R2000-100 09-12-00RESOLUTION NO. R2000-100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, CONSENTING TO THE CREATION OF FORT BEND COUNTY FRESH WATER SUPPLY DISTRICT NO. 1. WHEREAS, in accordance with Chapter 53 of the Texas Water Code, the Fort Bend County Fresh Water Supply District No. 1 (the "District") was duly created on January 23, 1997; and WHEREAS, pursuant to Section 42.042, Texas Local Government Code, no land within the extraterritorial jurisdiction of a city shall be included in a district unless the City grants its written consent, by resolution, to the inclusion of the land within the district; and WHEREAS, the District submitted a petition, attached as Exhibit "A", for the City's consent to the creation of a fresh water supply district containing approximately 4,704 acres situated within Fort Bend County, Texas; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the City Council hereby consents to the creation of Fort Bend County Fresh Water Supply District No. 1. Section 2. This Resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Pearland and it is accordingly so resolved. Rozell, County Judge of Fort Bend County, Texas, pursuant to Chapter 53 of the Texas Water Code. A fully executed copy of the order is attached hereto. Pursuant to Section 42.042, Texas Local Government Code, as amended, no land within the extraterritorial jurisdiction of a city shall be included in a district unless the city grants its written consent, by resolution or ordinance, to the inclusion of the land within the district. Accordingly, we respectfully petition the City of Pearland for consent to the creation of Fort Bend County Fresh Water Supply District No. 1 of Fort Bend County, Texas. Enclosed please find a Petition for Consent to Creation of Fort Bend County Fresh Water Supply District No. 1 with the requisite signatures and the Resolution Requesting Consent as approved by the District's Board of Supervisors. To date, the District has not levied any taxes, authorized any bonds for issuance, or constructed any water supply or sanitary sewer services in the District; furthermore, the District is currently financially dormant. The name of the District is "Fort Bend County Fresh Water Supply District No. 1." II. Said District is organized under the terms and provisions of Article XVI, Section 59 of the Constitution of Texas, and Chapters 49 and 53 of the Texas Water Code, together with all amendments and additions thereto. Said District contains an area of approximately 4,704 acres of land, situated within Fort Bend County, Texas, described by metes and bounds in Exhibit "A," attached hereto and incorporated herein. A portion of said District is located within the extraterritorial jurisdictions of the City of Pearland. IV. Said District shall be organized for the purposes allowed under Texas Water Code, Sections 53.101 and 53.121: (1) To conserve, transport, and distribute fresh water from any sources for domestic and commercial purposes; and (2) To collect, transport, process, dispose and control all domestic and commercial wastes, whether of fluids, solids or composites. 3289.0\226684.1 KCORPREW V. The general nature of the work to be done by and within the District at the present time is the (i) construction, maintenance and operation of a waterworks system for domestic and commercial purposes; (ii) the construction, maintenance and operation of a sanitary sewer collection system and sewage disposal plant; and (iii) such other construction, installation, maintenance, purchase and operation of such additional facilities, systems, plants and enterprises as shall be consonant with the purposes for which the District is organized. The estimated cost to complete this work is a approximately twenty-six million dollars ($26,000,000). VI. A necessity exists for the improvements above described because the residents and land located within the District need a public supply of safe drinking water and an adequate sanitary sewer system in as much as the existing area has been cited on numerous occasions for public health violations due to the lack of such facilities. In addition, the area has been cited for the absence of sufficient water for fire fighting purposes. The purchase, construction, extension, improvement, maintenance and operation of such waterworks system and sanitary sewer collection disposal system will conserve and preserve the natural resources of this State by promoting and protecting the purity and sanitary condition of the State's waters and will promote and protect the public health and welfare of the community; therefore, a public necessity exists for the organization of said District. VII. Creation of the District is feasible because there exists within the boundaries of the District a significant amount of tax base and a significant number of occupied residences, whose occupants will be customers for water and sewer service. VI". In requesting that the City Council and Mayor consent to the creation of the District, the undersigned is willing to accept such consent based upon the terms and conditions set out in Exhibit "B" attached hereto and in consideration of the City granting its consent for the creation of a District, the undersigned do expressly agree to comply with said conditions.
