T. & B.R.R. WHEREAS, Jan Carrico, applicant for George Ran on behalf of Hattie Mae Wood, Virgle Wood Hawk, Beatrice Wood Theriot, Leslie Gordon Liere, and Richard Douglas Liere, owners, filed on November 29, 2004, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A"; and WHEREAS, on the 17th day of January, 2005, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached thereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of 1 ORDINANCE NO. 509-757 Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 2nd day of February, 2005, the Planning and Zoning Commission of the City submitted its report and recommendation to the City Council regarding the proposed amendment application by Jan Carrico, applicant for George Ran on behalf of Hattie Mae Wood, Virgle Wood Hawk, Beatrice Wood Theriot, Leslie Gordon Liere, and Richard Douglas Liere, owners, whereby the Commission recommended approval of the change of classification for the described property from its existing classification of Suburban Development District (SD) to General Business District (GB); and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and the recommendation of the Planning and Zoning Commission at a regular meeting on February 14, 2005; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Jan Carrico, applicant for George Ran on behalf of Hattie Mae Wood, Virgle Wood Hawk, Beatrice Wood Theriot, Leslie Gordon Liere, and Richard Douglas Liere, owners, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I . The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Suburban Development District (SD) is hereby zoned to General Business District (GB), such property being more particularly described as: 2 ORDINANCE NO. 509-757 15.0832 acres of land, being all of Lot 60 of the Allison Richey Gulf Coast Home Company Subdivision, Section 85, Abstract 304, H. T. & B.R.R. Company Survey, recorded in Volume 2, Page 107 of the Brazoria County Plat Records, City of Pearland, Brazoria County, Texas (Generally Located on the North Side of FM 518 (Broadway Street), and on the West Side of County Road 90 (Hooks Road)) II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. 3 ORDINANCE NO. 509-757 V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. VI. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. 509 and consistent with the approval herein granted for the reclassification of the herein above described property. T. & B.R.R. The subject property was annexed into the City in 1996 and subsequently zoned SD. The subject property is currently undeveloped. The applicant has indicated that they plan to construct a retail center and other general business district uses on the subject property if the zone change is approved. ZCA No. 1203 Page 1 JOINT PUBLIC HEARING AGENDA ITEM MEETING OF JANUARY 17, 2005 SURROUNDING ZONING AND LAND USES: North South East West Zoning Planned Unit Development District (PUD) Land Outside of the City limits of the City of Pearland (ETJ) General Business District (GB) General Business District (GB), and General Business District — Specific Use Permit (GB(S)) Land Use Undeveloped land, but future site of a single family residential subdivision CVS Pharmacy Undeveloped land Retail uses; storage and mini - warehouse uses CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The applicant is requesting a GB zoning district. The minimum lot size for the GB district is 22,500 square feet and the minimum lot width is 150 feet. The subject property meets the minimum lot size requirements, as the subject property is over 15 acres in size and has a lot width greater than 700 feet. Any further subdivision of the subject property will be required to comply with this minimum lot size and lot width. The applicant will be responsible for complying with all other ordinance requirements, such as yard setback requirements and lot coverage. CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004 update adopted on July 26, 2004) recommends "Retail, Office, and Service" uses for the subject property and for the surrounding properties along Broadway Street (FM 518). The Comprehensive Plan further indicates that the appropriate zoning districts for Retail, Office, and Service Uses are the Office and Professional District (OP), the Neighborhood Service District (NS), and the General Business District (GB). Therefore, the proposed zone change conforms to the Comprehensive Plan. CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage on Broadway Street, a major thoroughfare with an ultimate right-of-way of 120 feet. When the subject property is platted for development, if sufficient right-of-way is not available for Broadway Street, the applicant will be responsible for the dedication of any necessary ZCA No. 1203 Page 2 JOINT PUBLIC HEARING AGENDA ITEM MEETING OF JANUARY 17, 2005 additional right-of-way. The subject property will also be affected by the northern extension of County Road 90, also known as Hooks Road, a major collector street with an ultimate right-of-way of 80 feet. Portions of Hooks Road have been constructed in the subdivisions of Sunrise Lakes north of the subject property. The developer of the PUD to the north of the subject propertyis dedicating right-of-way for Hooks Road, and has already submitted a preliminary plat indicating a right-of-way dedication of 40 feet. Since the PUD needs Hooks Road for access to their subdivision, it is Staffs understanding that the developer of the PUD is working with the developer of the retail tract to the east to dedicate and build Hooks Road. Hooks Road will not run directly adjacent to the subject property on the east side. Instead, the right-of-way will need to curve over into the subject property near Broadway Street, in order for Hooks Road to align with CR 90 at a right angle at Broadway Street. It is Staffs understanding that all property owners involved, including the applicant for the subject property, the property owner on the east side of Hooks Road, and the owner of the PUD tract, have met and are working out how the right-of-way will be dedicated by a plat, and any land swaps due to the curve of Hooks Road. As the subject property is platted for development, the applicant will be responsible for the submittal of a traffic impact analysis, in order to determine the impact of the proposed development on adjacent streets and adjacent properties, as well as the locations of drive approaches. IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The tracts to the east and west of the subject property are both zoned general business district. The area along Broadway Street within the city limits is largely developing with general business district uses. The tracts on the south side of Broadway Street are not located within the City limits of the City of Pearland. However, these tracts are developed with various retail, office, service, and commercial uses. The proposed zone change is consistent with other uses and GB zoning districts within the subject area. The applicant will be responsible for the construction of a 6 foot high masonry fence along the northern property line, due to the adjacent residential tract, as the site is developed. PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners within 200 feet of the subject property under consideration. A legal notice of public hearing was published in the local newspaper, and a Zoning Sign_ was placed on the subject property. ZCA No. 1203 Page 3 JOINT PUBLIC HEARING AGENDA ITEM MEETING OF JANUARY 17, 2005 STAFF RECOMMENDATION: Staff recommends approval of the zone change for GB, as proposed by the applicant, for the following reasons: 1. The proposed zone change provides for "Retail, Office, and Service" uses as recommended by the Comprehensive Plan. 2. The proposed zone change is consistent with existing GB zoning districts within the subject areas, as well as being consistent with existing retail, office, service, and commercial uses within the subject area.
