R2017-068 2017-04-10RESOLUTION NO. R2017-68 A Resolution of the City Council of the City of Pearland, Texas, requesting that the Executive Director of the Texas Commission on Environmental Quality (`TCEQ") suspend TCEQ Municipal Solid Waste Permit No. 1505A ("Permit) until the Blue Ridge Landfill ("BRL") demonstrates to the TCEQ that landfill is operating in strict compliance with the Permit and all rules and regulations governing nuisance odors and surface concentration monitoring associated with the landfill. WHEREAS, BRL is a permitted landfill located in Fort Bend County that operates under the rules and regulations of the TCEQ; and WHEREAS, based on TCEQ records, from November 1, 2014 to November 30, 2016 there were 358 complaints filed against BRL, and there were more than 1,800 odor complaints in the surrounding area during the same period; and WHEREAS, In a TCEQ investigation conducted from May 4, 2016 to August 18, 2016, the TCEQ documented that BRL failed to prevent nuisance odor conditions at the landfill; and WHEREAS, In another TCEQ investigation from October 18, 2016 through November 10, 2016, it was documented that BRL failed to properly monitor surface concentrations at the landfill; and WHEREAS, the City Council acknowledges that TCEQ regulations governing the operations of landfills exist to protect the health, safety and welfare of the public; and WHEREAS, the City Council, in the interest of the public, requests that the TCEQ strictly enforce all rules and regulations that apply to BRL landfill. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That City Council hereby requests that the Executive Director of the Texas Commission on Environmental Quality (TCEQ") suspend TCEQ Municipal Solid Waste Permit No. 1505A ("Permit) until the Blue Ridge Landfill ("BRL") demonstrates to the TCEQ that the landfill is operating in strict compliance with the Permit and all rules and regulations governing RESOLUTION NO. R2017-68 nuisance odors and surface concentration monitoring associated with the landfill. PASSED, APPROVED and ADOPTED this the 10th day of April, A.D., 2017.
