A regular meeting of the City Council of the City of Pearland was
called to order by Mayor Kegley at 7:30 P. M. in the City Hall on
-May 13, 1965, with the following present:

A motion was made by Councilman Sanders, seconded by Councilman Nolen
that minutes of regular meeting held on April 22, 1965 be approved.
WHEREUPON, the question was asked and the motion carried, all Council-
men voted "aye" with no "noes."
A motion was made by Councilman Sanders, seconded by Councilman Calvin
that minutes of a special meeting held on April 29, 1965 be approved
with corrections. WHEREUPON, the question was asked and the motion
carried, all Councilmen voted "aye" with no "noes.'
A motion was made by Councilman Sanders, seconded by Councilman Nolen
that minutes of a special meeting held on May 3,,1965 be approved.

Motion made by Councilman Nolen, seconded by Councilman Shukanesthat
the Tetter'from Allen Field Enterprises, dated April 29, 1965, regarding
54.818 acres of land in the Perry & Austin League and in the Hoildale
& Coffman Subdivision, in Brazoria and Galveston Counties, Texas, be
referred to the City Engineer and City Attorney for necessary information
as to the ability of the City to Pearland to serve the area mentioned.
WHEREUPON, the question was asked and the motion carried, all Council-
men voted "aye" with no "noes."
Councilman Nolen and Councilman Shukanes of the Subdivision Committee
recommended that the preliminary plat presented by M. N. McGlathery
for Section 3 of Garden Acres is acceptable and ready for the Linen
Plat to be presented to the City. It was necessary for a 20 ft. drain-
age easement be changed to a road easement.
Kelly Sims, Chairman of the Planning Commission warned the City Council
to be very alert to the fact that Brazoria County could be added to
the Clear Creek Basin Authority by an amendment from the floor of either
house, and stated that they would write letters to our congressman and
senator advising them to stop it if such is the case.
The Planning Commission also made the following recommendations:,.
— 1.
The Pearland Planning Commission proposes that the
City Attorney be instructed by the City Council to find
one or more methods by which the City of Pearland may
legally be divided into several subdivisions, and that
said Attorney submit to the Pearland Planning Commission
for further consideration, one or more proposals by which
division can be done within 60 days after instruction.
2.
That the City Council Street and Bridge Committee closely
supervise and co-ordinate the activities of the road
district within the City Limits of Pearland.

3.
That the City Council adhere more strictly to the
existing subdivision ordinance as related to the submission
of plats in order to conserve more City Council time.
4.
That the Planning Commission meet with the City Council
Subdivision Committee on the submission of a subdivision
until final approval by the City Council is in order, thus
conserving more City Council meeting time.
5.
That the City Council begin or deligate a revision of the
subidivision ordinance in existance, in order to close
stop -gap holes which exist in the present ordinance.
— 6.
That the Garbage Committee find a way to enforce the
rule where only people from our area could use the garbage
dump, thereby eliminating out of town people from using
the site.
7. That Councilman Victor Nolen and Planning Commission
member Lloyd Yost secure and make known all plans and
meetings in regards to the long range Water Control
District now being formed by Galveston County.
Councilman. Calvin stated that County Commissioner Jordan has reminded
the City that the sum of $4,000.00 remains in their fund for this fiscal
year.

