Ord. 509-725 07-26-04ORDINANCE NO. 509-725 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY LOCATION BEING 2.00 ACRES, BEING OUT OF LOTS 168 AND 169, ZYCHLINSKI SUBDIVISION, ABSTRACT 308, SECTION 27, H.T. & B.R.R. COMPANY SURVEY, AS RECORDED IN VOLUME 29, PAGE 9, OF THE DEED RECORDS OF BRAZORIA COUNTY, TEXAS (LOCATED AT 3418 WARREN ROAD) (APPLICATION NO. 1176) FROM CLASSIFICATION SUBURBAN DEVELOPMENT DISTRICT (SD) TO SINGLE FAMILY DWELLING DISTRICT (R-1) AT THE REQUEST OF DENNIS AND PHYLLIS OMO, OWNERS, PROVIDING FOR AN AMENDMENT OF THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT. WHEREAS, Dennis and Phyllis Omo, Owners, filed on May 17, 2004, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A"; and WHEREAS, on the 21st of June, 2004, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached thereto and made a part hereof for all purposes as Exhibit "B", said call and notice being in strict conformity with provisions of Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 1st day of July, 2004, the Planning and Zoning Commission of the City submitted its report and recommendation to the City Council regarding the 1 ORDINANCE NO. 509-725 proposed amendment application by Dennis and Phyllis Omo, Owners, whereby the Commission recommended to approve a change of classification for the property described in Exhibit "A" from its existing classification of Suburban Development District (SD) to Single Family Dwelling District (R-1); and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and concurred with the recommendation of the Planning and Zoning Commission at a regular meeting on July 12, 2004; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Dennis and Phyllis Omo, Owners, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Suburban Development District (SD) is hereby for all purposes changed and reclassified as Single Family Dwelling District (R-1), such property being more particularly described as: 2.00 acres, being out of Lots 168 and 169, Zychlinski Subdivision, Abstract 308, Section 27, H.T. & B.R.R. Company Survey, as recorded in Volume 29, Page 9, of the Deed Records of Brazoria County, Texas (located at 3418 Warren Road) 2 ORDINANCE NO. 509-725 II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. 3 ORDINANCE NO. 509-725 VI. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. 509 and consistent with the approval herein granted for the reclassification of the herein above described property. PUBLIC HEARING AGENDA ITEM MEETING OF JUNE 21, 2004 ZONE CHANGE APPLICATION NO. 1176 Existing Zoning: Suburban Development District (SD) Requested Zoning: Single Family Dwelling District (R-1) Location or Address of Property: 3418 Warren Road Property Owner: Dennis and Phyllis Omo Applicant: Dennis and Phyllis Omo SUMMARY: The applicant is requesting a change in zoning on the subject property for single family residential uses. The subject property was annexed into the City in 1997 and subsequently zoned SD. The subject property is currently developed with a single family residence that is considered a non -conforming use. The applicant has indicated that they plan to construct an addition to the single family residence on the subject property if the zone change is approved. Our records indicate that the applicant applied fora zone change for R-1 in February of 1999. A public hearing was held and the Planning and Zoning Commission recommended approval of the zone change, but the zone change application was never scheduled for City Council consideration. This was discovered when the applicant applied for a building permit for the proposed addition last month. Since all of this occurred over 5 years ago, Staff informed the applicant that we would schedule another public hearing and have the applicant go through the entire zone change process again. Zone Change Application No. 1176 Page 1 JOINT PUBLIC HEARING AGENDA ITEM MEETING OF JUNE 21, 2004 SURROUNDING ZONING AND LAND USES: Zoning Land Use North Suburban Development Single family residence District (SD) South Suburban Development Single family residence District (SD) East Suburban Development Single family residence District (SD) West Mobile Home Park District Single family residences and (MH) mobile home residences CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The applicant is requesting an R-1 zoning district. The minimum lot size for the R-1 district is 8,800 square feet and the minimum lot width is 80 feet. The subject property meets these requirements; the subject property is approximately 2 acres in size and approximately 175 feet in width. The applicant will be responsible for complying with all other space limitations of the R-1 zoning district. It appears that the subject property consists of two lots. Therefore, prior to issuance of a building permit, the applicant would be required to submit a completed Declaration of Intent, which establishes the subject property as one building site rather than two separate lots. CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan recommends Low Density Residential Uses for the subject property and all of the surrounding properties on Warren Road. The Comprehensive Plan further indicates that the appropriate zoning districts for Low Density Residential Uses are the Estate Lot Single Family Dwelling District (R-E) and the Single Family Dwelling Districts R-1 and R-2. Therefore, the proposed zone change conforms to the Comprehensive Plan. CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage on Warren Road, a local/residential street. No other roadways affect the subject property. Therefore, the use is consistent with existing development within the area. PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners within 200 feet of the subject property under consideration. A legal notice of public hearing was published in the local newspaper, and a Zoning Sign was placed on the subject property. STAFF RECOMMENDATION: Staff recommends approval of the zone change for R-1, as proposed by the applicant, for the following reasons: 1. The proposed zone change provides for Low Density Residential Uses as recommended by the Comprehensive Plan. 2. The proposed zone change is consistent with existing residential uses and R-1 zoning districts along Warren Road.
