria Technical Memorandum Page 19 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 Task 5 Force Main Conceptual Design The CONSULTANT shall complete a route study for the force main from the onsite domestic lift station and document the findings, conceptual design, and recommendations in a technical memorandum (TM). The following activities are included in this Task. 5.1 TM 9: Force Main Conceptual Design CONSULTANT shall evaluate up to two alignments for the proposed force main. The study shall take into consideration the outcomes and conclusions presented in Task 4: Waterline Conceptual Design and Route Study, Task 6: Permitting and Funding Requirements, and Task 8.3: Real Estate and Easement Acquisition Task. 5.1.1 Data Collection and Review Collect and review existing data associated with the Project alignment survey, design and easements. 5.1.2 Verify Alignment CONSULTANT shall verify the following alignment of the force main from the SWP to the north along Airline Rd for approximately 6,000 LF to a discharge point at an existing manhole, south of Broadway St. The CONSULANT will verify the following: 1. Easement/parcel analysis 2. Permitting/coordination issues (Task 6) 3. Coordination with Stakeholders to identify requirements and review feasibility of line locations within the following jurisdiction: a. City of Pearland Staff & Owner's Representative b. Gulf Coast Water Authority c. Brazoria County d. Texas Department of Transportation e. Franchise Utilities 4. Additional permitting and environmental support will be compensated as part of Task 8. 6.1 TM 10: Permitting and Environmental Requirements CONSULTANT shall conduct a desktop level study to identify permits and fees required for the project. Conduct a desktop level study of the following site factors and other factors as appropriate based on available public information to determine if further environmental assessment (phase 1 and/or phase 2) is needed: 1. Environmental factors based on readily available public data. 2. Jurisdictional waters and wetlands. 3. Threatened and endangered species occurrence, soluble soils, and critical habitat. 4. Hazardous or contaminated sites based on readily available public data. 5. Archeological and historical sites based on readily available public data. 6. Finding to be incorporated into ROW and Route Studies. Deliverables: • Permitting and Environmental Requirements Technical Memorandum Page 21 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 Task 7: Preliminary Engineering Report (PER) The CONSULTANT shall develop a Preliminary Engineering Report (PER) for approval, revised as reasonably required, from a consolidated set of review comments from the CITY. The PER will address the following items: 7.1 Development of DRAFT Preliminary Engineering Report CONSULTANT shall develop preliminary design criteria for the analysis of the pump station and pipeline based on the individual Technical Memorandums prepared. If needed to expedite a portion of the Project, the PER will be split into a PER for the water transmission and another for the pump station. The work will culminate in the preparation of the Project Preliminary Engineering Report, which will contain the following information: • Introduction • Executive Summary • Pump Station and Ground Storage Tanks Layout • Architectural Requirements & Renderings • HVAC, Plumbing, and Building Automation Services • Electrical, Instrumentation, and Controls Requirements • Water Transmission Route Study • Hydraulic Modeling • Water Quality Study • Pipeline Design Criteria • Force Main Conceptual Design • Permitting Requirements • Texas Water Development Board (TWDB) Funding Assistance • Basis of Design • Preliminary 30% Design Drawings • List of Final Design Specifications • 30% Level Opinion of Probable Construction Cost • Preliminary Project Construction Schedule Page 22 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 7.1.1 Basis of Design and Preliminary Design Drawings (included in PER) The CONSULTANT shall develop a Basis of Design as a collection of design elements which will be updated at each milestone in future phases of the design. The Basis of Design will address the following items: • Equipment sizing and location • Pump, motor, and tank sizing • Pipe design materials and sizing • Mechanical, Electrical, Instrumentation and Controls, Architectural, Landscaping, Civil, Hydraulics, HVAC, and Corrosion design criteria Develop preliminary design drawings, including the following disciplines and their respective level of completion: a. Process Instrumentation Diagrams (PIDs) to 30% b. Process Mechanical to 30% c. Site Civil, including site, yard piping, grading, and paving plans, to 