MINUTE'S OF A REGULAR MEETING OF THE CITY COUNCIL OF THE
CITY OF PEARLAND, TEXAS, HELD ON OCTOBER 28, 1965 AT 7:30 P. M.
A regular meeting of the Pearl and City Council was called to order by
Mayor John Kegley in the City Hall at ?:30 P. M. October 28, 1965, with
the following present:

A motion was made by Councilman Nolen, seconded by Councilman Calvin
that the minutes of the regular meeting held on October 14, 1965 be
approved. WHEREUPON, the question was asked and the motion carried, all
Councilmen present voted "aye" with no "noes." Councilmen Sanders and
Cogbill absent at this time.
A motion was made by Councilman Nolen, seconded by Councilman Shukanes
that the minutes of a special meeting held on October 18, 1965 be approved.
WHEREUPON, the question was asked and the motion carried, all Councilmen
present voted "aye" with no "noes." Councilman Sanders absent at this
time.
A motion was made by Councilman Shukanes, seconded by Councilman
Calvin that the following invoices and salaries be paid. WHEREUPON,
the question was asked and the motion carried, all Councilmen present
voted "aye" with no "noes." Councilman Sanders not present at this
time.

The Right -of -Way Committee reported that it could soon proceed with the
drawing up of papers for the additional easement for the industrial road.
Several owners have already agreed with others promising to let the
Committee know within a few days.
Councilman Calvin reported that a major accident had occurred at the
dead-end of Mykawa Road at Orange Street on Tuesday night and he recom-
mended that some tile be placed in the ditch on the north side of Orange
Street and covered over. This might enable a driver who missed the
regular turn to stop before going into the fence and 117,h1l poles across
Orange Street. The Committee will investigate' this problem. Also,
-
it was reported that Mykawa Road was in need of repair in several places.
The City Secretary was instructed to obtain prepared bid forms to be used
in contracting street repairs and other work out of the City Hall.
A motion was made by Calvin, seconded by Sanders that the recent lot
mowing project in Clear Creek Estates be charged to the developer Robinson
and charged against his remaining lots. WHEREUPON, the question was asked

and the motion carried, all Councilmen present voted "aye" with
no "noes."
Councilman Cogbill stated that the garbage dump seemed to be in order.
A motion was made by Councilman Sanders, seconded by Councilman Shukanes,
subject to approval by the City Attorney, that the Building Code be
read for the third and final time next Thursday Night, November 4, 1965.
If the City Attorney rules it illegal to be passed at a special meeting
then the Code will be read in full at the next regular meeting. WHEREUPON,
the question was asked and the motion carried, all Councilmen present
voted "aye" with no "noes."
Mayor Kegley read a letter from Barry Rose offering to sell some of —
his land to the City for a sewage disposal plant. The City Secretary
instructed to write a letter to Mr. Rose stating that the Council knew
nothing of this request and'had already selected a site for the plant
as evidenced by the recent bond vote by the people of Pearland.
C. Lawrence Frye, Captain of the City of Pearland Auxiliary Police force,
made a request that the Council approve the expenditure of up to $25.00
per man for jackets. A total of eight jackets to be purchased. Mayor
Kegley commended Captain Frye on the good work done by the Auxiliary
Police and stated that they were a credit to the City. A motion
was made by Councilman Nolen, seconded by Councilman Sanders that the
City purchase jackets for the Auxiliary Policemen, purchase price not
to exceed $25.00 per man for eight men: WHEREUPON, the question was
asked and the motion carried, all Councilmen voted "aye" with no
"noes."
A motion was made by Councilman Sanders, seconded by Councilman Shukanes
that the motion made in the previous meeting regarding the furnishing
of water for the volunteer firemen on which action was deferred until
now be brought up for action at this time. WHEREUPON, the question was
asked and the motion carried, all Councilmen voted "aye" with no "noes."
The motion was made by Councilman Sanders, seconded by Councilman
Shukanes as follows:
"In recognition of past services to the City by the Pearland Volunteer
Department and as an inducement to increase regular attendance at
fire practice meetings, the City of Pearland will refrain from charging
for water used at the homes of regularly enrolled firemen with the
following conditions to prevail.
1. The above water allowance will be limited to 30 members.
2. Any person receiving the water allowance must be a member
in good standing of -the Fire Department for at least 90
days.
3. Any member missing three consecutive meetings without
a bona fide excuse shall have his water allowance dis-
continued. This allowance shall be reinstated only after
another 90 day probation period has been fulfilled.
4. City employees who are members of the Fire Department
shall be included in this allowance.
5. The Fire Department shall furnish a list monthly of the
qualified water allowance recipients to the City
Secretary.
6. Such allowance not to exceed $5.00 for water only. It

