WHEREAS, Pastor Keith Anderson, applicant for Pearland New Harvest Christian Fellowship, Inc., owner, filed on September 2, 2004, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A"; and WHEREAS, on the 18th day of October, 2004, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached thereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of Section 28.3 and 28.4 of Ordinance No. 509; and 1 ORDINANCE NO. 509-749 WHEREAS, on the 2nd day of November, 2004, the Planning and Zoning Commission of the City submitted its report and recommendation to the City Council regarding the proposed amendment application by Pastor Keith Anderson, applicant for Pearland New Harvest Christian Fellowship, Inc., owner, whereby the Commission recommended approval of the change of classification for the described property from its existing classification of Suburban Development District (SD) to Single Family Dwelling District — Specific Use Permit (R-1(S)), a Specific Use Permit for a church and church facilities; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and the recommendation of the Planning and Zoning Commission at a regular meeting on November 8, 2004; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Pastor Keith Anderson, applicant for Pearland New Harvest Christian Fellowship, Inc., owner, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Suburban Development District (SD) is hereby zoned to Single Family Dwelling District — Specific Use Permit (R-1(S)), a Specific Use Permit for a church and church facilities, subject to the following conditions: 1) Development of the subject property shall comply with Section 22.6 (A) of the Land Use and Urban Development Ordinance; 2 ORDINANCE NO. 509-749 2) Development of the subject property shall comply with Sections 22.1, 22.2, 22.3, 22.4, and 22.5 of the Land Use and Urban Development Ordinance; 3) All refuse containers placed on the subject property shall be screened from public view on 3 sides with an opaque fence; and such property being more particularly described as: 5.00 acres of land being the west half of Lot 19, Allison Richey Gulf Coast Home Company's Suburban Gardens Subdivision of Section 80, H.T. & B.R.R. Company Survey, Abstract 564, Brazoria County, Texas, according to the Plat recorded in Volume 2, Page 98 of the Plat Records of Brazoria County, Texas (Located at 12216 West Broadway Street) II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. 3 V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. VI. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. 509 and consistent with the approval herein granted for the reclassification of the herein above described property. Grahmann, Senior Planner SUBJECT: Consideration and Possible Action—Zonehange Application No. 1197 and Specific Use Permit No. 136 (Request for an amendment to the Land Use and Urban Development Ordinance from classification Suburban Development District (SD) to Single Family Dwelling District — Specific Use Permit (R-1(S)) for a church and related facilities, on the Property Located at 12216 West Broadway Street SUMMARY: This zone change request for R-1 and a Specific Use Permit for a church and related uses was tabled by the Planning and Zoning Commission during the meeting of October 18, 2004, in order to allow Staff and the applicant additional time to review the zone change request and specific use permit. As discussed during the Joint Public Hearing and Planning and Zoning Commission Meeting on October 18, the proposed Specific Use Permit is a discretionary item. Therefore, additional safeguards and conditions can be placed on the approval of a Specific Use Permit. More specifically, since the subject tract is being requested . for R-1 zoning, many development standards do not apply to an R-1 tract. Consider the following: 1. Building Facade Ordinance. The building facade ordinance does not apply to R-1 districts, or any residential districts. Since the subject property is located on Future Broadway Street, Staff is concerned about the building facade,and Staff recommends that any future buildings on the subject property be developed according to Paragraph "A" of the Building Facade Ordinance. 2. Screening Fence. The subject property is adjacent to the Southern Trails development, which shows single family residential lots directly on the south and west sides of the subject property. Although the church is not a residential use, it would be zoned R-1 and a screening fence would not be required to be installed by the Church. The existing church to the east of the subject property currently does not have a screening fence along its south side. If the Commission believes that screening between uses is important, several types of screening could be considered, such as a solid masonry fence, wrought iron fence with masonry columns, or a living screen ,of shrubbery. The Southern Trails PUD document does not specify the type of fencing that they would provide along the adjacent residential properties. 3. Landscaping. The landscape ordinance .does not apply to . R-1 " zoned properties. Therefore, the Commission may want to consider having the applicant comply with Chapter 22 Landscape Regulations of the Zoning Ordinance. 