30% d. Structural 10% e. Electrical to 10% f. Architectural to 30% g. HVAC/Plumbing to 10% h. Water Transmission plan and profiles and details to 30% i. Force Mains plan and profiles and details to 30% Deliverables: • Basis of Design (to be included in PER) • 30% Design Drawings 7.1.2 Preliminary Design Opinion of Probable Construction Cost (OPCC) CONSULTANT shall develop an engineer's OPCC for the recommended improvements including scope and estimating contingency appropriate for the level of design. An AACE International Class 4 cost estimate is assumed for this level of design. The OPCC will be prepared in accordance with American Association of Cost Engineering (AACE) International Standards. CONSULTANT's opinions, recommendations and assessments are limited by a) the accuracy and completeness of information upon which it may reasonably rely, b) schedule constraints or scope limitations, c) unknown or variable site or other conditions, d) other factors beyond CONSULTANT's control. Any estimates as to construction costs are limited by a lack of control over financial and/or market conditions, including the future price of labor, materials, and prospective bidding environments and procedures. CONSULTANT does not warrant or guarantee the accuracy or completeness of its opinion of cost estimating Services to the extent impacted by these limitations. Page 23 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 7.1.3 Preliminary Construction Schedule CONSULTANT will coordinate with the CITY and Owner's Representative to develop a preliminary construction schedule. 7.1.4 Draft PER Review Workshop CITY will attend a one day PER review workshop session conducted by CONSULTANT upon completion of the draft PER and provide comments and feedback on the draft PER for consideration by the CONSULTANT. It is expected that all CITY comments and suggestions will be received within ten (10) working days from the workshop in accordance with the agreed upon Project schedule. CONSULTANT shall document the results of the workshop and provide responses in writing to the CITY's comments and suggestions within five (10) working days from receipt in accordance with the agreed upon Project schedule. Results and conclusions reached during this workshop and follow up. 7.1.5 Final Preliminary Engineering Report Based on the results of the Draft PER Review Workshop, and subsequent comments received from the CITY within ten (10) working days of the workshop, CONSULTANT shall finalize the PER and shall submit six (6) hard copies of the PER along with searchable .PDF's, .DWF's and electronic files in original format will be provided. Deliverables: 1. The CONSULTANT shall submit six (6) copies of the draft preliminary engineering report, with CD copy in PDF format provided with each. 2. After receipt of review comments, the CONSULTANT shall provide a written response to review comments. 3. Draft PER Workshop 4. CONSULTANT shall incorporate review comments, as appropriate, and submit six (6) copies of the final preliminary engineering report, with CD copy in PDF format provided with each. Page 24 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 Task 8: Additional Services The following tasks are to be provided on an as needed basis. The Level of effort and payment terms will be negotiated when services are requested by the CITY. The level of effort herein is based on the anticipated scope provided below, however, the full extent of the scope will be defined prior to CITY authorization. 8.1 Survey CONSULTANT will perform design topographical surveying for the ground storage tanks, pump station / administrative building, and along the waterline and force main alignment. Permanent control points based on CITY bench marks to CITY datum will be established. The following items will be included in the Survey scope: 8.1.1 Topographic Survey (Package #3 Site): 1. Location of structures and above ground improvements 2. Surface elevations across the survey area at 25 feet intervals or at changes in grade. Top of canal/ditch banks and centerlines of the canals/ditches, if present. 3. Extents of retaining walls, bridges and bridge abutments, if present. 4. Extents and centerline of roads (include type of surfacing), as well as paths, sidewalks, alley approaches, drive approaches, lane markings, traffic signs, road surface transitions, and other transportation related items. 5. Top of curbs, gutter flow lines, and other drainage flow paths. 6. The location of trees and hedges 6 -inches in diameter and larger. Indicate location, diameter and species. Show the extents of wooded areas. 7. Power, utility and light poles, overhead power lines, guy wires, anchors, electric vaults, fencing, sheds/outbuildings, barriers, gates, signs, and telephone pedestals. 