R2004-145 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, APPROVING WORK AUTHORIZATION #10 SUPPLEMENT #9 FOR CONSTRUCTION INSPECTION SERVICES ASSOCIATED WITH THE PEARLAND MOBILITY AND DRAINAGE BOND PROGRAM (YOST ROAD PROJECT). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain contract by and between the City of Pearland and Turner, Collie and Braden, Inc., ("T C & B) for Program Management of the Pearland Mobility and Drainage Bond Program was authorized by the City Council on December 10, 2001. Section 2. That T C & B has developed work authorization #10 Supplement #9, which is attached hereto as Exhibit "A". Section 3. That work authorization #10 Supplement #9 for construction inspection services associated with the Yost Road Project is hereby approved. COKER CITY ATTORNEY TOM REID MAYOR ATTACHMENT D WORK AUTHORIZATION NO. 10 SUPPLEMENT NO. 9 Exhibit "A" Resolution No. R2004-145 This Work Authorization is made pursuant to the terms and conditions of the Pearland Mobility & Drainage Bond Program, hereinafter identified as the "Contract," entered into by and between the City of Pearland ("City"), and Tumer Collie & Braden Inc. ("Engineer). PART 1. Work Authorization No. 10, Supplement No.9 is related to the improvement of Yost BoUlevard from Broadway (FM 518) to Clear Creek. The Engineer will perform Construction Observation services under this Authorization. PART 2. The maximum amount payable for services under this Work Authorization, Supplement No. 9 is $85,000.00. This amount is based on the rates in the attached fee proposal submitted by: ESPA Corp., dated August 5, 2004. PART 3. Payment to the Engineer for the services established under this Work Authorization shall be "Reimbursable-Not- To-Exceed". PART 4. This Work Authorization shall become effective on August 31, 2004 and shall terminate on November 12, 2005, unless extended by a supplemental work authorization. PART 5. This Work Authorization does not waive the parties' responsibilities and obligations provided under the contract. PART 6. This Work Authorization is hereby accepted and acknowledged below. Our proposed fee to inspect the above mentioned project is $141,538.00 which is approximately 3.6 percent of the construction cost and is detailed in the enclosed proposal. The City can realize significant savings by utilizing our services for more than one project. To maximize the efficiency of our knowledgeable and experienced personnel and to realize the benefits of economies of scale, we recommend issuing an additional project to be inspected concurrently with the proposed. MS/jda Attachments pc: Jerry Sowells CONSTRUCTION' OBSERVATION SCOPE OF SERVICES ESPA CORP will provide on-site construction observation for the City of Pearland Mobility and Drainage Bond Program - Yost Boulevard Improvement Project. The following are the duties and responsibilities. 1. Assign a project representative to the project: 2. Project Representatives shall visit individual proje~ sites multiple times per day and insure critical construction activities are observed. (All activities do not require full time observation.) Observe the contractor's activities to determine that construction is in conformance with the contract drawings and specifications. Observe materials and equipment being incorporated into construction to determine that they are handled, stored, and installed in compliance with the Contract Documents. Monitor and review the construction contractor's progress to determine if the work is in compliance with the terms and conditions of the Contract Documents and report the status of construction to TC&B and the City. Project representatives should complete daily inspection report at the end of each day, for each project. The report should include the following: Weather observation Description of work completed each day Itemized list pay items and quantities completed each day Inventory of equipment the Contractor had on site and used that day Inventory of personnel the Contractor had working on site Record of any communications that might affect the progress or quality of the project. 7. Coordinate activities of the construction materials testing laboratories to determine if the proper number and type of tests are accomplished in a timely manner. 8. Attend monthly construction progress meetings. · Report on construction progress · Identify any problems related to contractor's work in progress. 9.
