A Resolution of the City Council of the City of Pearland, Texas, awarding a bid
for the removal and installation of new running track surface at the Recreation
Center & Natatorium to Rubber Flooring Systems, Inc., in the amount of
$134,494.40.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That competitive pricing for the removal and installation of new running track
surface has been reviewed and tabulated.
Section 2. That the lowest pricing can be obtained through the Texas Buyboard, a
cooperative purchasing partner of the City.
Section 3. That the City Council hereby awards the bid to Rubber Flooring Systems, Inc.,
in the amount of $134.494.40.
Section 4. That the City Council hereby authorizes an appropriation from the Fund 340
(Parkland Dedication) Fund Balance.
Section 5. The City Manager or his designee is hereby authorized to execute a contract
for the removal and installation of new running track surface at the Recreation Center & Natatorium.

III. Standard Contractual Provisions.
A. Definitions.
Contract means this Standard Contract for Construction Services.
Services means the services for which the City solicited bids or received proposals as
described in Exhibit "A" attached hereto.
B. Services and Payment. Contractor will furnish Services to the City in accordance with the
terms and conditions specified in this Contract. Contractor will bill the City for the Services provided
at intervals of at least 30 days, except for the final billing. The City shall pay Contractor for the
Services in accordance with the terms of this Contract, but all payments to be made by the City to
Contractor, including the time of payment and the payment of interest on overdue amounts, are
subject to the applicable provisions of Chapter 2251 of the Government Code.
C. Termination Provisions.
(1) City Termination for Convenience. Under this paragraph, the City may terminate this
Contract during its term at any time for the City's own convenience where the Contractor is not in
default by giving written notice to Contractor. If the City terminates this Contract under this
paragraph, the City will pay the Contractor for all services rendered in accordance with this Contract
to the date of termination.
(2) Termination for Default. Either party to this Contract may terminate this Contract as
provided in this paragraph if the other party fails to comply with its terms. The party alleging the
default will give the other party notice of the default in writing citing the terms of the Contract that
have been breached and what action the defaulting party must take to cure the default. If the party
in default fails to cure the default as specified in the notice, the party giving the notice of default may
terminate this Contract by written notice to the other party, specifying the date of termination.
Termination of this Contract under this paragraph does not affect the right of either party to seek
remedies for breach of the Contract as allowed by law, including any damages or costs suffered by
either party.
(3) Multi -Year Contracts and Funding. If this Contract extends beyond the City's fiscal year
in which it becomes effective or provides for the City to make any payment during any of the City's
fiscal years following the City's fiscal year in which this Contract becomes effective and the City fails
to appropriate funds to make any required Contract payment for that successive fiscal year and
there are no funds from the City's sale of debt instruments to make the required payment, then this
Contract automatically terminates at the beginning of the first day of the City's successive fiscal year
of the Contract for which the City has not appropriated funds or otherwise provided for funds to
make a required payment under the Contract.
D. Liability and Indemnity. Any provision of any attached contract document that limits the
Contractor's liability to the City or releases the Contractor from liability to the City for actual or
compensatory damages, Toss, or costs arising from the performance of this Contract or that provides
for contractual indemnity by one party to the other party to this Contract is not applicable or effective
under this Contract. Except where an Additional Contract Document provided by the City provides
otherwise, each party to this Contract is responsible for defending against and liable for paying any
claim, suit, or judgment for damages, loss, or costs arising from that party's acts or omissions in the
performance of this Contract in accordance with applicable law. This provision does not affect the
right of either party to this Contract who is sued by a third party for acts or omissions arising from
this Contract to bring in the other party to this Contract as a third -party defendant as allowed by law.