8. Remobilization and location of geotechnical borings upon completion of drilling. 9. Prepare drawing to identify project control and benchmarks and bore locations for inclusion in the plan sets. Survey will use/tie into CITY control monuments. 8.1.2 Topographic Survey (Package #3 Waterline and Force Main): Specific corridors to be develop after conclusion of Route Studies. Level of effort is based on survey of 300 foot wide, 59,000 linear foot corridor. 1. Identification of the adjacent property for the purposes of establishing the existing property corners, as well as identification of adjacent easements and right- of - ways. 2. Location of structures and above ground improvements 3. Surface elevations across the survey area at 50 feet intervals or at changes in grade. Top of canal/ditch banks and centerlines of the canals/ditches, if present. 4. Extents of retaining walls, bridges and bridge abutments, if present. 5. Survey will use/tie into CITY control monuments. 8.2 Subsurface Utility Engineering: Location of subsurface utilities at identified locations along the preferred waterline and force main alignment shall be mapped. CONSULTANT shall be responsible for recording contact information associated with these utilities, including utility affiliation, contact name, address, and phone number. Utilities that cannot be directly observed shall have their locations estimated by record drawings or from utility locate marks supplied by the utility owner or by a 3rd party locate service. Specific subsurface utilities to identify in the survey include the following: 1. Existing water mains and observable appurtenances such as fire hydrants and water valve boxes. The elevation of the top of valve operator nuts shall also be recorded. 2. Existing storm and sanitary sewers, manholes, force mains, storm inlets, culverts, and associated items. Manhole and storm drain inlet information shall include manhole lid center location and elevation of pipe inverts. Manholes outside of the survey boundary shall also be surveyed if pipes are suspected to be within the survey boundaries. 3. Fiber optic, phone, and other communication utilities. 4. Buried power (including duct banks), traffic signal, and traffic loops. 5. Natural gas and other petroleum transmission and distribution systems. 6. Any other underground structures or utility such as underground tanks, thrust blocks, lift stations, vaults. 7. Chemical feed lines. 8. Provide traffic control within the designated work area while designating and locating the subsurface utilities. Traffic control is to be maintained in accordance with applicable standards. Provide safety devices, signs and/or other safety equipment. 9. Utilizing conventional electronic designating equipment together with Ground Penetrating Radar (GPR), designate and mark with paint and/or flags the horizontal location of found underground utilities (larger than 2" in diameter). 10. Survey collected utility information will be used to develop the Civil 3D model. 11. Based upon Engineering considerations including above information and proposed design, CONSULTANT shall provide a Utility Conflict Matrix containing potential utility conflicts by appropriate coordinates. 12. Utilizing the Utility Conflict Matrix described above, survey and pre -stake each of the utility conflicts. Active utilities that cannot be accurately located shall be recorded according to the best available information and shall be labeled "LOCATION NOT KNOWN. FIELD VERIFY". Abandoned utilities whose locations are not known shall be recorded to the best Page 26 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 available information and shall be labeled as abandoned and that the location is not known. A note indicating that the utility is abandoned shall also be recorded. After review of the survey data, CONSULTANT and/or CITY may require that buried utilities that cannot be located accurately be potholed for verification. 8.3 Geotechnical 8.3.1 Geotechnical Report (Pump Station) CONSULTANT will perform design geotechnical drilling and a geotechnical report for the pump station site. Permanent control points based on CITY bench marks to USGS datum will be established. The following items will be included in the geotechnical scope: 1. Provide an appropriate number of borings and piezometers for design of the package 3 components. Borings will be backfilled. Anticipated are eight (8) bores for the Ground Storage Tanks, four (4) bores for the Pump Building, two (2) bores for the Parking Lot, and two (2) bores for the Access Road. 2. Borings will be used to estimate site stratigraphy, and soil samples will be collected for lab testing. All specified field and lab standards will be prepared per ASTM standards. 