$6,335.00 be paid to Walsh & McLaren for Engineering service rendered
for the preliminary and design phases for additions to water distribution
system for the City of Pearland, Texas. WHEREUPON, the question was
asked and the motion carried, all Councilmen voted "aye" with no "'noes."
Motion made b Councilman Shukanes, seconded by Councilman Nolen that
the sum of $64,226.17 be paid to Texala Construction Company on
Engineer's Estimate No. B-3 for work completed through April 30, 1965.
WHEIREUPON, the question was asked and the motion carried, all Councilmen
voted "aye" with no "noes."
Motion made by Councilman Shukanes, seconded by Councilman Nolen that
the sum of $37,130.97 be paid to McCarty Construction Company on
Engineer Estimate No. A 4 for work completed through April 30, 1965.
WHEREUPON, the question was asked and the motion carried, all Council-
men voted "aye" with no "noes."
Motion made by Councilman Shukanes, seconded by Councilman Cogbill that
the sum of $1,128.72 be paid to Walsh and McLaren for Engineering
services rendered for the preliminary and design phase for sanitary
sewer laterals in Westminister Subdivision, McGinnis Subdivision
and F. M. 518 extension west. WHEREUPON, the question was asked and
the motion carried, all Councilmen voted "aye" with no "noes."
Motion made by Councilman Shukanes, seconded by Councilman Nolen that
the sum of $3,086.62 be paid to Walsh & McLaren for engineering services
rendered during construction phase of additions to referenced Project
WPC TEX 336 through April 20, 1965. WHEREUPON, the question was asked
and the motion carried, all Councilmen voted' -"aye" with no "noes."
Motion made by Councilman Shukanes, seconded by Councilman Sanders
that the sum of $100,0000.00 be transferred from time deposit, Pearland
State Bank, to the construction fund, with an additional $100,000.00
to be transferred when needed, upon request of W. A. McClellan.
WHEREUPON, the question was asked and the motion carried, all Council-
men voted "aye" with no "noes."
Mayor Kegley acknowledged telegrams from Senator Ralph Yarbrough and
Clark W. Thompson, Congressman, concerning the grant to Pearland of
$220,110 for sewage treatment plant outfall and interceptor lines and
lift stations.
A letter from Public Works Director Escue V. Harris was read regarding
hiring an additional employee for outside work.
After due discussion, a motion was made by Councilman Calvin, seconded
by Councilman Sanders that Public Works Director Escue V. Harris be
instructed to employ another man. WHEREUPON, the question was asked
and the motion carried, all Councilmen voted "aye" with no "noes."
Engineer Walsh reported that he had met with engineers for the Santa
Fe Railway Company concerning the Orange Street crossing and that they
had since sent him some drawings asking for additional irf ormation which
they will prepare.
The following letter was sent to Brazoria County Drainage District No. 4
on May 18, 1965:
" Receipt is acknowledged of your letter of April 30, 1965
addressed to the Mayor and City Council of Pearland, concerning the
Orange Street railroad crossing.
As of this date City Engineer William C. Walsh has met with
the Santa Fe engineers for preliminary discussions. They have since
mailed him some drawirg requesting additional information on which
he is working.
We will let you know as engineering progresses and when right-
of-ways are in order."
Motion made by Councilman(Sanders, seconded by Councilman Calvin that
a check for advance attorney fees in the amount of $1,000.00 be mailed
to Vinson, Elkins, Weems and Searls per their letter in the case of
Bert Jamison vs City of Pearland. WHEREUPON, the question was asked

Motion made by Councilman Shukanes., seconded by Councilman Calvin
that Electrical Ordinance No. 110 - AN ORDINANCE TO BE CALLED "ELECTRICAL
CODE OF PEARLAND" CREATING A BOARD OF ELECTRICAL CODE PRESCRIBING
DUTIES AND QUALIFICATIONS OF BOARD MEMBERS; PROVIDING FOR LICENSING ALL
PERSONS DOTING OR CAUSING TO BE DONE ELECTRICAL WORK; PRESCRIBING LICENSING
FEE; AUTHORIZING REVOCATIONS OF LICENSES; REQUIRING PERMITS TO PERFORM
ELECTRICAL WORK AND PRESCRIBING FEES; PROVIDING EXCEPTIONS; REGULATING
QUALITY, TYPE AND KIND OF 'ELECTRICAL MATERIAL AND MANNER OF INSTALLATION
THEREOF; REFERRING TO LATES REGULARLY PUBLISHED NATIONAL ELECTRIC
CODE AND ADOPTING SAME; REQUIRING PERMITS FOR INSTALLATION OF ELECTRICAL
WIRING, ETC., AND PRESCRIBING FEES THEREFOR; PROVIDING FOR'APPOINTMENT
OF ELECTRICAL INSPECTOR AND INSPECTION OF ALL ELECTRICAL WORK; .PRO-
HIBITING ELECTRICAL SUPPLY COMPANIES FROM FURNISHING"ELECTRIC CURRENT
UNLESS AUTHORIZED BY CITY INSPECTOR; PRESCRIBING IN`qPECTION FEE,
PROVIDING PENALTY; CONTAINING SAVINGS CLAUSE, be approved on the -final

