Ordinance No. CUP 17-00001 An ordinance of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) to allow for a Liquor/Package Store in the General Business (GB) zoning district, being Reserve G a 1 .5707 acre portion of a 20.8406 acre (907,818 square feet) tract of land being all of proposed Albertson's Pearland, a subdivision of land out of Lots 31, 32, 63, and 64 of the Allison — Richey Gulf Coast Home Company Subdivision of Section 9, H. T. & B. Railroad Company Survey, Abstract No. 234, Brazoria County, Texas, according to the plat recorded in Volume 2, Page 24, of the Brazoria County Plat Records. (Located at 7109 W. Broadway Street, Pearland, TX.) Conditional Use Permit Application No CUP 17-00001, within the General Business (GB) zoning district, at the request of Hiren C. Patel, applicant, on behalf of 2ML Real Estate Interests, Inc., owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. WHEREAS, Hiren C. Patel, applicant, on behalf of 2ML Real Estate Interests, Inc., owner; is requesting approval of a Conditional Use Permit (CUP) to allow for a Liquor/Package Store use on approximately 1 .5707 acres of land on the following described property; said property being legally described in the legal description attached hereto and made a part hereof for all purposes as Exhibit "A," and more graphically depicted in the vicinity map attached hereto and made a part hereof for all purposes as Exhibit "B"; and WHEREAS, on the 20th day of February 2017, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached hereto and made a part hereof for all purposes as Exhibit "C," said call and notice being in strict conformity with provisions of Section 1.2.2.2 of Ordinance No. 2000T; and WHEREAS, on the 21st day of February 2017, the Planning and Zoning Commission submitted its report and recommendation to the City Council regarding the proposed Conditional Use Permit (CUP) to allow for a Liquor/Package Store use on an approximately 1.5707 acres of land, said recommendation attached hereto and made a part hereof for all purposes as Exhibit "D"; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, City Council considered this application and the recommendation of the Planning and Zoning Commission at regular meetings on the 20th day of March 2017 and the 27th day of March 2017; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Hiren C. Patel, applicant, on behalf of 2ML Real Estate Interests, Inc., owner; for approval of a Conditional Use Permit on approximately 1.5707 acres of land to allow for a Liquor/Package Store use; presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section I. The following described property located within the corporate City Limits of the City of Pearland, Texas, and presently being located within the General Business (GB) zoning district, is hereby granted a Conditional Use Permit (CUP) to allow for a Liquor/Package Store use, subject to all requirements of the GB zoning district, and the site plan and other details attached hereto and made a part hereof for all purposes as Exhibit "E", in accordance with all conditions and requirements of the current Unified Development Code and the following conditions approved by the City Page 2 of 11 Ord. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission for consideration and decision. Section III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. Section IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. General Location: 7109 W. Broadway Street, Pearland, TX. Summary of Request This request is for approval of a Conditional Use Permit (CUP) located at 7109 W. Broadway Street, to allow for a Liquor/Package Store in the General Business (GB) zoning district. The property is currently developed as a shopping center and the proposed use will be located in an existing 1 ,500 square foot suite within the center. On October 24, 2016, the City Council approved Liquor/Package Stores as a new land use category which, in addition to the GB zoning district, also requires a CUP within the Business Park — 288 (BP-288), General Commercial (GC), and Light Industrial (M-1) zoning districts. Recommendation Staff recommends approval of the requested CUP for a Liquor/Package Store on the approximately 1.5707 acre site for the following reasons: 1. The parcel is surrounded by other commercially zoned properties and is not adjacent to residentially zoned land. 2. The location is not at an entrance to residential neighborhoods. 3. The proposed use is a retail use of similar size and intensity to the surround retail and commercial uses and therefore compatible. 4. The location in an established shopping center mitigates the potential for negative aesthetics or activity that might accompany this type of retail use. 1 i RESPONSIVE RESULTS-ORIENTED TRUST-BUILDERS ACCOUNTABLE 5. The applicant has not proposed any modifications to the suite such as bars over the windows or additional light which would negatively affect the surrounding businesses. If the CUP is considered for approval, staff recommends the following conditions: 1. Bars over or behind the windows would be prohibited. 