3. Provide a geotechnical report with bore logs and test data, groundwater conditions, foundation recommendations for structures, pavement recommendations, structural fill requirements, and general earthwork recommendations. Deliverables: • Draft and final Pump Station Geotechnical Report 8.3.2 Geotechnical Report (Pipelines) CONSULTANT will perform design geotechnical drilling and a geotechnical report for the pipeline corridors. Permanent control points based on CITY bench marks to USGS datum will be established. The following items will be included in the geotechnical scope: 1. Provide an appropriate number of borings and piezometers for design of the water transmission and sewer force main facilities. Borings will be backfilled. Anticipated are bores at approximately 500-1000 foot spacing and at potential tunneling locations (80 bores). Locations to be identified after conclusion of Route Studies. 2. Borings will be used to estimate site stratigraphy, and soil samples will be collected for lab testing. All specified field and lab standards will be prepared per ASTM standards. 3. Provide a geotechnical report with bore logs and test data, groundwater conditions, foundation recommendations for structures, pavement recommendations, structural fill requirements, and general earthwork recommendations. Deliverables: • Draft and final Pipelines Geotechnical Report Page 27 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 8.4 Right of Way and Easement Study An initial ROW easement/parcel analysis will be completed to identify restrictions and preliminary boundary conditions along the proposed routes. The results of this study will be incorporated into the waterline and force main route studies to identify fatal flaws early and recommend the preferred route. Specific activities include: 1. Establishment of Right of Ways and easements utilizing GIS data and title research. 2. Identification of the adjacent property for the purposes of establishing the existing property corners, as well as identification of adjacent easements and right-of- ways for the purposes of accurately establishing buffer zone requirements. 3. Establishment Rights of entry that would be needed during the final Design Phase. 4. Identification of temporary easements for construction access. 5. Coordinate with Gulf Coast Water Authority (GCWA) to discuss requirements and feasibility of proposed waterline within GCWA ROW. 6. Coordinate with TxDOT to identify requirements for crossing TxDOT ROW. 7. Conduct field reconnaissance (walk routes, photo document, identify potential obstructions, etc.) 8. Develop Right-of-Way(s) restriction and preliminary boundary conditions along proposed alignment. 9. Coordinate with Pearland Staff and CITY's Owners Representative (Ardurra) to develop a streamlined process for accelerating required acquisitions to be completed in Tasks 4 and 5. 10. Develop initial stakeholder outreach and engagement plan to support Real Estate and Easement Acquisition task. 1 1. Attend required council meetings. Conduct a workshop with the CITY to establish right of way needs. 8.5 Right -of -Way and Easement Acquisition CONSULTANT shall complete the following tasks: 1. Obtain title reports on properties involving right-of-way acquisition, permanent easement or temporary construction access. 2. Write full legal descriptions for property and easement acquisition based on figures with meets and bounds provided by CONSULTANT 3. Contact, negotiate and obtain the required ROW/easements. If the tract is encumbered, prior to payment, prepare and/or obtain the relative curative documents. 4. Prepare property acquisition figures in the listed parcel areas. 5. Prepare figures for existing encroachment conflict improvements in the listed parcel areas. 8.5.1 Communication 1. Attend monthly meeting with appropriate CITY staff. Date, time and location are determined by CITY staff. Page 28 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 2. Provide monthly summaries of project expenses including amounts authorized, amounts paid and budget forecasting as required by CITY staff. Will work with CITY staff to determine appropriate format. 3. Maintain current status reports of all parcels and project activities and provide weekly status reports to CITY staff. Will work with CITY staff to determine appropriate format. 4. Provide schedule of all areas of work indicating anticipated start and end dates. The reporting format will be determined by CITY staff. 