Motion made by Councilman Calvin, seconded by Councilman Nolen that
Amendment to ORDINANCE NO. 110 known as ORDINANCE NO. 110-A be adopted
as follows: AN ORDINANCE AMENDING ORDINANCE NO. 110, KNOWN AS THE
ELECTRICAL CODE OF THE CITY OF PEARLAND, TEXAS, AMENDING SUBPARAGRAPH
2, OF SECTION I, SUBPARAGRAPH 5 AND 6 OF SECTION II, AND SUBPARAGRAPH
I OF SECTION III OF SAID ORDINANCE NO. 110;. AND AMENDING SECTION 2
OF ORDINANCE NO. 110, IN REGARDS THE APPOINTMENT AND SERVICE OF
ELECTRICAL INSPECTORS CREATING APPRENTICE ELECTRICAL LICENSE AND
AMENDING OTHER SECTIONS, SUB SECTIONS AND PARAGRAPHS AND OTHER MATTERS
RELATING THERETO: AND SUSPENDING THE RULE REQUIRING ORDINANCES TO BE
READ ON TWO SEPARATE AND SEVERAL DAYS. WHEREUPON, the question was
asked and the motion carried, Councilmen Calvin, Nolen, Shukanes and
Sanders voted "aye" with Councilman Cogbill voting "no."
Councilman Cogbill stated that he had made an inspection trip to the
garbage dump and suggested some needed changes that he will be working
on.
Engineer Walsh reported that the Department of Health, Education &
Welfare representative Mr. F. A. Gutierrez and Texas Department of Public
Health representative R. B. Riddle have approved all city records and
data for the Federal Grant on Sewer Plant No. 3 and lines.
Councilman. Sanders discussed the desire of Berry Miller, Sr. to move
the present two story framebuilding now located on the southeast
corner of F. M. 518 and State Highway 35 to the east boundry line of
the lot and facing F. M. 518.
Motion made by Councilman Sanders, seconded by Councilman Shukanes
that requested be granted. WHEREUPON, the question was asked and the
motion carried, all Councilmen voted "aye" with nn'"noes."
Motion made by Councilman Nolen, seconded by Councilman Calvin that
the City pay for one sign, "Plum Street and Old Alvin Road." WHEREUPON,
the question was asked and the motion carried, all Councilmen voted
"aye" with no,'"noes."
Meeting recessed at 9:40 P. M.
Meeting reconvened at 9:50 P. M. with Mayor John G. Kegley, Councilmen
Steven A. Shukanes, Joe Dan Calvin, Gene E. Sanders, City Engineer
William C. Walsh and City Secretary W. A. McClellan.
Engineer Walsh reported that the City had been given permission by
the representative of the Department of Health, Education and Welfare,
Mr. F. A. Gutierrez and representative of the Texas Department of
Public Health$ Mr. R. B. Riddle to proceed with the construction of
sewage lines that would serve the Pearland School System ahead of the
construction of the remainder of the lines and Sewer Plant No. 2.
Motion made by Councilman Shukanes, seconded by Councilman Calvin
that Walsh & McLaren prepare plans and specification and to advertise
for bids for the sewage lines to serve the school. WHEREUPON, the
question was asked and the motion carried, Councilman Shukanes and
Councilman Agn6ftpe voted "aye" with Councilman Sanders abstaining.
