1965-05-03 CITY COUNCIL SPECIAL MEETING MINUTES188 MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL CITY OF PEARLAND, TEXAS, HELD ON MAY 34 1965 - 7:30 P. M. A special meeting of the City Council of the City of Pearland was called to order by Mayor Kegley at 7:30 P. M. in the City Hall on May 3, 1965, with the following present. Mayor Councilman Councilman Councilman Councilman Councilman City Secretary Fiscal Agent City Engineer Representative John G. Kegley Victor A. Nolen Steven A. Shukanes- Gene E. Sanders Joe Dan Calvin Basil L. Cogbill W. A. McClellan D. N. Eddleman Jack McLaren Visitors: Lee Plyler, John Alexander, Tom Alexander, Frank D. Barringer, David L. Smith, Jr. and E. T. Gibbons. Mayor Kegley stated that the purpose of the meeting was to fund the outstanding Time Warrants on the Mary's Creek water plant and improve- ments--t-o- unvoted bonds and other pertinent business necessary for Council action. Mayor Kegley stated that at approximately 6:00 P. M. May 3: 1965, he, as Mayor and the City of Pearland were cited as defendant parties to -.a law su5.t filed by Bert M. Jamison. After due -discussion Mr. Eddleman advised that the City should proceed with -the Warrant Funding. Ordinance No. 113 was read by Mr. Eddleman for Council review. After due discussion a motion was made by Councilman Shukanes, seconded by Councilman Nolen that Ordinance No. 113 - AN ORDINANCE AUTHORIZING THE ISSUANCE OF 1050000 CITY OF PEARLAND, TEXAS, WATER- WORKS SYSTEM REFUNDING BONDS, SERIES 1965; PRESCRIBING THE TERMS AND PROVISIONS THEREOF; MAKING PROVISIONS FOR THE PAYMENT OF PRINCIPAL AND INTEREST THEREON; PROVIDING FOR THE EXCHANGE THEREOF FOR THE TIME WARRANTS BEING REFUNDED THEREBY; CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT; AND PROVIDING THAT THIS ORDINANCE SHALL BE EFFECTIVE ON AND AFTER ITS PASSAGE. WHEREUPON, the question was asked and the motion carried, all Councilmen voted "aye" with no "noes . 0 Councilman Shukanes requested that the Citation of Suit of Bert M. Jamison vs City, of Pearland No. 45,716 District Court of Brazoria County, Texas, be entered into the city minutes. Motion made by Councilman Shukanes, seconded by Councilman Nolen that the City Attorney be instructed to defend the City's welfare and to hire any assistants he may deem necessary in the Citation No. 45716 of Bert M. JamisonsCity of Pearland. WHEREUPON, the question was asked and the motion carried, Councilman Cogbill abstained, Council- men Sanders, Councilman Nolen, Councilman Shukanes and Councilman Calvin voted "aye." Councilman Cogbill abstained because of insufficient time to study this problem. "^ Motion made by Councilman Sanders that Engineer be instructed'to complete plans and specifications in conjunction with City Attorney to proceed with drilling of a new water well on the City Hall site, and that final plans and specifications be reviewed by City Council before advertising for bids. WHEREUPON, the question was asked and the motion carried, all Councilmen voted "aye" with no "noes." Motion made by Councilman Sanders, seconded by Councilman Nolen that the City Engineer proceed with plans and specifications to finalize water lines for the old townsite and be ready to present to Council 189, for final approval to advertise for bids on Monday Night May 100 1965. WHEREUPON, the question was asked and the motion carried, all Councilmen voted"aye" with no "noes." Mr. Frank Barringer stated to the Council that he was ready toy,, proceed with the development of Section II of Willowcrest Subidivison. This matter was referred to the Subdivision Committee for study and recommendation. Meeting adjourned at 10:15 P. M.