5. Prepare initial property owner contact list for use by CITY staff in distribution of CONSULTANT introduction letters or as determined necessary by the CITY. 8.5.2 File Management 1. Will coordinate with CITY staff to determine format for type of file folders and document order and placement. 2. Prepare invoices utilizing CITY standard payment submission forms with supporting documentation. Supporting documentation requirements are determined by CITY staff. 3. Maintain records of all payments including, but not limited to, check number, amount, date paid, etc. 4. Maintain copies of all correspondence, emails and contacts with property owners. 5. Tum over all files, hard and pdf files to the CITY upon completion of the project or as requested by the CITY. 6. All files shall be accessible and available to the CITY or assignee. 8.5.3 Title and Closing Services 1. Secure preliminary title commitment or preliminary title search, and 5- year sales data from Title Company that will be providing title insurance. 2. The charges from the Title Company for the preliminary title commitments will be paid by the CITY and should not be included in the CONSULTANT's fee schedule. 3. Secure title commitment updates in accordance with insurance rules and requirements for parcel payment submissions. The charges from the Title Company for the update of the title commitment will be paid by the CITY and should not be included in the CONSULTANT's fee schedule. 4. Secure title insurance for all parcels acquired, insuring acceptable title to the CITY. Written approval by the CITY required for any exception. The charges from the Title Company for the title insurance will be paid by the CITY and should not be included in the CONSULTANT's fee schedule. 5. The curative services necessary to provide clear title to the CITY is the responsibility of the CONSULTANT and is to be included in the fee schedule for this service. 6. The CONSULTANT has the responsibility of direct contact with the Title Company to obtain an updated title commitment along with other forms and certified copy of the instrument of conveyance necessary when requesting the Parcel Payment from CITY staff. Page 29 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 7. The CONSULTANT provides closing services in conjunction with the Title Company and will be required to attend closings. 8. Any fee related to obtaining certified court documents and fees for recording same which are not collected at the closing of the parcel shall be paid directly by the CITY. 9. CONSULTANT shall cause the recordation all original instruments immediately after closing at the respective County Clerk's Office. The cost of the recording fees and filing fees are paid by CITY and should not be included in the CONSULTANT'S fee schedule. 8.5.4 Negotiation Services 1. Review right of way, parcel sketches and construction plans provided by the CITY and provide comments when necessary. 2. Verify that legal descriptions, right of way maps, construction plans, survey (if provided) and appraisal reports correspond with each other. 3. Issue all applicable notices in accordance with CITY, State, Federal policies and procedures. 4. Analyze preliminary title report to determine potential title problems, propose and inform CITY of methods to cure title deficiencies. 5. Analyze appraisal and appraisal review reports and confirm the CITY's approved value prior to making offer for each parcel. 6. Prepare and send the letter transmitting the Landowners' Bill of Rights by Certified Mail -Return Receipt Requested (CMRRR). 7. Prepare the initial offer letter, memorandum of agreement, instruments of conveyance, and any other documents required or requested by the CITY on applicable CITY forms. 8. The written offer, appraisal report and required brochures must send to each property owner or the property owner's designated representative through CMRRR. Maintain follow-up contacts and secure the necessary instruments upon acceptance of the offer for the closing. Retain copies of the unsigned CMRRR receipt and the appraisal as support for billing purposes. 9. Respond to property owner inquiries verbally and in writing. Follow up with phone call to schedule a face to face meeting with landowner per request. 10. Prepare a separate negotiator contact report for each parcel. 11. Advise property owner of the Administrative Settlement process. Transmit to the CITY any written counter offer from property owners including supporting documentation. 12. Prepare and mail the documents of conveyance. 13. Appear and provide Expert Witness testimony as a CONSULTANT when requested. 