AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN DEVELOPMENT
ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF
CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY LOCATION
BEING 18.325 ACRE TRACT OF LAND IN THE T. D. YOAKUM SURVEY,
ABSTRACT 399, AND THE A.C.H. & B. SURVEY, ABSTRACT 147, BRAZORIA
COUNTY, TEXAS, SAID TRACT BEING DESCRIBED IN A DEED RECORDED IN
CLERK'S FILE NO. 2004018266 IN THE BRAZORIA COUNTY CLERK'S OFFICE
(GENERALLY LOCATED ON THE NORTH SIDE OF JOHN LIZER ROAD, AND

RELATED TO THE SUBJECT.
WHEREAS, Clarinda Robertson, Applicant for Vivien Naeve, Owner, filed on
August 2, 2004, an application for amendment pursuant to Section 28 of Ordinance No.
509, the Land Use and Urban Development Ordinance of the City, for approval of a
change in the land use as provided for in said Section 28, said property being legally
described in the original applications for amendment attached hereto and made a part
hereof for all purposes as Exhibit "A"; and
WHEREAS, on the 20th day of September, 2004, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached thereto and made a part hereof for all
purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of
Section 28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 29rd day of September, 2004, the Planning and Zoning
Commission of the City submitted its report and recommendation to the City Council
regarding the proposed amendment application by Clarinda Robertson, Applicant for
Vivien Naeve, Owner, whereby the Commission recommended denial of the change of

classification for the described property from its existing classification of Single Family
Dwelling District (R-1) to General Business District (GB); and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on October 11, 2004; and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises, finds that in the case
of the application of Clarinda Robertson, Applicant for Vivien Naeve, owner, presented
which, in the judgment of the City Council, would justify the approval of said application;
now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Single Family Dwelling District (R-1)
is hereby zoned to General Business District (GB), such property being more
particularly described as:
18.325 acre tract of land in the T. D. Yoakum Survey, Abstract 399, and the
A.C.H. & B. Survey, Abstract 147, Brazoria County, Texas, said tract being
described in a deed recorded in Clerk's File No. 2004018266 in the Brazoria
County Clerk's Office (Generally Located on the North Side of John Lizer Road,
and East of Pearland Parkway)
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been

accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.

VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

Honorable Mayor and Council Members:
At their regular meeting of September 20, 2004 the Planning and Zoning Commission considered
the request for a zone classification change from Single Family Dwelling District (R-1) to
General Business District (GB), on the following property:

Discussion ensued regarding conformance to the Comprehensive Plan. The Commission stated
that the Comprehensive Plan was just adopted by the city, and proposed zone changes should
stay in conformance with the Comprehensive Plan.
Commissioner Greiner made a motion to approve, and Vice Chairman Iocco seconded.
Motion to approve failed 0-7.