voted "aye" with no "noes."
A motion was made by Councilman Calvin, seconded by Councilman Nolen that
the same provisions and conditions of the above motion apply to the
Auxiliary Police. WHEREUPON, the question was asked and the motion
carried, all Councilmen voted "aye" with no "noes."
Mayor Kegley requested D. R. Armbruster, a member of the Planning
Commission, to start immediately on the street numbering program. Mr.
Milton Farmer was appointed as a special member to serve on this project.
Mr. Frank Barringer, developer of Willowerest Subdivision presented a
copy of the revised plat of Section 2 showing the changed location of
a portion of the utility easement to accomodate a section of storm sewer,
that had to be changed because of other lines.
A motion was made by Councilman Nolen, seconded by Councilman Sanders
that Engineer Walsh be instructed to determine the size of the needed
for the drainage ditch between Westminister Subdivision -and Sherwood
Subdivision. WHEREUPON, the question was asked and the oration carried,
all Councilmen voted "aye" with no "noes.
A motion was made by Councilman Calvin, seconded by Councilman Cogbill
that the Secretary secure sealed bids from local people on prices per
hour to furnish and operate maintainers and maintainers with scarifier
attachment. WHEREUPON, the question was asked and the motion carried,
all Councilmen voted "aye" vqith no"noes."'
A motion was made by Councilman Calvin, seconded by Councilman Cogbill
that City Engineer Walsh be instructed to prepare a bid sheet for road
maintenance and road construction. WHEREUPON, the question was asked
and the motion carried,Iall Councilmen voted "aye" with no "hoes."
A motion was made by Councilman Shukanes, seconded by Councilman Calvin
that Ordinance No. 118 AN ORDINANCE REQUIRING WEEDS AND GRASS TO BE
CUT UPON PREMISES AND THAT RUBBISH AND TRASH BE REMOVED THEREFROM; AND
FIXING A PENALTY FOR FAILURE TO COMPLY WITH SUCH ORDINANCE,.ANDtPROVIDING
THAT SAME SHALL BE DONE BY THE CITY IN THE EVENT OF SUCH FAILURE, -AND
PROVIDING FOR THE FIXING OF A LIEN UPON THE PROPERTY FOR THE EXPENSE
IECURRED IN REMOVING AND DECLARING THAT ALLOWING WEEDS TO GROW AND TRASH
AND RUBBISH TO ACCUMULATE TO BE A NUISANCE; AND DECLARING AN EMERGENCY.
WHEREUPON, the question was asked and the motion carried, all Councilmen
voting "aye" with no "noes."
A motion was made by Councilman Nolen, seconded by Councilman Calvin
that the Public Work's Director be instructed to proceed with the laying
of sewage line to the new home of M. D. Wellhausen. WHEREUPON, the
question was asked and the motion carried, all Councilmen voted "aye"
with no "noes."
A motion was made by Councilman Shukanes, seconded by Councilman Calvin
that Ordinance 43 - passed and approved by the City Council on the
21st day of September, A. D. 1961 be made a part of the Plumbing Ordinance.
Said Ordinance 43 reading in part as follows: AN ORDINANCE REQUIRING ALL
PERSONS, FIRMS OR CORPORATIONS WITHIN THE CITY OF PEAR LAND, TO CONNECT
ON AND USE AVAILABLE FACILITIES IN THE CONNECTIONS WITH EXISTING SANITARY
SEWER AND WATER WHERE SUCH CONNECTIONS RUN ADJACENT TO THEIR PROPERTY
LINES: REQUIRING THE USE OF SEPTIC TANKS AND CONNECTIONS WHERE SUCH
SANITARY SEWER CONNECTIONS ARE NOT AVAILABLE: PROHIBITING THE USE OF
OUTDOOR CLOSETS OR TOILETS OR THE FLOW OF RAW OR UNTREATED SEWERAGE INTO
OPEN DITCHES OR DRAINS: REQUIRING COMPLIANCE WITH THE POLICIES OF USE
AND CONNECTIONS AS ADOPTED BY THE WATER CONTROL AND IMPROVEMENT DISTRICT
WITHIN THE CITY OF PEARLAND: PROVIDING A PENALTY FOR VIOLATION AND
DECLARING AN EMERGENCY: WHEREUPON, the question was asked and the
motion carried, all Councilmen voted "'aye" with no "noes."
Mayor Kegley stated that the regular meeting would be adjourned and that
an executive session would be held immediately.
EXECUTIVE SESSION
A motion was made by Maor Kegley, seconded by Councilman Nolen that
Chief Casey be given a $50.00 per month increase for the reason that
he had not received the customary raise at the end of his probation period
when he was hired, and for the good job he is doing as head of the Police
Department. WHEREUPON, the question was asked and the motion carried
Councilmen Nolen, Calvin, Shukanes and Sanders voted "aye" with Council-
man Cogbill abstaining.