14. Securing a Right of Entry or Possession and Use Agreement is part of general Negotiation Services. Page 30of32 Surface Water Plant Package 3 Scope of Services March 28, 2018 8.5.5. Condemnation Support Services 1. Upon receipt of a copy of the final offer, request an updated title commitment for Eminent Domain from the Title Company or as deemed necessary by the CITY. 2. Prepare a packet containing copies each of the following documents: Commitment, Negotiator's Reports, Appraisal Acknowledgment, Pre -appraisal Contact Sheet, signed and sealed property description, and plat, Final Offer Letter, any correspondence from the land owner or representatives, one original copy of the appraisal report, and any real property records which are relevant to any unusual joiner or service issue. Submit packet to the CITY staff for submission to the Legal Department. 3. Maintain a copy of the condemned parcel. In an event of a judgment/award, consultant shall coordinate with CITY staff to obtain copies of all executed post hearing documents for the condemned parcel. (award, JAO, deposit letter) 4. If a settlement is agreed upon by both parties prior to condemnation, CONSULTANT shall coordinate with CITY staff to complete all necessary procedures to dose the file. 5. Provide all closed parcel files including condemned parcels to CITY. Deliverables: • Turn over the paid draft, Ownership Report, and recorded documents associated therewith to the CITY. 8.6 Permitting and Environmental Services Consultant shall provide additional permitting and environmental support for the regulating agencies identified in Task 6. Because the history and extent of the current site conditions and route are not completely known, CONSULTANT proposes to begin providing the following services, as authorized by the CITY. Specific Permitting Services scope items may include the following: 1. USACE Permitting (including NEPA) 2. TxDOT 3. Gulf Coast Water Authority 4. Brazoria County CONSULTANT shall notify the CITY Project Manager a minimum of fifteen (15) working days in advance of permit application submittal of the required fees to allow the preparation of payment of the application fee and shall also provide a copy of the permitting Agency's fee schedule for each permit required. The CITY will pay all fees for required permits. It is assumed that the permitting will not include endangered species permitting, and is not included in the CONSULTANT Scope of Services. The CONSULTANT shall coordinate with the agencies having permit jurisdiction over the PROJECT and use reasonable professional effort to gain timely approval of permits for the PROJECT. Page 31 of 32 Surface Water Plant Package 3 Scope of Services March 28, 2018 Specific Environmental Services scope items may include the following: 1. Documentation for Categorical Exclusion (CE); or 2. Wetland delineation 3. Performance and submittal of an Environmental Assessment (EA); or 4. Preparation of an Environmental Impact Statement (EIS) 5. Preparing, presenting and attending public meetings as may be recommended by the Texas Water Development Board process. 8.7 Public Outreach and Stakeholder Engagement Consultant shall provide public outreach and stakeholder engagement support services. These activities may include public meetings, Project Fact Sheets and education material, exhibits, community presentations. 8.8 Supplemental Water Quality and Hydraulics Modelling Services Consultant shall provide additional water quality and hydraulic modelling services to refine design requirements or support permitting activities. These tasks may include the following: 1. CFD Modeling of Ground Storage Tanks to optimize inlet and outlet conditions, residence time (baffling for CT) and chemical dispersion. Disinfection CT Study and draft disinfection protocol provided by Others. 2. Develop preliminary process instrumentation and control diagrams for the proposed chlorine -ammonia injection stations. FD Modeling will be conduct to optimize tank inlet and outlet conditions, analyze baffling configurations for the optimization of disinfection protocols. Although passive or active mixing is not anticipated, the CFD modeling may be used to analyze the dispersion of chemicals in the ground storage tanks. b. Tank sizing and configuration. HDR will simulate tank operations during average day and maximum day demand conditions in incorporate various pumping operational protocols and limitations. c. Tank operational simulations will incorporate geotechnical, foundation and aesthetic criteria established for the ground storage tanks. Based on results of the hydraulic model, disinfectant decay coefficient, and water quality dynamics provided by Others, HDR will evaluate the need for water quality maintenance stations along the transmission pipelines. b. Provide recommendation and schematics for chemical injection equipment and appurtenances including process monitoring and control equipment such as residual monitors, flow meters, access and injection vaults and similar appurtenances. c. Develop Process and Instrumentation Diagrams (P&IDs) Key Assumptions: • The chloramine decay curves will be prepared and provided by Others. • The dynamic water quality modeling will be prepared and provided by Others. • The City will provide feedback on system monitoring strategies, and equipment and instrumentation preferences. Deliverables: • The findings of this Task will be presented in Technical Memorandum 7. 