Subject: #1189 Rezoning Request
Dear Mr. Mayor and City Council Members:
Clarinda Robertson — President and Linda Carr — Vice President of Sensational Event
Solutions, Inc., namely SES, propose to bring to the Pearland community an exciting
breath of fresh air in the event -planning market. By building The Crystal Atrium
combined with beautiful landscaping, old fashioned values, going the extra mile, and
using cutting edge event -planning techniques, SES plans to join with the Pearland
community in creating a much needed meeting place to make Pearland the place to live,
grow, and be entertained.
After much searching, a 21-acre tract of land along Pearland Parkway and John Lizer in
Pearland was decided as the perfect place to start construction. The acreage has been
surveyed and is scheduled to be platted, tree studied, and topographied.
For the progression of the project, SES respectfully requests that the 18.326 acres that
faces John Lizer be rezoned from Residential 1 to General Business to -conform with the
3.14-acre tract of land facing Pearland Parkway that is already zoned General Business.
The following listing is a brief description of the usage of the 18.326 and 3.14 tract sites:
Professional landscaping will be maintained along Pearland Parkway and John Lizer with
twenty feet of the natural tree line that is currently surrounding the properties being
preserved. All efforts will be made to protect as many of the abundant trees and shrubs
as possible. The entrance on Pearland Parkway will be approximately 60-70 ft in width
with lighted cascading waterfalls and pillars on both sides. The driveway to The Crystal
Atrium will have lighted fountains dividing the entrance and exit lanes.
1. The Crystal Atrium
This facility is nothing the event community has ever seenoutside of
elaborate hotel ballrooms. Even then, the hotel ballrooms don't furnish
the soothing and enjoyable landscape and atmosphere that will be
naturally included in each event planned. The building is 38,950 sq ft and
will consist of one room with a 750. capacity, two rooms with a 300
capacity each, one room with a 175 capacity, two bride's rooms, two
groom's rooms, four offices, one conference room, restrooms, storage
room, mechanical room, laundry room, employee break room,
professional kitchen, floral room, two conservatory atriums, and two large
patios with pergola arbors. The rooms themselves will be decorated in
such a manner that no additional decorating will be needed other than
choice of color theme and floor plan. Services of music, menu, and
photographer for the event are the only additional decisions.
2. Mary's Creek Wedding Chapel
A beautiful, quaint 2700 sq ft wedding chapel is to be constructed on the
premises of The Crystal Atrium to accommodate those that choose to get
married closer to their receptions or cannot find a suitable church in the
timeframe they need. It will feature large stain glass windows, seating for
250, music/audio capabilities, and a horse-drawn carriage to carry the
newlywed couple to their destination, whether that be to an outside
reception, inside reception at The Crystal Atrium, or their waiting vehicles
if their reception is at another center.
3. Greenhouse
A 2400 sq ft working greenhouse used to supply the floral and plant
demands of the entire facilities and outside orders of Special Days, a rental
division of SES, will also be housed on the premises. The greenhouse will
be crafted similar to an old-fashioned plant conservatory in order to
enhance the landscape of the project.
In conclusion, both Linda Carr and myself would like to thank you for your time

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
applicant is requesting a GB zoning district. The minimum lot size for the GB district is
22,500 square feet and the minimum lot width is 150 feet. The subject property meets
these requirements; the subject property is approximately 18 acres in size and over 380
feet in width along John Lizer Road.
The applicant will be responsible for complying with all other space limitations of the GB
zoning district.
CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004
update adopted on July 26, 2004) recommends Low Density Residential for the subject
property. The Comprehensive Plan further indicates that the appropriate zoning districts
for Low Density Residential are the Estate Lot Single Family Dwelling District (R-E) and the
Single Family Dwelling District R-1. Therefore, the proposed zone change does not
conform to the Comprehensive Plan.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on John Lizer Road, a secondary thoroughfare with an ultimate right-of-way of 100 feet.
No other roadways affect the subject property.
The applicant may be required to submit a traffic impact analysis (TIA) for the subject
property when it is submitted for development, in order to determine the impact of the
proposed development on the surrounding streets, and in order to determine the locations
of driveways.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The proposed zone change
should have minimal impact on surrounding properties. Although the Comprehensive Plan
recommends Low Density Residential uses for the subject property, the subject property
may be more suited for General Business uses. The Comprehensive Plan also
recommends that the area between the subject property and Pearland Parkway be Low
Density Residential, also. However, that property is already zoned General Business.
A creek exists to the north of the subject property. The creek is a natural feature that
serves as a buffer between the single family residential uses to the north and east, to the
general business along Pearland Parkway and John Lizer Road.

The Comprehensive Plan adopted in July 2004 contains a checklist of items that should be
reviewed when considering deviations from the Comprehensive Plan. Since the proposed
zone change does notconform to the Comprehensive Plan, it is important to review this
checklist:
• Will the proposed development enhance the City economically?
• Will the proposed development enhance the City aesthetically?
• Is the proposed development consistent with the City's vision, goals, and/or
objectives?
• Is the proposed development a better use of land/property, both for the
owner/developer and the City, than that recommended by the Plan?
• Will the proposed development impact adjacent residential areas in a positive or
negative manner?
• Will the proposed development have adequate access — have considerations been
made for roadway capacity, ingress and egress, traffic impact?
• Are uses adjacent tothe proposed development similar in nature in terms of
appearance, hours of operation, and other general, aspects of compatibility?
•. Does the proposed development present a significant benefit to the public health,
safety, and welfare of the community?
Staff is of the opinion that the creek serves as a buffer between the existing residential
uses and any non-residential uses, thereby decreasing any incompatibility between uses.
Any deviation from the Comprehensive Plan should be an improvement over what is
recommended within the Plan. It is Staffs opinion that the proposed GB at this major
intersection would better serve the subject area.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.