E. Assignment. Contractor shall not assign this Contract without the prior written consent of
the City.
F. Law Governing and Venue. This Contract is governed by the law of the State of
Texas and a lawsuit may only be prosecuted on this Contract in a court of competent
jurisdiction located in or having jurisdiction in Brazoria County, Texas.
G. Entire Contract. This Contract represents the entire Contract between the City and the
Contractor and supersedes all prior negotiations, representations, or contracts, eitherwritten or oral.
This Contract may be amended only by written instrument signed by both parties.
H. Independent Contractor. Contractor shall perform the work under this Contract as an
independent contractor and not as an employee of the City. The City has no right to supervise,
direct, or control the Contractor or Contractor's officers or employees in the means, methods, or
details of the work to be performed by Contractor under this Contract. The City and Contractor
agree that the work performed under this Contract is not inherently dangerous, that Contractor will
perform the work in a workmanlike manner, and that Contractor will take proper care and
precautions to insure the safety of Contractor's officers and employees.
I. Dispute Resolution Procedures. The Contractor and City desire an expeditious means to
resolve any disputes that may arise between them regarding this Contract. If either party disputes
any matter relating to this Contract, the parties agree to try in good faith, before bringing any legal
action, to settle the dispute by submitting the matter to mediation before a third party who will be
selected by agreement of the parties. The parties will each pay one-half of the mediator's fees.
J. Attorney's Fees. Should either party to this Contract bring suit against the other party for
breach of contract or for any other cause relating to this Contract, neither party will seek or be
entitled to an award of attorney's fees or other costs relating to the suit.
K. Severability. If a court finds or rules that any part of this Contract is invalid or unlawful,
the remainder of the Contract continues to be binding on the parties.
IV. Special Terms or Conditions. None.

are part of this Contract, except as follows: any provision contained in any of the Contractor's
Additional Contract Documents specified below that conflicts with a Contract provision not included

WARNING: THESE INSTALLATION INSTRUCTIONS ARE FOR INDOOR APPLICATIONS OVER
CONCRETE. FOR OUTDOOR INSTALLATION PROCEDURES OR INDOOR INSTALLATIONS OVER
ASPHALT, PLEASE COMMUNICATE WITH MONDO'S TECHNICAL DEPARTMENT.
9.1 SURFACE PREPARATION
9.1.1 GENERAL CONTRACTOR
a) All subfloors must be properly prepared to provide a satisfactory bonding surface for
the adhesive being used to install the resilient flooring. Refer to Mondo's current
Subfloor Preparation Guide for all requirements.
b) The General Contractor must provide a finished concrete subfloor ready to receive Mondo's
resilient rubber flooring. Subfloors must be smooth and level within a tolerance of 1/8" (3mm)
in a 10' (3.05m) radius. Mondo does not recognize the "F" numbers: FF = floor flatness. FL =
floor levelness. Minor surface cracks or grooves must be filled with a good quality Portland
cement based patching or leveling compound such as Mapei or Ardex. High spots, bumps
and peaks must be repaired prior to installation. Mondo recommends a magnesium trowel
finish. Please note that while a smooth surface is desired, a shiny, slick, non -porous or
over -porous slab is not acceptable and will require additional preparation prior to
installing Mondo flooring products. Once the subfloor preparation is complete, you
should have a CSP (Concrete Surface Profile) of about 1.
c) New concrete subfloors must be allowed to cure a minimum of 28 days prior to
installing Mondo flooring. However, drying time is typically 4 weeks for every 1" thickness
of slab (i.e. a 6" slab will take approximately 24 weeks to adequately dry).
d) Flooring installation shall not commence until the building is enclosed and all other trades
have completed their work.
e) Maintain a stable room and subfloor temperature prior to installation (before performing
moisture tests), during the installation and min. 48 hours after the installation. Recommended
temperature range of 65°F to 86°F (18°C to 30°C). General recommended ambient humidity
control level is between 35 to 55%.
f) Concrete substrates must be fully cured and free of any hydrostatic and/or moisture
problems. Moisture and alkalinity tests must be performed on all concrete substrates,
under in-service conditions. It is recommended to turn on the HVAC unit to ensure stable
conditions during testing and installation. The pH level should be in the range of 7 to 10.
Readings below 7 and in excess of 10 have been known to affect some adhesives. Moisture
vapor emission content of the concrete slab must not exceed the tolerance of the adhesive
specified when tested according to ASTM F1869 (anhydrous calcium chloride for moisture
vapors from concrete), and relative humidity of concrete slab must not exceed the tolerance
of the adhesive specified when tested according to ASTM F2170 (in-situ probes for relative
humidity in concrete slab).

