AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN
DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR
THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL
PROPERTY LOCATION BEING THE NORTH 9.9226 ACRES OF LOT 30
(CALLED NORTH ONE-HALF OF LOT 30) OF THE ALLISON RICHEY GULF
COAST HOME COMPANY SUBDIVISION OF SECTION 21 OF THE H.T. &
B.R.R. COMPANY SURVEY, ABSTRACT 309, BRAZORIA COUNTY, TEXAS,
ACCORDING TO THE PLAT THEREOF RECORDED IN VOLUME 2, PAGE 23
OF THE PLAT RECORDS OF BRAZORIA COUNTY, TEXAS (LOCATED ON
THE WEST SIDE OF COUNTY ROAD 89 (OLD CHOCOLATE BAYOU ROAD),
AND NORTH OF FITE ROAD) (APPLICATION NO. 1179) FROM
CLASSIFICATION SUBURBAN DEVELOPMENT DISTRICT (SD) TO GENERAL
BUSINESS DISTRICT (GB) AT THE REQUEST OF MICHAEL POLLOK,
APPLICANT FOR E.R. MILSTEAD, OWNER, PROVIDING FOR AN
AMENDMENT OF THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS
CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER
PROVISIONS RELATED TO THE SUBJECT.
WHEREAS, Michael Pollok, Applicant for E.R. Milstead, Owner, filed on June 18,
2004, an application for amendment pursuant to Section 28 of Ordinance No. 509, the
Land Use and Urban Development Ordinance of the City, for approval of a change in
the land use as provided for in said Section 28, said property being legally described in
the original applications for amendment attached hereto and made a part hereof for all
purposes as Exhibit "A"; and
WHEREAS, on the 19th of July, 2004, a Joint Public Hearing was held before the
Planning and Zoning Commission and the City Council of the City of Pearland, Texas,
notice being given by publication in the official newspaper of the City, the affidavit of
publication being attached thereto and made a part hereof for all purposes as Exhibit
"B", said call and notice being in strict conformity with provisions of Section 28.3 and
28.4 of Ordinance No. 509; and

WHEREAS, on the 26th day of July, 2004, the Planning and Zoning Commission
of the City submitted its report and recommendation to the City Council regarding the
proposed amendment application by Michael Pollok, applicant for E.R. Milstead, owner,
whereby the Commission recommended to approve a change of classification for the
property described in Exhibit "A" from its existing classification of Suburban
Development District (SD) to General Business District (GB); and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and concurred with the
recommendation of the Planning and Zoning Commission at a regular meeting on
August 9, 2004; and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises, finds that in the case
of the application of Michael Pollok, applicant for E. R. Milstead, owner, presented
which, in the judgment of the City Council, would justify the approval of said application;
now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I.
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Suburban Development District
(SD) is hereby for all purposes changed and reclassified as General Business District
(GB), such property being more particularly described as:

The North 9.9226 acres of Lot 30 (Called North One -Half of Lot 30) of the
Allison Richey Gulf Coast Home Company Subdivision of Section 21 of the
H.T. & B.R.R. Company Survey, Abstract 309, Brazoria County, Texas,
according to the plat thereof recorded in Volume 2, Page 23 of the Plat
Records of Brazoria County, Texas (Located on the West Side of County
Road 89 (Old Chocolate Bayou Road), and North of Fite Road)
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.

V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of the
City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

SUMMARY: The applicant is requesting a change in zoning on the subject property for
general business district uses. The subject property was annexed into the City in 1997
and subsequently zoned SD. It appears that the subject property is currently developed
with a single family residence that is considered a non -conforming use. The applicant has
indicated that they plan to general business district uses on the subject property if the zone
change is approved.

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
applicant is requesting a GB zoning district. The minimum lot size for the GB district is
22,500 square feet and the minimum lot width is 150 feet. The subject property meets
these requirements; the subject property is larger than 9 acres in size and approximately
500 feet in width.
The applicant will be responsible for complying with all other space limitations of the GB
zoning district.
CONFORMANCE TO THE COMPREHENSIVE PLAN:. The future extension of Cullen
Boulevard is proposed to cut through the subject. property. The Comprehensive Plan
recommends that the properties along the. east side of future Cullen Boulevard be
developed with Retail, Office, and Service uses. The Comprehensive Plan further
indicates that the appropriate zoning districts for Retail, Office, and Service uses are the
Office and Professional District (OP), the Neighborhood Service District (NS), and the
General Business District (GB). The Comprehensive Plan also indicates that properties
along the west side of Cullen Boulevard be developed with Low Density Residential Uses,
and that the appropriate zoning districts for Low Density Residential Uses are the Estate
Lot Single Family Dwelling District (R-E) and the Single Family Dwelling Districts R-1 and
R-2.
However, the 2004.Update to the Comprehensive Plan recommends that the properties
along both sides of Cullen Boulevlard/County Road 89 be developed with Retail, Office,
and Service uses. Therefore, although the proposed zone change does not comply with
the current Comprehensive Plan, it does conformto the proposed 2004 Update to the
Comprehensive Plan.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property currently has
frontage on County Road 89 (Old Chocolate Bayou Road). However, the Cullen Boulevard
extension will cut through the eastern side of the subject property. The Cullen Boulevard

extension is designated as a secondary thoroughfare with 100 feet of right-of-way. At the
time that the subject property is platted, right-of-way dedication for Cullen Boulevard will
be required.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The proposed zone change will
provide for general business uses, a continuation of existing general business uses along
Broadway Street, Cullen Boulevard, and Old Chocolate Bayou Road.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of the zone change for GB, as
proposed by the applicant, for the following reasons:
1. Although contrary to the current Comprehensive Plan, the proposed zone change
would conform to the 2004 Update to the Comprehensive Plan, which recommends
Retail, Office, and Service uses for the subject property.
2. The proposed zone change is consistent with existing general business,
commercial, and neighborhood service uses along Broadway Street, Cullen
Boulevard, Old Chocolate Bayou Road, and Fite Road.
3. The proposed zone change is appropriate for this location on Old Chocolate Bayou
Road, which is designated as a secondary thoroughfare.
