MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF PEARLAND, TEXAS, HELD ON MARCH 11, 1965
The regular meeting of the City Council of the City of Pearland was
called to order by Mayor Kegley at 7:30 P. M. in the City Hall on
March 11, 1964, with the following present:

The first matter to come before the Council was a motion by Councilman
Alexander, seconded by Councilman Sanders that minutes of regular meet-
ing held on February 25, 1965 be approved. WHEREUPON, the question
was asked and all Councilmen voted "aye" with no "noes'. Motion carried.
Motion made by Councilman Sanders, seconded by Councilman Shukanes
that minutes of executive meeting held on February 25, 1965, be approved.
WHEREUPON, the question was asked and the motion carried, all Council-
men voted "aye"_with no "noes."
Motion made by Councilman Nolen, seconded by Councilman Alexander that
minutes of special meeting held on February 26, 1965, be approved.
WHEREUPON, the question was asked and the motion carried, all Council-
men voted "aye" with no "noes."
Motion made by Councilman Shukanes, seconded by Councilman Nolen that
the following outstanding invoices and salaries be paid. WHEREUPON,
the question was asked and the motion carried, all Councilmen voted
"aye" with no "noes."

Motion made by Councilman Nolen, seconded by Councilman Alexander that
City Attorney Jack Harrison write a letter to Franklin, Kelly, Graham
& Laughter, that the City of Pearland will accept the streets in Twin
Creek Woods, sub'ect to the filing of appropriate papers with the
City Secretary, �(a linen plat, usual dedication of thoroughfares,
right-of-way easements, utility easements and alleys.) WHEREUPON,
the question was asked and the motion c rr�dveouncilman Alexander,
Councilman Nolen, Councilman Shukanes+��" with Councilman
Hawkins abstaining.
Mayor Kegley acknowledged a petition presented by Louis Bellview, signed
by 57 people requesting the Southwestern Bell Telephone Company to drop
the mileage charge in their area. He further acknowledged that the
City Council was in agreement and in full sympathy with them and would
do whatever it could for them. City Secretary was requested to,�mite
a letter to the Southwestern Bell Telephone Company office in St. Louis,
Missouri, with a copy to the Houston office.
A letter from the Angleton Bank of Commerce was read as follows:
"As of February 23, 1965, and until further notice by this bank,
you are released from your pledge to make all checks for services
performed by Walsh & McLaren jointly in favor of this bank and
such and such firm. This bank has no interest in any amounts due
Walsh & McLaren by your municipality.
We appreciate your cooperation towards the benefit of our customer."
Councilman Alexander reported for the Park Committee and stated that
a bridge had been placed across Marys Creek in the new city park,
and that tables and benches have been provided and that barbecue pits
will be provided shortly. A sign is needed prohibiting loaded trucks
from crossing the bridge. Also, a chain link fence is needed for
the back side.
The Garbage Committee reported that the house for Chester had been moved
to the garbage dump and that he had moved in.
Councilman Shukanes and Councilman Sanders reported that the Street
and Bridge Committee would have their report ready by the next meeting.
Councilman Nolen reported that a copy of a Dog Ordinance, a Building
Code Ordinance and Electrical Code Ordinance had been given to the
City Attorney to be properly drawn up.
Kelly Sims reporting for the planning commission stated that nothing
good could be found in the present set-up on the Clear Creek pollution
problem due to the fact that; this area, which made up about 70% of
the area, did not have a single representative on the Board. They
will work to remedy this situation, however, part of it is still some-
what in the planning stage.
Engineer Walsh also agreed that the plans are not feasible for Pearland
at this time for the following reasons: No. 1. The people who pay
will not have representation. 2. Paid for by revenues for usage of
sewer lines.
Motion made by Councilman Sanders, seconded by Councilman Alexander that