NOTE: Moisture tests will help confirm whether the slab is dry enough to proceed with
the installation. It does not mean the slab will always remain dry. Never attempt a
moisture test until the HVAC unit has been operational for at least 7 days and/or the
site conditions (temperature and humidity) are constant in the building and reflective
of in-service conditions.
MONDO WILL NOT GUARANTEE THE ADHESION OF A MONDO PRODUCT TO A
SUBFLOOR WITH RELATIVE HUMIDITY OR MOISTURE VAPOR EMISSIONS RATES
EXEEDING THE TOLERANCE OF THE SPECIFIED ADHESIVE, WHEN TESTED IN
ACCORDANCE TO ASTM F2170 AND F1869.
9.1.2 FLOORING CONTRACTOR/SUBCONTRACTOR
a) Before proceeding with any work, the substrate surface must be inspected and any visible
defects on the surface such as cracks, bumps, rough areas or variations in levelness must be
reported in writing to the Project Manager and the General Contractor.
b) The Flooring Contractor/Subcontractor must verify moisture testing results to ensure they are
within tolerance for the adhesive specified. Refer to Mondo's Subfloor Preparation Guide for
recommendations on moisture testing. The Flooring Contractor should keep records of all
tests conducted.
c) Concrete subfloors must be dry, sufficiently porous, smooth, clean and free of paint, wax,
dust, oil, sealers, grease, curing agents, surface hardeners, solvents, asphalt, old adhesives
and any other contaminants that could inhibit or reduce bond strength. Concrete surfaces that
are powdery or scaly are not acceptable. Mondo recommends the removal of
contaminants by way of mechanical abatement, such as a light to medium shot-
blasting (ICRI CSP #3 to #5 profile). NEVER use chemical abatement methods. Ensure
removal of contaminant was successful by performing a bond test, as described in Mondo's
Subfloor Preparation Guide.
d) Prior to beginning any installation of Mondo products it is recommended that the entire room
be vacuumed thoroughly to remove dust. loose dirt and debris. DO NOT use sweeping
compounds. If desired. use damp sawdust to help with sweeping.
e) Store sheet goods upright on a clean, dry. flat surface protected from all possible damage
and exposure to harmful weather conditions.
9.2 INSTALLING TRACK SURFACING PRODUCTS
NOTE: When installing running/jogging/walking tracks with radius, it is possible to bend
the material around the radius (provided that the radius is not too small). Please contact
Mondo's Technical Department for recommendations when faced with this type of
installation.
a) Do not install the rubber flooring until all jobsite conditions and subfloor preparations are met
and completed. Before starting any installation, verify the product for type, size, thickness,
color, visual imperfections or color variations and notify the Mondo Technical Department of
all apparent defects. No claims will be accepted after the material has been installed.
b) Allow all materials to acclimate to site temperature prior to their use and installation.

c) If installation calls for the material to be laid out in a format other than a track with radius,
such as a room or specific section, proceed to square the room and make the first chalk line
down the center of the room parallel to the length of the room.
d) Unroll material in the same direction and follow the numbered roll sequence. Allow rubber
track surfacing to relax overnight (12 hours or longer if needed). Colder facility temperatures
may necessitate longer relaxation time; adjust as needed.
e) Dry lay and "cut to fit" all material to be installed on a given day, prior to adhesion. This
includes all perimeters, columns, doorways, etc.. that are contained within the space.
f) End seams should be staggered and overlapped approximately 6" (15cm).

Note: If a multiple color layout is to be made, double-checking measurements will
avoid problems. If applicable, make sure that the seams between two colors will be in
the middle of the painted game lines whenever it is possible to do so.
Long seams do not need any trimming (unless damaged in some way). Ensure they remain
overlapped 3/16" (-0.5cm) to make tight compression seams.
h) End seams should be overlapped approximately 6" (15cm). The first edge of the seam must
be trimmed a MINIMUM of 3" (7.6cm) with the help of a good straightedge. Then cut the
second edge by using the first straight cut side as a guide. Then cut the second edge by
using the straight edge again leaving 3/16" (-0.5cm) overlap to make a tight compression
seam.
NOTE: All cuts must be slightly beveled to make sure that the seam will close without
applying too much pressure. Too much bevel can result in a peaking or falling seam.
Reverse beveling will result in a gapped seam. Slightly beveled refers to < 5°.
NOTE: A proper cut should be made in multiple passes. The first pass should score
though the wear layer using a utility knife. The second pass should be made using a
hook blade. Experienced installers may choose to use other types of cutting tools but
end results should be the same as required.
i) End seams must be adjusted without applying too much pressure while ensuring that they
are perfectly closed. Pressured seams will cause peaking.
9.2.1 TROWEL SIZE
Jobsite/substrate conditions will affect spread rate, it may be necessary to adjust trowel size or
perform additional surface preparation. It is recommended to change trowels every so often
in order to assure the teeth are not worn out and that the adhesive spread is consistent
throughout.