4. Dumpster Screening. Applicant: Pastor Keith Anderson SUMMARY: The applicant is requesting a change in zoning on the subject property for single family residential uses, as well as a Specific Use Permit for a church and related facilities. The subject property was annexed into the City in 1999 and subsequently zoned SD. The subject property is currently undeveloped, and is adjacent to a church. The church property and the subject property are both owned by the New Harvest Christian Church. The applicant has indicated that they plan to construct additional church or church educational facilities on the subject property if the zone change and specific'use permit are approved. SURROUNDING ZONING AND LAND USES: North Zoning Planned Unit Develoment Undeveloped land - District (PUD) for Shadow Creek Ranch Land Use Zone Change Application No. 1197 and SUP 136 Page 1 South East West JOINT PUBLIC HEARING AGENDA ITEM MEETING OF OCTOBER 18, 2004 Planned Unit Development District (PUD) for Southern Trails Single Family Dwelling District — Specific Use Permit (R-1(S)) for church and related facilities Planned Unit Development District (PUD) for Southern Trails Undeveloped land Pearland New Harvest Christian Fellowship Church Undeveloped land CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The applicant is requesting an R-1 zoning district. The minimum lot size for the R-1 district is 8,800 square feet and the minimum lot width is 80 feet. The subject property meets these requirements; the subject property is approximately 5 acres in size and has approximately 400 feet of frontage along Broadway Street. The applicant will be responsible for complying with all other space limitations of the. R-1 zoning district, such as yard setback requirementsand lot coverage. CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004 update adopted on July 26, 2004) recommends "Low Density Residential" for the subject property and for the surrounding properties on the south side of Broadway Street. The Comprehensive Plan further indicates that the appropriate zoning districts for Low Density Residential are the Estate Lot Single Family Dwelling District (R-E) and the Single Family Dwelling District (R-1). Since a church is allowed in an R-1 district by approval of a Specific Use Permit, the proposed zone change and specific use permit do not conflict with the Comprehensive Plan. CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage : on Broadway Street, a major thoroughfare with an ultimate right-of-way. of 120 feet. If the subject property is required to be platted, a right-of-way.dedicatian for Broadway: Street may be necessary. The applicant may be responsible for submitting a traffic impact analysis (TIA) for. the subject property as it is developed, in order to determine the allowed number of driveways and driveway separations. Zone Change Application No. 1197 and SUP 136 -= Page 2 JOINT PUBLIC HEARING AGENDA ITEM MEETING OF OCTOBER 18, 2004 IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The lot directly to the east of the subject tract is currently zoned R-1 with an approved Specific Use Permit for a church. The subject property is completely surrounded on the south and west sides by the Southern Trails development. The .Southern Trails PUD indicates that all tracts that surround the subject property and the existing church are to be developed with single family residential uses. With the church fronting Broadway Street, and all traffic generated by the church entering and exiting on Broadway Street, it is anticipated that the subject property will not negatively impact the surrounding future residential properties. A church is.a permitted use within the office district, neighborhood service district, general business district, and commercial district. Instead of choosing one of these non-residential districts, the applicant chose the R-1 district with the specific use permit in order to be consistent with the existing zoning for the adjacent property in which the church is built, and to be more compatible with the adjacent residential properties. The proposed Specific Use Permit is a discretionary item for review by the Planning and Zoning Commission and City Council, and additional safeguards and conditions can be placed on the approval of a Specific Use Permit. With the subject property being requested for R-1 zoning, the building facade ordinance would not apply to an R-1 tract. Also, if the subject property is zoned R-1, and being adjacent to the Southern Trails PUD, which is also residential, the church would not be required to construct any type of screening fence. Also, other standards, such as landscaping, dumpster screening, parking, etc., would not apply to residentially zoned property. If the Commission and Council believe that a building facade standard or screening fence is warranted, a condition such as that could be placed on the approval of the Specific Use Permit, The following condition could be placed on the approval of the Specific Use Permit: "The development of the subject property should comply with all requirements of the Land Use Ordinance as if the property were zoned Commercial District, such as building facade standards, 6 foot high screening fence, landscaping, dumpster screening, and parking." PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners within 200 feet of the subject property under consideration. A legal notice of public hearing was published in the local newspaper, and a Zoning Sign was placed on the subject property. STAFF RECOMMENDATION: Staff recommends approval of the zone change for R-1 and Specific Use Permit, as proposed by the applicant, for the following reasons: 1. The proposed zone change and specific use permit provide for church and related uses, which tend -to be compatible with adjacent residential uses.. 3. The following condition be placed on the approval of the Specific Use Permit: "The development of the subject property should comply with all requirements of the Land Use Ordinance as if the property were zoned Commercial District, such as building facade standards, 6 foot high screening fence, landscaping, dumpster screening, and parking."
