Ord. 509-729 08-09-04 FailedFAILED 8/9/04 Ordinance No. 509-729 ORDINANCE NO. 509-729 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY LOCATION BEING LOTS 12, 13, 14, AND 15, IN BLOCK 2, OF COLONIAL ESTATES SUBDIVISION, AN ADDITION IN BRAZORIA COUNTY, TEXAS, ACCORDING TO THE MAP OR PLAT THEREOF RECORDED IN VOLUME 9, PAGE 123, OF THE PLAT RECORDS OF BRAZORIA COUNTY, TEXAS (LOCATED AT 3610 MCLEAN ROAD) (SPECIFIC USE PERMIT APPLICATION NO. 132) FROM CLASSIFICATION SINGLE FAMILY DWELLING DISTRICT (R-1) TO SINGLE FAMILY DWELLING DISTRICT — SPECIFIC USE (R-1(S)), FOR A DAY CARE, AT THE REQUEST OF LISA DIESE, APPLICANT FOR PRAVIN B. WHEREAS, Lisa Diese, Applicant for Pravin B. Patel and Jagdish Patel, Owners, filed on February 26, 2004, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A"; and WHEREAS, on the 19th day of July, 2004, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached thereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 26th day of July, 2004, the Planning and Zoning Commission of the City submitted its report and recommendation to the City Council regarding the proposed amendment application by Lisa Diese, applicant for Pravin B. Patel and 1 ORDINANCE NO. 509-729 Jagdish Patel, whereby the Commission recommendation to deny for the change of classification for the property described in Exhibit "A" from its existing classification of Single Family Dwelling District (R-1) to Single Family Dwelling District — Specific Use (R-1(S)); and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and the recommendation of the Planning and Zoning Commission at a regular meeting on August 9, 2004; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of Lisa Diese, applicant for Pravin B. Patel and Jagdish Patel, Owners, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Single Family Dwelling District (R- 1) is hereby for all purposes changed and reclassified as Single Family Dwelling District — Specific Use (R-1(S)) for a day care, such property being more particularly described as: Lots 12, 13, 14, and 15, in Block 2, of Colonial Estates Subdivision, an addition in Brazoria County, Texas, according to the map or plat thereof recorded in Volume 9, Page 123, of the Plat Records of Brazoria County, Texas (Located at 3610 McLean Road) II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been 2 ORDINANCE NO. 509-729 accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. VI. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of Ordinance No. 509 and consistent with the approval herein granted for the reclassification of the herein above described property. Patel and Jagdish Patel Applicant: Lisa Diese SUMMARY: The applicant is requesting the approval of a specific use permit to operate a day care facility in the Single Family Dwelling District (R-1). The Land Use and Urban Development Ordinance requires a specific use permit for a day care in any single family dwelling district. It appears that the subject property is currently developed with a single family residence. The applicant is proposing to retain the single family residence, and construct an approximately 5,000 square foot day care facility. In April 2002, the applicant applied for a zone change for the subject property for Neighborhood Service District, which was denied by the City Council. The zone change for NS was proposed because the applicant at that time wanted to construct a day care and a service station on the subject property. Several surrounding property owners spoke in opposition to the zone change for NS due to the impact that a non-residential zoning district would have on the subject property and surrounding properties. Specific Use Permit Application No. 132 Page 1 JOINT PUBLIC HEARING AGENDA ITEM MEETING OF JULY 19, 2004 SURROUNDING ZONING AND LAND USES: North South East West Zoning Suburban Development District (SD) Suburban Development District (SD) Single Family Dwelling District (R-2) Suburban Development District (SD) Land Use Undeveloped tract Single family residence Single family residential lots in Cabot Cove subdivision Single family residences CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan recommends Low Density Residential Uses for the subject property, as well for all of the properties on all sides of the subject property. The Comprehensive Plan further indicates that the appropriate zoning districts for low density residential uses are the Estate Lot Single Family Dwelling District (R-E) and the Single Family Dwelling Districts R-1 and R-2. A day care is permitted in the R-1 district by the approval of a specific use permit. CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage on McLean Road, a major collector street with 80 feet of right-of-way that is to be widened in the future as necessary. No other roadways affect the subject property. IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The subject property is currently zoned for single family residential uses but is not developed at this time. Staff is ofthe opinion that a day care is not appropriate at this location, due to the subject property being surrounded by single family residential uses on all sides. Further to the south is a large area of land, currently undeveloped and zoned for General Business District, in which a day care facility would be a permitted use. Even though the applicant is not asking for a zone change, the proposed day care is a non-residential use that has the potential to cause negative impacts to the surrounding residential properties, including an increase in traffic on the subject property and on McLean Road. PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners within 200 feet of the subject property under consideration. A legal notice of public hearing was published in the local newspaper, and a Zoning Sign was placed on the subject property. STAFF RECOMMENDATION: Staff recommends denial of the specific use permit for a day care, as proposed by the applicant, for the following reasons: . The proposed day care is a non-residential use that has the potential to cause negative impacts to surrounding residential properties. 2. There are several areas to the south that are currently undeveloped and zoned General Business District, all of which could be developed with the proposed use.