9.2.2 RECOMMENDED ADHESIVES
INDOOR RUBBER TRACK SURFACING
Mondo track surfacing products are generally installed using two-part polyurethane, such as PU
100 (colored) or PU 105. However, the use of EP 55 epoxy adhesive may be possible in some
areas. See notes below.
WARNING: Mondo's epoxy adhesive (EP 55) cannot be used when installing over Everlay.
The only suitable adhesive for installing flooring over Everlay is polyurethane (either PU
100 or PU 105).
WARNING: For indoor installations over asphalt, ONLY use PU 100 (never use PU105,
EP55 or MP965).
WARNING: Mondo EP 55 is an epoxy based adhesive that cures to a very hard state. It may
not be suitable for surface impacts (i.e. dropping weights). If in doubt, please contact
Mondo's Technical Department for recommendations.
9.2.3 ADHESIVE APPLICATION
a) Refer to specified adhesive's current technical data sheet for complete instructions on
use.
b) A bond test is recommended before proceeding with an installation to ensure good bond
strength.
c) Create a mixing station by selecting a location, away from the installation area, and protecting
it with a 6' x 6' scrap piece of material, Kraft paper or other suitable product. Mondo reactive
adhesives are two component adhesives and the proportions for the mix are ready to use.
Pour the small container(s) of part B in the large pail of part A (NOTE: For the two containers
of part B in the EP 55 adhesive, after you have poured them out into part A you can screw
their caps back on and invert the bottles for a minute. This will allow you to get a few more
ounces out of each bottle). Stir thoroughly with a variable speed mixer (6 amps minimum)
until a homogeneous and smooth consistency is obtained. The complete contents of both
parts of the adhesive must be used at once. Improper mixing may result in a poor bond.
Using a variable speed mixer should not take longer than 2 minutes to mix the two parts to a
creamy texture. Over mixing will cause the catalyst to set up too fast, thus reducing pot life
and entrapping air which may reduce bond performance. The adhesive has to be applied
immediately after mixing, otherwise it will thicken and be much harder to trowel.
d) Roll back flooring from and end (head) to the middle of the roll length. Do not "flop" back;
always roll.
e) When starting the first row, apply adhesive evenly up to 2" (5cm) from both edges of long
seams (adjacent rolls) and stopping 12" (30cm) before end seam. The head seam will be
glued last. Special care must be taken that the adhesive is not applied too thinly.
f) Carefully place material into fresh adhesive; do not flop material into adhesive as it
may cause air entrapment. Proper adhesive transfer should be confirmed periodically by
lifting the rubber surfacing to inspect its backing for a minimum 90% transfer.
When starting the second row, apply adhesive underneath the long seam to be completed
(i.e. the 2" (5cm) of the previous row) and up to 2" (5cm) from the next adjacent row.

h) Immediately remove any dropped or oozed adhesive with a damp cloth while it is still fresh:
dried adhesive may be very difficult to remove. Mondo only recommends using denatured
alcohol for polyurethanes and epoxies. Do not use solvent based products to remove
adhesive spills as they could discolor the surfacing.
i) At the end of the day. stop the installation in the center of shot (6" (15cm) minimum from
edge), not at a seam. DO NOT STOP AT A SEAM EDGE. When continuing the next day,
make sure to get adhesive all the way back to the adhesive line from the day before.