4. Task 4.0 Progress Meetings a. HDR will attend meetings with Stantec, the City of Pearland and other consultants on the Project to coordinate Project related components and facilitate information exchange. Key Assumptions: • This proposal anticipates four meeting over the course of Phase 1 of the Project. Deliverables: • HDR will review and comment on meeting agendas and minutes to Stantec. 5. Task 5.0 — Technical Memorandum Preparation and Presentation a. HDR will assemble all data, evaluations, recommendations and supporting documentation into the appropriate Technical Memorandum format and provide to Stantec for review, comment and use. b. HDR will assist Stantec in presenting the Technical Memoranda to the City of Pearland and their representatives. c. HDR will revise the applicable portions of the Technical memoranda based on the comments provided by Stantec, the City of Pearland and their representatives and return the revised document to Stantec. Key Assumptions: • Stantec will provide a standardized Project Technical Memorandum format for the development of the TMs. • This proposal anticipates one set of review comments form Stantec and one set of comments from the City for each Technical Memorandum for which HDR is involved. . The proposed improvements include the following: • Approximately 60,000 linear feet of water line ranging in size from 12" to 36" • Approximately 6,000 linear feet of force main; • Two (2) ground storage tanks, one (1) pump building along with access road and parking lot at the water plant site. It is our understanding that the project is in the preliminary stage (to be ready for 30% submittal) and the water line route, structure location and sizes may alter during the design process. Based on the provided information, the proposed water line and force main will be installed by open cut method of construction except at few locations (approximately 10 locations), what it will be installed by trenchless method of construction. Purpose and Scope The purpose of this study is to explore the subsurface conditions at the proposed site and to develop geotechnical recommendations pertinent to the design and construction of the proposed improvements for the 30% design submittal. The scope of services is based on the information provided to us on February 27, 2018 and our discussions on March 1, 2018 and consists of the following tasks: • provide utilities clearance for new boring locations. It includes: • all Texas One Call referencing with street name and Key Map block Mr. Jarah Parke, P.E., CFM, PMP Proposal No. 1140428099 Page 2 March 6, 2018 number; and ■ mark the borings location and coordinate with representative of utility companies as well as plant representatives to clear the marked boring location. Proposed Water Line and Force Main • Obtain pavement corings for boring access, where applicable; • Drill and sample sixty (60) 20 -foot borings and twenty (20) 30 -foot borings; and • Convert twelve (12) borings into a piezometer for steady state long term water level measurements. Proposed Water Treatment Plant (WTP) • Drill and Sample: • two (2) 120 -foot borings and ten (10) 40 -foot borings for ground storage tanks; • four (4) 30 -foot borings for pump building; and • four (4) 10 -foot borings for access road and parking lot. • Convert two (2) borings into a piezometer for steady state long term water level measurements. The proposed boring/piezometer program is shown on Attachment No. 1. • perform laboratory tests on selected representative soil samples including consolidation tests to determine the engineering properties of the soils and to select design soil parameters; • perform engineering analyses to develop geotechnical recommendations for the design and construction of the proposed water line, force main, ground storage tanks, pump building and access road and parking lot at the water plant site; • perform a limited review of existing fault maps to identify the presence of known active faults that may impact the project; and • prepare a geotechnical report. It is understood that the survey information of the borings will be provided by Stantec. As discussed, we are