Ord. 509-754 02-28-05ORDINANCE NO. 509-754 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY LOCATION BEING 2.488 ACRES OF LAND OUT OF LOT 5, HICKORY PLACE SUBDIVISION, ABSTRACT 310, H.T. & B.R.R. COMPANY SURVEY, AS RECORDED IN VOLUME 18, PAGE 333, OF THE PLAT RECORDS OF BRAZORIA COUNTY, TEXAS, CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS (GENERALLY LOCATED SOUTH OF HUGHES RANCH ROAD (CR 403), AND ON THE EAST SIDE OF BRYAN COURT) (APPLICATION NO. 1202) FROM CLASSIFICATION SUBURBAN DEVELOPMENT DISTRICT (SD) TO ESTATE LOT SINGLE FAMILY DWELLING DISTRICT (R-E) AT THE REQUEST OF LARRY AND LADONNA RANDLE, OWNERS, PROVIDING FOR AN AMENDMENT OF THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT. WHEREAS, Larry and Ladonna Randle, owners, filed on November 3, 2004, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A"; and WHEREAS, on the 17th day of January, 2005, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached thereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 2nd day of February, 2005, the Planning and Zoning Commission of the City submitted its report and recommendation to the City Council regarding the proposed amendment application by Larry and Ladonna Randle, owners, 1 ORDINANCE NO. 509-754 whereby the Commission recommended approval of the change of classification for the described property from its existing classification of Suburban Development District (SD) to Estate Lot Single Family Dwelling District (R-E); and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and the recommendation of the Planning and Zoning Commission at a regular meeting on February 14, 2005; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Larry and Ladonna Randle, owners, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Suburban Development District (SD) is hereby zoned to Estate Lot Single Family Dwelling District (R-E), such property being more particularly described as: 2.488 acres of land out of Lot 5, Hickory Place Subdivision, Abstract 310, H.T. & B.R.R. Company Survey, as recorded in Volume 18, Page 333, of the Plat Records of Brazoria County, Texas, City of Pearland, Brazoria County, Texas (Generally Located South of Hughes Ranch Road (CR 403), and on the East Side of Bryan Court) II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been 2 ORDINANCE NO. 509-754 accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. VI. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. 509 and consistent with the approval herein granted for the reclassification of the herein above described property. 3 ORDINANCE NO. 509-754 VII. Company Survey, as recorded in Volume 18, Page 333, of the Plat Records of Brazoria County, Texas, City of Pearland, Brazoria County, Texas GENERAL LOCATION: Generally Located South of Hughes Ranch Road (CR 403), and on the East Side of Bryan Court APPROVAL PROCESS: After this Joint Public Hearing, the requested zone change application will be considered as follows: Planning and Zoning Commission: January 17, 2005 City Council for First Reading: February 14, 2005 City Council for Second Reading: February 28, 2005 SUMMARY: The applicant is requesting a change in zoning on the subject property for single family residential uses. The subject property was annexed into the City in 1998 and subsequently zoned SD. The subject property is currently undeveloped. The applicant has indicated that they plan to construct a single family residence on the subject property if the zone change is approved. The minimum lot size for the R-E district is 21,780 square feet and the minimum lot width is 120 feet. The subject property meets the minimum lot size requirements, as the subject property is over 2 acres in size. However, the subject property does not meet the minimum lot width requirement as the subject property is only approximately 30 feet in width. The applicant has applied for a variance to the lot width requirement, and the variance for lot width was approved by the Zoning Board of Adjustment on January 6, 2005. The applicant will be responsible for complying with all other ordinance requirements, such as yard setback requirements and lot coverage. CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004 update adopted on July 26, 2004) recommends "Suburban Residential — 10,000 square foot Tots" for the subject property and for the surrounding properties on the south side of Hughes Ranch Road. The Comprehensive Plan further indicates that the appropriate zoning districts and guidelines for Suburban Residential — 10,000 square foot lots (a proposed new residential zoning district) have not yet been formulated, and is proposed to be written as part of the Unified Development Code. The proposed zone change provide for an R-E district, which has a minimum lot size of half an acre, and therefore, the proposed zone change conforms to the Comprehensive Plan. ZCA No. 1202 Page 2 JOINT PUBLIC HEARING AGENDA ITEM MEETING OF JANUARY 17, 2005 CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage on Bryan Court, a local/residential street. No other roadways affect the subject property. It appears that the subject property has not yet been platted in accordance with the Subdivision Ordinance. The applicant may be required to submit a plat for the subject property, and the plat would have to be approved and filed prior to the issuance of a building permit. IMPACT ON EXISTING AND FUTURE DEVELOPMENT: Some lots in the vicinity of the subject tract are zoned for single family residences, either R-E or R-1. Many of the lots in the subject area are developed with single family residences, although many are still zoned as SD. Therefore, the proposed zoning for R-E is consistent with existing development and zoning districts within the area. The single family dwelling district with the minimum lot size of 10,000 square feet was discussed in the update of the Comprehensive Plan but is not yet a written ordinance. The subject area is largely developed with larger lots in excess of 10,000 square feet, some of which are zoned R-E and R-1. PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners within 200 feet of the subject property under consideration. A legal notice of public hearing was published in the local newspaper, and a Zoning Sign was placed on the subject property. STAFF RECOMMENDATION: Staff recommends approval of the zone change for R-E, as proposed by the applicant, for the following reasons: 1. The proposed zone change provides for "10,000 Square Foot Suburban Residential" uses as recommended by the Comprehensive Plan, as the minimum lot size for R-E is 21,780 square feet and the subject property is over 2 acres in size. 2. The proposed zone change is consistent with existing R-E and R-1 zoning districts within the subject areas, as well as being consistent with existing single family residential uses within the subject area. 3. The general trend along Hughes Ranch Road is towards larger lots, as can be seen along Bryan Court as well as Hughes Ranch Road.