Weights will need to be applied over every seam. Prior to applying the weights, We
recommend that you manually work the seams so that they are perfectly flat and tight (butted
together and never pressured to avoid peaking), using 2" (5cm) masking tape to help close
small gaps in the seams and keep the material in place while the adhesive sets. Never use
duct tape. Duct tape adhesive will chemically react with the flooring surface and leave
permanent residue. Even if the end or head seams look perfect, always apply masking tape
on them to keep them perfectly closed until full cure.
k) Use a lightweight 100Ibs (45kg) roller to eliminate entrapped air that could remain between
the subfloor and the athletic flooring. Roll in multiple directions, first rolling across width then
along the roll length.
I) WEIGHTS MUST BE APPLIED OVER EVERY SEAM: COMPLETELY COVER THE SEAM.
Grey concrete utility bricks (2" x 4" x 8") are the only suitable weights. DO NOT
SUBSTITUT WITH COLORED BRICKS. Weights must be kept on a minimum of 12 to 24
hours, depending on site temperature and adhesive curing. Weighting the seams with bricks
will prevent them from peaking. It is also necessary to brick the perimeter and all edges
(doorways, walls, columns, sleeves, etc.).

NOTE: The above listed quantities are merely suggestions. Specific site and
environmental conditions could necessitate additional bricks on the seams. Enough
bricks should be used to effectively keep the material flat in the adhesive for the
required amount listed above. Never use pieces of wood, boxes of other materials,
sand bags, cinder blocks or any other substitute to weight the seams. GREY
CONCRETE UTILITY BRICKS, 2" X 4' X 8", ARE THE ONLY SUITABLE WEIGHTS. Lack
of weight on the seams while the adhesive is setting can result in peaking.
9.2.4 TRAFFIC AND MAINTENANCE
a) No foot traffic shall be allowed on the material for a period of 24 hours after the
installation and for a longer period of time if the temperature is below 72°F (22°C). Prohibit
heavy traffic or rolling loads for a period of 72 hours. 1/8" Masonite or 1/4" plywood can
be used to protect the material for the 24 to 72 -hour period.
Initial cleaning should only be performed a minimum of 72 hours after the athletic surfacing has
been completely installed, or wait a minimum of 30 days before scrubbing the surfacing if it has
freshly painted lines or logos.

specifications and general conditions for the listed price. The price includes all applicable freight and taxes, unless otherwise noted. Unless
specifically included in this proposal: excludes all demolition, repair or take-up of existing flooring; excludes vacuuming, damp mopping, buffing,
waxing and floor protection; excludes floor floating, leveling and repair; excludes sealing of floor, cleaning or removal of oil, grease, solvents,
paints, plaster or other foreign substances; excludes asbestos control/abatement; includes no attic stock of material beyond installation
coverage; includes work only during regular hours and for a single phase job; excludes any fumiture movement; excludes any addenda beyond
the base bid; Per CRI -104-96, 6.3 site conditions: The owner or general contractor must submit to the flooring contractor a written report on
moisture and surface alkalinity of the slab to determine its suitability as a substrate for the material to be installed. Floor preparation (feather
finish) that exceeds the contracted coverage will be billed at $40 per bag supplied and installed. Floor leveling, if required, will be billed at $90
per bag supplied and installed. Client is subject to payment for stored materials. One Source Commercial Flooring, Inc. will not accept charge
backs for damage or cleaning without the option to inspect the claim(s) or without the option to make arrangements for acceptable repairs at
their expense. One Source Commercial Flooring, Inc. is not responsible for any claims that might result from product delivery date changes
beyond their control. If a manufacturer requires a deposit to manufacture/ship certain items, client will pay that amount. This proposal is valid
for thirty (30) days. Full payment is due ten (10) days from receipt of invoice unless otherwise specified. Acceptance of this proposal
constitutes agreement that all pricing and verbiage contained herein will become part and parcel to the subcontract documents.

1 am dropping off samples today of Super X and Sportflex M.
1 wanted to clarify a few things:
1 - Super X or Sportflex M: SAME PRICE - The proposal you have is good for either of these products.
Super X: This is Mondo's "Bread & 13utter" and has been in the industry for a long time. it is the main
product we use for indoor tracks. The product is designed specifically for track usage.
Sportflex M: A newer product line that Mondo has introduced. 'f'hc texture on top is less and the overall
feel is a bit harder. The intent of this Sportflex M is to be used primarily as a track but have a more
"multipurpose" application as well. A lot of rec centers arc moving to this product line if the area will be
used for other activities other than the track.
Suggestion: Again..pricing is the same. 1 do not know the usage of the track upstairs but if it is primarily
1 1 used as a jogging/walking track, then 1 would suggest Super X.

