MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL
CITY OF PEARLAND, TEXAS, HELD ON APRIL'29, 1965 - 7:30 P. M.
A special meeting of the City Council of the City of Pearland was
called to order by Mayor Kegley at 7:30 P. M. in the City Hall on
April 29, 1965, with the following present:

Phillip Hall and Jim Bell.
Mayor Kegley stated that the purpose of the meeting was to discuss
water and sewage lines in the old part of Pearland including the new
sewage Plant No. 2, and any other business that might properly be
brought before the Council.
The first order of business was a request by the Council that the City
Secretary write a letter of appreciation to Dr. Joe E. West of Friends -
wood for his help and supervision in handling the injured persons
involved in a wreck just west of Pearland at the Manvel Highway
and F. M. 1128 intersection.
Mayor Kegley next read a le ter dd essed to the Chief -of -Police by
Ray Martinex a citizen of City Secretary instructed by the
City Council to inform Chief Casey to adhere to the F. B. I. systemz-
in classifying persons arrested.
Mayor Kegley read a letter from Judge Segelquist, Corporation Court
Judge for the City of Pearland, stating that he and his clerk would
be away from the City from May 9, 1965 through May 23, 1965.
A discussion was held regarding sewage plans with the following
results.

Motion made by CouncilmanNolen, seconded by Councilman Calvin that
the City buy from 8 to 17.85 acres of land from the Settagest Estate
for the sum of $3,000.00 per acre, and to instruct the City Engineer
to prepare a 401 easement plat, from the Barry Rose property to the
Settagest property and to so notify the Alexanders that the City will
offer them the same amount per acre for the easement. If this is
not agreeable then condemnation proceedings will be started. Settagest
Estate to furnish a written statement upon the sale of their property
that they will not protest the City securing a permit for the sewage
treatment plant.
Substitute motion made by Councilman Shukanes, seconded by Councilman
Sanders that the above motion be tabled until the negotiations have
been carried out with the Alexanders, and price to be determined for the
land in the proceeding motion is ascertained and provisions for the
payment of this land and condemnation proceedings are provided since
not any funds were provided in the original bond issued. WHEREUPON,
the question was asked and Councilman Shukanes and Councilman Sanders
voted "aye." Councilman Calvin and Councilman Nolen voted "no."
Councilman Cogbill abstained, therefore, the vote ended in a tie and
Mayor Kegley cast a "aye" vote to break the tie. Motion carried.
Motion made by Councilman Sanders, seconded by Councilman Shukanes
that the existing committee or the Mayor meet with the Alexanders
and bring back to the Council a factual outline in writing, agreeable

400 feet, and a sanitary sewage line in McGinnis Subdivision on Willits
Drive, between Block 2 and 3 and along Lot 12 in Block 2 on Dixie
Farm Road to an existing manhole were ready for bids and that request
for bids would be published in the Alvin Sun. Opening date for bids
to be May 8, 1965 at 10:00 A. M.
Mayor Kegley called a special meeting f or Thursday Night April 29,
1965 for approval of plans and specifications for improvements to
the old water district.•
Motion made by Councilman Shukanes, seconded by Councilman Sanders
I that plans for location. of Sewage Plant Site No. 2 be pursued to see
what might be worked out and that a committee be appointed to present
and solve this matter in an equitable manner for all concerned. Said
Committee to report back on Thursday Night April 29, 1965. WHEREUPON,
the question was asked and the motion carried, all Councilmen voted
"aye' with no "noes."
Mayor Kegley appointed Councilmen Shukanes, Nolen and Calvin to serve
on this committee.
Motion made by Councilman Shukanes, seconded by Councilman Nolen that
the previous question regarding passage of Ordinance No. 112 be brought
from the table and said Ordinance which.reads as follows be passed.
AN ORDINANCE REQUIRING DRIVERS OF MOTOR VEHICLES TO COME TO A COMPLETE
STOP WITH SAID VEHICLE WHEN APPROACHING A SCHOOL BUS FROM EITHER DIRECTION
WHICH IS STOPPED ON -A PUBLIC STREET OR THOROUGHFARE WITHIN THE CITY OF
PEARLAND, TEXAS, FOR THE PURPOSE OF RECEIVING OR DISCHARGING SCHOOL
CHILDREN; CONTAINING OTHER PROVISIONS RELATING TO SAME; PROVIDING
FOR A PENALTY FOR VIOLATION; FINDING THAT THERE IS NOT NOW IN EFFECT
ANY ORDINANCE PROTECTING THE HEALTH, SAFETY AND WELFARE OF SCHOOL
CHILDREN WITHIN THE CITY OF PEARLAND, TEXAS; PROVIDING A SEVERABILITY
CLAUSE AND DECLARING AN EMERGENCY. WHEREUPON, the question was
asked and the motion carried, all Councilmen voted "aye" with no
"noes."
Mayor Kegley appointed Councilman Sanders as a committee of one to
check with the school authorities concerning Ordinance No. 112.
Motion made by Councilman Shukanes, seconded by Councilman Nolen that
the City accept a deed to a 10 ft. easement along Old Alvin Road
from Westminister Subdivision to Mary's Creek from Dalsco, Inc.
WHEREUPON, the question was asked and the motion carried, all Councilmen
voted ."aye" with no "nod ."
Motion made by Councilman Sanders, seconded by Councilman Shukanes
that Drainage District No. 4 be requested to recut the drainage ditch
in Westminister Subdivision to the Old Alvin Highway. WHEREUPON, the
question was asked and the motion carried, all Councilmen voted "aye"
with no "noes."
David L. Smith, developer of Vegal Oaks stated that an additional sum
of money had been turned over the City as escrow funds for the future
black topping of Regal Drive and that a small sum more would be paid
when the lots have been fully paid for. He requested the City to do
the black topping now and he would turn in the '._balance due, or if the
City would pay the escrow funds direct to a contractor so that the
black topping could be completed now.
Motion made by Councilman Shukanes, seconded by Councilman Nolen that
J David L. Smith be instructed to black top Regal Drive in accordance
with City plans and specifications, the City to pay from the escrow
funds being held for the black topping of Regal Drive direct to the
contractor.
Meeting adjourned at 10:10-P. M.

to go'across Clear Creek. WHEREUPON, the question was asked and
Councilman Shukanes and Councilman Sanders voted "aye." Councilman
Nolen, Councilman Calvin and Councilman Cogbill voted "no." Motion
failed.
Motion made by Councilman Nolen, seconded by Councilman Calvin that
the City Engineer be instructed to design a sewage treatment plant
on our present sewage site t6 serve the people of the Pearland Town -
site. WHEREUPON, the question was asked and Councilman Nolen,
Councilman Calvin and Councilman Cogbill voted "aye." Councilman
Shukanes and Councilman Sanders voted "no." Motion carried.
Councilman Shukanes and Sanders stated that they thought that the
Council had done the City a great `disservice in not following the
original plans as outlined on the Bond Brochure Map.
Following a brief discussion of water plans for the old townsite the
meeting was adjourned by the Mayor.
Meeting was adjourned at 10:30 P. M.

After due :consideration of the three alternate routes of sewer
mains to Plant No. 2 based upon estimated engineering costs of
each and the varying political and economic aspects of each
and realizing that Engineer Walsh does not recommend this
routing as the best and most feasible solution, based on sound
engineering and economic design, I propose that the routing
down the drainage ditch thence down Clear Creek to Settegast
property be accepted at a line cost of approximately $143,000.00
