A Resolution of the City Council of the City of Pearland, Texas, authorizing the
power of eminent domain to acquire fee simple title to certain property for the
Hughes Ranch Road Improvement Project (Cullen Parkway to Smith Ranch
Road); being a 0.0331 of one acre (1,442 square feet) parcel of land
located in the H.T.& B.R.R. Co. Survey, Abstract No. 506, Brazoria
County, Texas and being situated in Reserve "A", of the FINAL REPLAT
OF CRYSTAL LAKE SUBDIVISION SECTION ONE, a subdivision per plat or
map recorded in Volume 19, Pages 711 -714, Brazoria County Map Records
(B.C.M.R.), said 0.0331 acre parcel being out of and a part of a tract
described as Reserves A through M in a conveyance to Crystal Lake
Property Owners Association, Inc. recorded under Brazoria County Clerk's
File (B.C.C.F.) No. 98044916 dated October 21, 1998, for the construction
and maintenance of water, sewer, drainage and road improvements on certain
real property described herein; authorizing the city attorney, or his designee,
and other city officials to take such actions as are necessary to acquire said
property, located within the city, by donation, purchase, or by the exercise of
the power of eminent domain.
WHEREAS, the City Council recognizes that a public convenience and necessity exists for
the location, construction, operation, and maintenance of water, sewer, drainage and road
improvements on certain real property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the public's best
interest to acquire fee title on certain property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public convenience and
necessity exists for the construction of water, sewer, drainage and road improvements on certain
real property located in Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of fee title by
donation, purchase, condemnation, or otherwise, of certain real property located within the City and
situated in Brazoria County, more particularly described in Exhibits "A" and "B", attached hereto and
incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to acquire the
property interest, described in Exhibits "A" and "B", either by donation, purchase or the exercise of
the power of eminent domain.

Survey, Abstract No. 506, Brazoria County, Texas and being situated in Reserve "A", of the
FINAL REPLAT OF CRYSTAL LAKE SUBDIVISION SECTION ONE, a subdivision per plat
or map recorded in Volume 19, Pages 711 — 714, Brazoria County Map Records (B.C.M.R.), said
0.0331 acre parcel being out of and a part of a tract described as Reserves A through M in a
conveyance to Crystal Lake Property Owners Association, Inc. recorded under Brazoria County
Clerk's File (B.C.C.F.) No. 98044916 dated October 21, 1998 and being more particularly
described by metes and bounds as follows:
COMMENCING at a 1/2 inch iron rod marking the intersection of the South line of a tract
described as 3.12 acres in a conveyance to Thomas J. Taylor, et ux recoded in Volume 1509, Page
784 of the Brazoria County Deed Records with the existing East right-of-way line of Sterling Drive
(60 feet width) (Also known as County Road 60) and being located North 87° 20' 09" E, 29.90
feet from the Southwest corner of said 3.12 acre tract, thence as follows:
North 02° 59' 51" West, along and with the existing East right-of-way line of said Sterling Drive,
at a distance of 165.12 pass the Southwest corner of a called 1.451 acre tract as described in a
conveyance to James Craig Trevillian, et ux, recorded under B.C.C.F. No. 93016039, and
continuing for a total distance of 309.74 feet to a 5/8 inch iron rod with cap stamped "Brown &
Gay" set in the proposed South right-of-way line of County Road No. 403, also known as Hughes
Ranch Road (120 feet width);
North 87°15'33" East, along and with said proposed South right-of-way line, a distance of 278.02
feet to a 5/8 inch iron rod with cap stamped `Brown & Gay" set for an angle point in said proposed
south right-of-way line;
South 81'15'45" East, continuing along and with said proposed South right-of-way line, a distance
of 60.30 feet to a 5/8 inch iron rod with cap stamped "Brown & Gay" set for an angle point in said
proposed south right-of-way line;
North 87°15'33" East, continuing along and with said proposed South right-of-way line, a distance
of 45.84 feet to a 5/8 inch iron rod with cap stamped "Brown & Gay" set on the common line of
said 1.451 acre tract and said Reserve "A", marking the Southwest comer and POINT OF
BEGINNING of the herein described parcel and having surface coordinates of X=3,126,219.37,

1. THENCE, North 02° 59' 27" West, along and with said common line, a distance of 12.00
feet to a 5/8 inch iron rod with cap stamped "Brown & Gay" set for the Northwest corner
of the herein described parcel and said Reserve "A";
2, THENCE, North 87° 15' 33' East, along and with the north line of said Reserve "A", a
distance of 129.41 feet to a 5/8 inch iron rod with cap stamped "Brown & Gay" set for the
Northeast corner of the herein described parcel and said Reserve "A", same being the
beginning of a non -tangent curve to the right, from which its center bears
North 81° 12' 14" West, 25.00 feet;
3. THENCE, In a Southerly direction, along the east line of said Reserve "A" and said curve
to the right, a distance of 11,05 feet, having a radius of 25.00 feet, a central angle of 25°
19' 59" and a chord which bears South 21° 27' 45" West, 10.96 feet to a 5/8 inch iron rod
with cap stamped "Brown & Gay" set for the Southeast corner of the herein described
parcel and said Reserve "A", same being the Northeast corner of Reserve "L" of said
FINAL REPLAT OF CRYSTAL LAKE SUBDIVISION SECTION ONE;
4. THENCE, South 87° 15' 33" West, along and with the conunon line of said Reserve "A"
and said Reserve "L", a distance of 29.50 feet to a 5/8 inch iron rod with cap stamped
"Brown & Gay" set for the beginning of a tangent curve to the left;
5. THENCE, In a Westerly direction, continuing along and with said common line and along
said curve to the left, a distance of 18.48 feet, having a radius of 85.00 feet, a central angle
of 12° 27' 14" and a chord which bears South 81° 01' 56" West, 18.44 feet to a 5/8 inch
iron rod with cap stamped "Brown & Gay" set for an angle point in the South line of the
herein described parcel;
6. THENCE', South 87" 15' 32.86" West, over and across said Reserve "A", a distance of
77.03 feet to the POINT OF BEGINNING and containing 0.0331 of one acre (1,442
square feet) of land.