1. Subject to the terms and conditions hereof, Societe Mondo America Inc. ("Mondo") provides this Limited Material
Warranty to the above specified Warranty Holder covering the above -referenced Specified Product(s): (a) for a period of one (1) year
against manufacturing defect which such manufacturing defect prevents use of the Specified Product(s), and (b) for a period of ten (10)
years against surface wear through the top surface to the underlayment from normal use in areas other than pivot or high stress areas
("Excessive Wear"). (A valid claim for Manufacturing Defect or Excessive Wear will be collectively referred to as a "Covered Claim").
For all purposes hereof, the Warranty Term shall commence on the date which is thirty (30) days from Mondo's date of shipment for
the Specified Product(s) (the "Warranty Commencement Date").
2. Subject to the terms and conditions hereof, Mondo warrants that in the event of a valid Covered Claim covered by this
Limited Material Warranty, which such Specified Product has been installed and maintained in accordance with the Mondo's
specifications, technical specifications and/or technical bulletins Mondo shall at its sole discretion elect either: (a) to repair the affected
area(s) of the Specified Product(s) proven to be subject to the Manufacturing Defect or Excessive Wear; or (b) to ship replacement
product reasonably equivalent to the affected area(s) of the Specified Products proven to be subject to the Manufacturing Defect or
Excessive Wear; or (c) to supply at Mondo's discretion an overlay product similar to the Specified Product or an Alternative Product(s)
not identical in type, thickness or otherwise from the Specified Product; that is/are installed on top of the affected area(s) of the Specified
Product proven to be subject to a Manufacturing Defect or Excessive Wear; provided, however, that specifically excluded from this
Limited Material Warranty is any claimed defect that affects only an aesthetic property or attribute of the Specified Product.
3. Notwithstanding any contrary provision hereof, in no event shall any liability of Mondo hereunder exceed the actual cost
of the Specified Product or Alternative Product required to repair, replace or overlay (in Mondo's sole discretion) the affected area(s)
of the Specified Product(s) (the "Liability Limit"). Furthermore in consideration of the fact that all products depreciate over time,
Mondo's Liability Limit for any Excessive Wear hereunder shall, starting on the first (1st) anniversary of the Warranty Commencement
Date, reduce each year during the Term by ten (10%) percent of the initial Liability Limit. For example, unless Mondo has received
written notice of an Excessive Wear claim prior to the first anniversary of the Warranty Commencement Date, Mondo's total liability
shall be reduced to ninety (90%) percent of the initial Liability Limit until the next anniversary of the Warranty Commencement Date,
at which time Mondo's total liability shall be reduced to eighty (80%) percent of the initial Liability Limit, with further ten (10%) per
cent reductions of the initial Liability Limit on each such anniversary throughout the Warranty Term.
4. EXCLUSIONS AND DISCLAIMERS. MONDO'S LIABILITY HEREUNDER SHALL BE LIMITED AS SPECIFIED
ABOVE, WHICH SHALL BE THE SOLE AND EXCLUSIVE OBLIGATION OF MONDO HEREUNDER. MONDO SHALL HAVE
NO LIABILITY FOR ANY CLAIM WHICH IS NOT A COVERED CLAIM. UNDER NO CIRCUMSTANCES WILL MONDO BE
LIABLE FOR LABOR OR ANY OTHER COSTS INCURRED IN CONNECTION WITH THE REPAIR, REMOVAL,
INSTALLATION OR REPLACEMENT OF ANY SPECIFIED PRODUCTS COVERED BY THIS LIMITED MATERIAL
WARRANTY, EXCEPT AS SPECIFICALLY PROVIDED HEREIN. UNDER NO CIRCUMSTANCES WILL MONDO BE LIABLE
FOR DIRECT OR INDIRECT DAMAGES, LABOR, REMOVAL, INSTALLATION, INCIDENTAL OR CONSEQUENTIAL
DAMAGES, FOR LOST PROFITS, LOST SALES, INJURY TO PROPERTY OR ANY OTHER DAMAGES, LOSSES OR
CONTINGENCIES DUE TO OR ARISING OUT OF ANY SPECIFIED PRODUCT, WHETHER OR NOT SUBJECT TO A
MANUFACTURING DEFECT. THE LIMITED MATERIAL WARRANTY IS VALID ONLY FOR THE SPECIFIED WARRANTY
HOLDER AND IS NOT ASSIGNABLE OR TRANSFERABLE UNDER ANY CIRCUMSTANCES. THERE SHALL BE NO THIRD
PARTY BENEFICIARIES (INTENDED OR OTHERWISE) HEREUNDER. THIS LIMITED MATERIAL WARRANTY IS IN LIEU
OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITATION ANY WARRANTY OF
MERCHANTABILITY, HABITABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ALSO IS IN LIEU OF ANY
OTHER OBLIGATIONS ON THE PART OF MONDO (CONTRACTUAL, TORT OR OTHERWISE). THIS LIMITED MATERIAL
WARRANTY CONSTITUTES THE ONLY WARRANTY MADE BY MONDO AND IS A COMPLETE AND EXCLUSIVE
STATEMENT OF ITS OBLIGATIONS. MONDO MAKES NO REPRESENTATIONS, EXPRESSED OR IMPLIED, NOT
SPECIFIED HEREIN. ANY AND ALL REPRESENTATIONS, PROMISES, WARRANTIES OR STATEMENTS BY MONDO'S
EMPLOYEES, REPRESENTATIVES, AGENTS, DEALERS, OR DISTRIBUTORS THAT DIFFER, ENHANCE, AMEND OR