the City Attorney write a letter for the Council to Caldwell & Schwartz
protesting the passage of any legislation authorizing any tax revenue
supported body to establish Clear Creek Basin Pollution Control
District,until said legislation is thoroughly discussed with each local
governing body involved and adopted by a two-thirds majority of the
participating governing bodies. WHEREUPON, the question was asked
and the motion carried, all Councilmen voted "aye" with no "noes."
Motion made by Councilman Alexander, seconded by Councilman Nolen to
purchase a steel storage tank for $100.00 to be used for storing asphalt
sealer material. WHEREUPON, the question was asked and the motion
carried, all Councilmen voted "aye" with no "noes."
Motion made by Councilman Shukanes, seconded b Councilman Alexander
that signs be ordered and placed on Highway 51y8 indicating "City Hall"
and "Corporation Court," and to change the sign on the jail building
to read "Police Department." WHEREUPON, the question was asked and
the motion carried, all Councilmen voted "aye" with no "noes."
City Attorney Harrison instructed to write a letter to Commissioners
Court requesting them to enter into condemnation proceedings for the
acquisition of a ten acre tract of land, lying adjacent to the present
City garbage dump grounds. City to reimburse the County for this cost
plus the actual consideration for the purchase of the tract to be paid
by Brazoria County.
City Secretary instructed to certify the Drilling Ordinance No. 84 and
mail to Angleton to be recorded.
Motion made by Councilman Nolen, seconded by Councilman Alexander that
Texala Construction Company be paid the sum of $42,235.48, Engineer's
Estimate No. B1, work completed through February 28, 1965; Contract
B - Sanitary Sewer Trunk Line with Appurtenances, Plant No. 3 WPC-TEX
336. WHEREUPON, the question was asked and the motion carried, all
Councilmen voted "aye" with no "noes."
Motion made by Councilman Nolen, seconded by Councilman Sanders that
the McCarty Construction Company be paid the sum of $3,174.07, Engineer's
Estimate No. A2, work completed through February 28, 1965; Contract
A - Sanitary Sewage Treatment Plant No. 3, WPC-TEX 336, Plant No. 3.
WHEREUPON, the question was asked and the motion carried, all Councilmen
voted "aye" with no "noes."
Motion made by Councilman Nolen, seconded by Councilman Hawkins that
Walsh and McLaren be paid the sum of $8,875 for engineering services
on WPC-TEX 352, Sewage System & Plant No. 2, through February 28, 1965.
WHEREUPON, the question was asked and the motion carried, all Council-
men voted "aye" with no "noes."
Motion made by Councilman Shukanes, seconded by Councilman Nolen that
a new telephone line be installed for the Police Department with an
extension in the City Hall. WHEREUPON, the question wasasked and
the motion carried, all Councilmen voted "aye" with no "noes."
Motion made by Councilman Nolen, seconded by Councilman Shukanes that
the base radio be accepted on a 90 day trial basis at a cost of 20% of
the total price of $432.44. WHEREUPON, the question was asked and
the motion carried, Councilmen Shukanes, Hawkins, Alexander and Nolen
voted "aye" with Councilman Sanders abstaining for lack of qualifying
information on how the station will be operated.
Motion made by Councilman Alexander, seconded by Councilman Shukanes
that a remote control line be installed from City Hall to the Police
Station, in order that City Hall employees could transmit. WHEREUPON,
the question was asked and the motion carried, Councilmen Nolen,
Shukanes, Hawkins and Alexander voted "aye" with Councilman Sanders
abstaining for lack of qualifying information on how station will be
operated.
Motion made by Councilman Alexander, seconded by Councilman Shukanes
that a remote transmitting station be installed at the City Hall for
the base radio station by the Mico Company on a 90. days trial basis

with 20%, down payment. WHEREUPON, the question was asked and the
motion carried, Councilman Nolen, Shukanes, Hawkins and Alexander
voted "aye" with Councilman Sanders abstaining for lack of qualifying
information.
Motion made by Councilman Sanders, seconded by Councilman Shukanes
that City Secretary be authorized to pay the special commissioners
and appraisers for condemnation service on the City of Pearland vs
Rayment E. Maness, Jr. et ux an amount not to exceed 400.00. WHEREUPON,
the question was asked and the motion carried, All Councilmen
voted "aye" with no "noes."