2. Neon and LED strip lighting around the doors or windows would be prohibited. Site History The subject property is currently developed as a shopping center. The site was annexed into the City in two parts; the first portion in 1995 and the second in 1997. The property has been zoned as General Business (GB) since that time. The site is bounded by General Business (GB) to the north, south, east, and west. The below table identifies surrounding uses and zoning districts: North General Business (GB) Retail Center (Food Town) Enterprise Rental Car South General Business (GB) Metro PCS Church's Chicken East General Business (GB) Sonic Drive-In Undevelo•ed Pro•ert West General Business (GB) Retail Center Conformance with the Comprehensive Plan The current zoning of GB on the subject property is in conformance with the future land use designation of the Comprehensive Plan. The Future Land Use Plan (FLUP) indicates the property to be "Business Commercial" which is suitable for retail businesses. The purpose of the CUP is to allow uses that may be suitable in certain locations within a zoning district or when additional standards and conditions can be imposed to ensure compatibility with adjoining uses. The proposed use is a retail use of similar size and intensity to the surround retail and commercial uses and therefore compatible. Conformance with the Thoroughfare Plan According to City records, Broadway Street is a Major Thoroughfare that is to be widened. Major Thoroughfares are defined as having a minimum right-of-way of 120 feet. Conformance with the Unified Development Code The property is currently developed as a shopping center. The General Business Retail District (GB) is intended to permit an extensive variety of commercial uses including retail trade, personal and business service establishments, offices and commercial recreational uses of limited scope. The proposed business is compatible with and compliments the surrounding uses. 2IPage RESPONSIVE RESULTS-ORIENTED TRUST-BUILDERS ACCOUNTABLE The lot requirements exceed the lot and setback requirements of the proposed GB zoning district, as indicated in the in the following table. General Business (GB) Area Regulations Size of Lot Required Proposed Minimum Lot Size 22,500 sq. ft. 1.5707 Acres (68,420 sq. ft.) Minimum Lot Width 150 ft. 56.8' (flag lot) Minimum Lot Depth 125 ft. 575.64 ft. The location for the proposed use is within an existing shopping center. The shopping center does not currently meet the requirements of the Unified Development Code (UDC) however, as the shopping center is currently and actively conducting business, the site will not be required to come into full compliance. The property also falls within the Corridor Overlay District (COD) and any future redevelopment would be required to be in compliance with the COD requirements in addition to other UDC requirements. Until new or redevelopment occurs on the site, compliance with the COD will not be required. Platting Status The subject property is currently platted as Albertson's Pearland, Block 2, Reserve `G', which was recorded May 8, 1997. Availability of Utilities According to City records, the subject property has access to City water and sanitary sewer infrastructure. A 16-inch water line exists along the south side of Broadway Street and another 8-inch water line is located along the boundary of the shopping center. A 12-inch sanitary sewer line runs along the north side of Broadway Street and another 6 —inch sanitary sewer line runs along the eastern boundary of the subject property. Impact on Existing and Future Development The proposed development is not anticipated to have a negative impact on the surrounding area. The proposed land use will take place within an existing shopping center that is equipped with parking and other requirements of development. The retail nature of the proposed use is compatible with the existing shopping center and neighboring retail uses. The proposed use at this location will not be in proximity to residential areas and will not negatively impact any residential neighborhoods. Additional Comments The request has been reviewed by the City's Development Review Committee (DRC) and there were no additional comments from other departments at the time of this report. Public Notification 3 RESPONSIVE RESULTS-ORIENTED TRUST-BUILDERS ACCOUNTABLE Staff sent public notices, comment forms and a vicinity map to the applicant, the owner of the property and to property owners within 200 feet of the subject property under consideration for the zone change. Additionally, a legal notice of the public hearing was published in the local newspaper, and a notification sign was placed on the property by the applicant.