EXTEND IN ANY MANNER FROM THE TERMS OF THIS WRITTEN LIMITED MATERIAL WARRANTY SHALL BE OF NO
FORCE OR EFFECT. NO REPRESENTATIVE, AGENT OR EMPLOYEE OF MONDO, OR ANY OTHER PERSON, IS
AUTHORIZED TO ASSUME FOR MONDO ANY ADDITIONAL LIABILITY OR RESPONSIBILITY WITH MONDO FLOOR
COVERING EXCEPT AS DESCRIBED ABOVE.
5. Without limiting the foregoing and subject to the particular type of Specified Product involved, this Limited Material
Warranty shall not cover damage to the Specified Product(s) caused in whole or in part by any of the following: (a) usage for which the
Specified Product(s) was not designed; (b) faulty design and/or construction of the building and/or sub -base; (c) failure of the other
contractors to adhere to their specifications; (d) deficiencies in the concrete or asphalt slab; (e) excessive dryness in the concrete slab;
(f) failure to install correctly moisture and/or vapor barriers; or (g) excessive moisture or alkali from humidity, spillage, mechanical
failure, migration through the slab or walls, or from any other source.
6. Specifically excluded from this Limited Material Warranty is any Specified Product which has been subjected to neglect,
abuse, or wear in pivoting areas and high stress areas. Without limiting the foregoing , this Limited Material Warranty in addition does
not cover damage due to free -weights, stains, gouges, punctures, tears, accidents, or damage resulting from any intentional misuse of
products; luster reduction from use; normal wear and tear; gradual changes in color shading due to exposure to sunlight and/or climatic
conditions. Differences in color/shading/flecking and marbleisation variations with any actual samples, printed illustrations and/or
previous productions are also excluded under this Limited Material Warranty.
7. In no event shall Mondo have any liability for any patent defects or discrepancies which were or could have been
discovered prior to installation of the Specified Products. Nor shall Mondo have any liability for any failure to comply with Mondo's
storage recommendations, nor for any Specified Products which have been stored for more than six (6) months prior from date of
shipment from Mondo.
8. This Limited Material Warranty shall not apply to Specified Products which have been discontinued or Specified Products
in a discontinued color, marbleisation or flecking at the time of sale, or to goods sold as seconds or B grade. This Limited Material
Warranty shall become void if the proper Mondo adhesive or Mondo recommended adhesive has not been used on the installation, if
the Specified Product has not been installed by certified installers, or if the Specified Product has not been maintained in accordance
with all of Mondo's specifications.
9. As a condition precedent to any of Mondo's obligations hereunder, the Purchaser must provide written notice to Mondo at
2655 Francis Hughes, Laval, Quebec, Canada H7L 3S8 within the earlier of either (a) expiration of the applicable Warranty Period (i.e.,
one year for a claim of Manufacturing Defect, and ten years for a claim of Excessive Wear) and (b) the date which is ten (10) days after
the discovery of any alleged defect. Such notice shall include the details and photographs concerning the alleged defect. After
notification, an authorized Mondo representative shall have the right to inspect and verify the alleged defect. Promptly thereafter,
Mondo will, if it determines the claim to be valid, and at its discretion, elect one of the options as provided in paragraph 2 herein above.
If shipment of an alternative product(s) is elected in accordance with this Limited Material Warranty, Mondo will try to supply a color
and embossing, to the extent that they are reasonably available, close to that of the Specified Product at the basis of the warranty claim.
If a product similar to the Specified Product is to be supplied, Mondo will make reasonable efforts, to provide a similar product in color
and texture/finish, if its production can be combined with a production run of the same product and color; however Mondo cannot
guarantee an exact match of color, shading, marbleisation, fleck dispersion, or fmish of the Specified Product(s) to be repaired, replaced
or overlaid.
10. An express condition precedent to any and all liability hereunder shall be Mondo's receipt of full payment for the Specified
Materials. In no event shall Mondo have any liability hereunder unless Mondo has received full payment for the Specified Materials.
11. No delivery of a specified or alternative product(s) for any repair(s), replacement(s) or overlay(s) shall be deemed to extend
or prolong the Term of this Limited Material Warranty. This Limited Material Warranty shall be void if the Specified Products are
repaired, replaced or overlaid by persons other than those authorized and approved by Mondo to perform such work.
12. Receipt and installation of any and all Specified Products constitutes acceptance of this Limited Material Warranty and all