providing a proposal for Preliminary Engineering Phase Services (Phase 1 only), as a subconsultant to Stantec, for the evaluation and analysis of the force main. Our proposal includes providing route studies and hydraulic calculations for the force main. Summary of Scope of Work for Sanitary Sewer Force Main: 1. Route study to evaluate best potential routes for a force main to service the pump station and treatment facility to a location as specified by Package 2. Included in the Route Study will be hydraulic design for sizing the force main for the design conditions. The route study will evaluate two alignments to determine the best potential routes for the force main. Hydraulic calculations, route alternatives and proposed design conditions will be included in the route study. The options will require coordination with the City of Pearland, which is included in this proposal. If, during the evaluation phase of the PER, we observe the conditions vary greatly from our assumptions, we will provide an amendment to our proposal for your review and approval. BASIC SCOPE OF SERVICES TM 13: Force Main Conceptual Design and Route Study Task 1: Project Management 1. Project Kick -Off meeting with the Stantec 2. Create, Manage, and Update internal Project Schedule 5engineering 3. Manage and Coordinate Project Efforts a) Manage and coordinate project efforts (estimated duration of the project is 6 to 8 months. At the time of this proposal, the schedule is estimated to span from April 2018 to year-end 2018. Schedule will be adjusted accordingly after initial meeting. 4. Quality Control/Quality Assurance a) Perform quality control/quality assurance throughout the project duration on all project deliverables, design calculations, and design report methodology. 5. Periodic Progress Meetings a) Attend and prepare for up to three (3) meetings (in-person or conference calls) through completion of Preliminary Engineering Phase Services. Prepare and distribute meeting summaries as required. Task 2: Force Main Conceptual Design and Route Study 1. Data Collection and Review a. Collect and review existing data associated with the Project alignment survey, design and easements as required, through the prime consultant. Review previous studies and reports and any other documents associated with the Project. 2. Route Study a. The route analysis will include the following alignment as the basis for the Study: i. Force Main extends from the SWP and continues north along Airline Rd for approximately 6,000 LF to a discharge point at an existing manhole, south of Broadway St. b. The route analysis will evaluate two (2) proposed alignments within the corridor described herein. c. Evaluate assembled data to determine the most advantageous route considering selection criteria including constructability, cost, traffic/community impacts, environmental impacts, right of way needs, and serviceability. i. Identify potential design complications (utility conflicts, traffic impacts, public impacts, existing wetlands, pipe material, crossing requirements, O&M issues) ii. Easement/parcel analysis iii. Permitting/coordination issues iv. Coordination with Stakeholders to determine specific requirements and feasibility of line locations including: 1. Draft and Final Technical Memorandum (TM 13) i. Preparation and submission of PER section and TM relating to the force main. The report section will be prepared as a stand-alone document. One draft will be submitted, review comments will be addressed, and the revised report will be finalized. b. Preliminary Design Drawings (30%), Force Main Plan and Profiles (12 sheets estimated) and Details (3 sheets estimated) The report will include force main calculations and methodology of route selection. It is assumed that no survey will be provided. Up to 3 exhibits. c. Preliminary Design Opinion of Probable Construction Cost i. CONSULTANT shall develop an engineer's OPCC for the recommended improvements including scope and estimating contingency appropriate for the level of design. An AACE International Class 5 cost estimate is assumed for this level of design. ii. The OPCC will be prepared in accordance with American Association of Cost Engineering (AACE) International Standards. The fee for performing the above scope of services is $70,860.00. The tasks will be invoiced monthly during the project. Payment is expected 30 days of the invoice date. Exclusions: 1. The proposal does not include: survey, sub -utility excavation (SUE), an archeological study if requested by the Texas Archeological Commission, utility relocation effort, or acquisition of Rights of Way or easements. 2. No geotechnical, environmental services, or permitting are included.