STAFF RECOMMENDATION: Staff recommends approval of the zone change for
General Business District as proposed by the applicant, for the following reasons:
1. Although contrary to the Comprehensive Plan designation of Low Density
Residential, the subject tract is located at a major intersection and would be
separated from residential uses by a creek, which would serve as a buffer between
uses.
2. The proposed zone change is consistent with existing General Business Districts
located along Pearland Parkway.

believe any business would be intrusive on the surrounding neighborhoods as
well as the high school, but, even more so, the proposed Event Center and
possible Convention Center would adversely affect all of the surrounding
neighborhoods. Businesses, especially an event center, would be very
detrimental to this highly -residential area causing the devaluation of our
property, traffic problems (bussing event participants from the high school
and First Baptist Church has been mentioned), and possibly bringing more
crime and litter to our area as well as more noise.
The 2004 Comprehensive Plan for the City of Pearland addresses the need to
keep a large portion of the City of Pearland as residential. There are
several idea: sights for a Convention Center in Pearland that are not
embedded in a residential area. Before purchasing our homes, many of us
reviewed the City's zoning maps and bought homes in our subdivisions knowing
we would be bordered by other homes and Independence Park - making the area

I am emailing to express my strong disapproval of rezoning application 1189 (John Lizer @ Pearland
Parkway). Changing this land to general business and allowing an event/convention center to be built will
be detrimental to the surrounding communities. As the treasurer for River Mist Homeowners Association,
I feel that our community will be adversely affected by the proposed changes. This will create major traffic
problems for our community. We only can only enter and exit our community from 3 entrances.. Two of
these are on John Lizer. I am afraid of the intersection turning into what has happened at Beltway 8 and
Telephone.
It is my responsibility as a board member of the homeowners association to preserve the property values
of the homes in our subdivision. The rezoning of this land can only have a negative impact on our
property values. This type of facility should be located in a place that can better handle traffic flow (like
518). I plan to attend the council meeting on October 11 along with others that oppose this rezoning. I
hope that you will agree with my views and the recommendation of the P&Z committee to deny application

I'm a resident home owner in the Rivermist subdivision. I want to thank you for being so
helpful in providing our HOA board member, Dana Morrison, with the information she
sought about the possible rezoning of the acreage north of John Lizer and East of
Pearland Parkway.
I'd like you to know that I want the City Council to follow the recommendation of the
P&Z committee and deny the proposed rezoning (Application 1189). I want the
property to remain zoned for single-family residential. My neighbors and I do not want
the noise and traffic of an event center or other business district in this residential area.
We believe that such a commercial enterprise would lower our quality of life and -lowe'rc
our property values.

Dear Mayor Tom Reid and Pearland City Council Members:
I wholeheartedly agree with the Pearland Planning and Zoning Commission to keep the
property abutting John Lizer and Pearland Parkway (Resolution #1189) zoned as
Residential and not rezoning it as Commercial Business. I believe any business would be
intrusive on the surrounding neighborhoods, but, even more so, the proposed Event
Center and possible Convention Center would adversely affect all of the surrounding
neighborhoods. Businesses, especially an event center, would be very detrimental to this
highly -residential area causing the devaluation of our property, traffic problems (bussing
event participants from the high school or First Baptist Church has been mentioned), and
possibly bringing more crime and litter to our area as well as more noise.
The 2004 Comprehensive Plan for the City of Pearland addresses the need to keep a large
portion of the City of Pearland as residential. Before purchasing our homes, many of us
reviewed the City's Zoning maps and bought homes in our subdivisions knowing we
would be bordered by other homes and Independence Park - making the area by the high
school a very nice place to live. There are several ideal sights for a Convention Center in
Pearland that are not embedded in a residential area. Please preserve our neighborhoods
and the homes we have worked so hard to acquire. Please vote to keep the land located
off of Pearland Parkway and John Lizer residential.