Operations Staff has solicited quotes and information regarding the declining state of the indoor
track at the Recreation Center and Natatorium. This track is heavily used year-round,
particularly due to the climate extremes in our region. As we have been able to quantitatively
correlate the decline of the track with the growth of our community population, this
recapitalization project qualifies for use of funds allocated to the Parkland Dedication Fund
(Fund 340). It is my recommendation that we utilize available funds from Fund 340, and award a
contract to the identified firm, that is both the lowest capable bidder as well as a member of the
cooperative purchasing group BuyBoard. Unless any issues remain unanswered, I will submit
the formal documentation necessary for award to be reviewed by City Council on the agenda of
a regular meeting for January 8, 2017.

Re: Running Track Replacement
Two repaired sections, but complete repair is not possible.

Previous attempt at repair (above left) created a hard spot due to amount of adhesive
required to prevent curling along the edges. Picture on right is the Northwest side, now
starting to come apart and curl. Smaller pieces do this first, as shown.
Picture on left happened within the last few months. Picture on right shows air pocket
underneath seam; this will likely curl as track has done above once seams start tosplit.
Other significant air pockets undemeath the surface; most are along seams.
Describe item/position reauested:
• Removal of worn and damaged running track surface with new safer and longer lasting
running surface.
• Multiple contractors have said that we are at the end of our track's lifespan; average life
span is typically five to six years with average wear for Nike grind indoor tracks. We are
now at year seven.
• Most Nike grind tracks from 2010 were resurfaced every 2-3 years, and then completely
replaced after 6 years due to degradation of support rubber, but mostly due to
breakdown along the edges and seams.
•
Recommendation is that we replace entire surface with a new running surface marked
lanes. New tracks have a typical lifespan of ten to twenty years depending on use and
conditions.
What is the impact if this request is notfunded?
• Seams are staring to pull apart and curl causing a safety concerns, including trip/fall
hazard.
• Once the seams start to pull apart or curl track degradation increases at a faster rate.
This will continue to compound until we cannot allow runners or walkers due to tripping
hazards and uneven surfaces.
• Contractors estimate that track surface will be unsafe within the next few months.
• Increasing liability risk from trips, falls, unsafe and uneven track surfaces.
• Consistent repairs and regluing are short term fixes, and do not address the issue of air
pockets underneath the track, or the wear of the running surface.
Recommendation to Council:
• Replace our Nike Grind track surface with a more durable, eco -friendly, well -tested
surface that has a 15-20 year average lifespan.
• Mondo Sportsflex M or Super X surfaces are the same price; Sportsflex M is a more
"general use" surface while the Super X is a traditional running/walking surface. My
recommendation is to use the Super X surface.

• This track surface is 10.5mm, which would add shock absorption for the runners over a
five or six millimeter surface. It would also provide additional sound deadening for
offices and rental areas underneath or adjacent to the track.
• The warranty on the surface of the track is based on wear for a ten year time period. The wear factor
decreases 10% annually after the first year.
