AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN
DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR
THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL
PROPERTY LOCATION BEING 7.00 ACRES OF LAND SITUATED IN LOT 4
OF THE ALLISON RICHEY GULF COAST HOME COMPANY SUBDIVISION OF
SECTION 85, H.T. & B.R.R. COMPANY SURVEY, ABSTRACT 304, BRAZORIA
COUNTY, TEXAS, ACCORDING TO THE PLAT RECORDED IN VOLUME 2,
PAGE 107 OF THE PLAT RECORDS OF BRAZORIA COUNTY, TEXAS
(LOCATED ON THE EAST SIDE OF SMITH RANCH ROAD, AND SOUTH OF

FROM CLASSIFICATION SUBURBAN DEVELOPMENT DISTRICT (SD) TO
SINGLE FAMILY DWELLING DISTRICT (R-1) AT THE REQUEST OF MARION
FISHER AND EUGENE L. FISHER, OWNERS, PROVIDING FOR AN
AMENDMENT OF THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS
CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER
PROVISIONS RELATED TO THE SUBJECT.
WHEREAS, Marion Fisher and Eugene L. Fisher, Owners, filed on June 24,
2004, an application for amendment pursuant to Section 28 of Ordinance No. 509, the
Land Use and Urban Development Ordinance of the City, for approval of a change in
the land use as provided for in said Section 28, said property being legally described in
the original applications for amendment attached hereto and made a part hereof for all
purposes as Exhibit "A"; and
WHEREAS, on the 19th day of July, 2004, a Joint Public Hearing was held before
the Planning and Zoning Commission and the City Council of the City of Pearland,
Texas, notice being given by publication in the official newspaper of the City, the
affidavit of publication being attached thereto and made a part hereof for all purposes,
as Exhibit "B", said call and notice being in strict conformity with provisions of Section
28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 26th day of July, 2004, the Planning and Zoning Commission
of the City submitted its report and recommendation to the City Council regarding the
proposed amendment application by Marion Fisher and Eugene L. Fisher, Owners,

whereby the Commission recommendation to deny for the change of classification for
the property described in Exhibit "A" from its existing classification of Suburban
Development District (SD) to Single Family Dwelling District (R-1); and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on August 9, 2004; and
WHEREAS, the City Council having fully heard the testimony and argument of all
interested parties, and having been fully advised in the premises, finds that in the case
of the application of Marion Fisher and Eugene L. Fisher, Owners, presented which, in
the judgment of the City Council, would justify the approval of said application; now,
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I .
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Suburban Development District
(SD) is hereby for all purposes changed and reclassified as Single Family Dwelling
District (R-1), such property being more particularly described as:
7.00 acres of land situated in Lot 4 of the Allison Richey Gulf Coast Home
Company Subdivision of Section 85, H.T. & B.R.R. Company Survey, Abstract
304, Brazoria County, Texas, according to the plat recorded in Volume 2, Page
107 of the Plat Records of Brazoria County, Texas (Located on the East Side of
Smith Ranch Road, and South of County Road 403 (Hughes Ranch Road))
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The

City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

SUMMARY: The applicant is requesting a change in zoning on the subject property for
single family residential uses. The subject property was annexed into the City in 1998 and
subsequently zoned SD. The subject property is approximately 7 acres in size and
consists of several Tots, all currently owned by the same family. A single family residence
currently exists on one of the lots. The existing single family residence is a non-
conforming use. The applicant has indicated that they plan to construct additional homes
on the subject property if the zone change is approved.

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
applicant is requesting an R-1 zoning district. The minimum lot size for the R-1 district is
8,800 square feet and the minimum lot width is 80 feet. The subject property appears to
consist of several Tots. Each lot, as well as each proposed lot (when the subject property
is replatted), will be required to meet the R-1 district space requirements. All platted lots
are required to have frontage on a public right-of-way.
The applicant will be responsible for complying with all other space limitations of the R-1
zoning district for each lot.
CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan
recommends Business Park uses for the subject property and many of the surrounding
properties on Smith Ranch Road and State Highway 288. The Comprehensive Plan
describes the Business Park as.the corridors along State Highway 288 and Beltway 8, and
that the area should consist of mixed use areas developments in coordinated and master
planned campus type settings with interdependent and complimentary uses. Preferred
uses include office buildings, regional shopping centers, research and development,
facilities, light manufacturing facilities, and high density residential along the outer edge of
the corridor. The Business Park designation also calls for special design standards, and
states that the appropriate zoning districts for Business Park uses are the Planned Unit
Development District (PUD) or a corridor overlay zoning district. Therefore, the proposed
zone change for single family residential. uses does not conform to the Comprehensive
Plan.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on Smith Ranch Road, a secondary thoroughfare that is to be widened in the future as
necessary. No other roadways affect the subject property.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: Staff is of the opinion that the
subject property is not suitable for a change in zoning for residential uses. The Future

Land Use Plan component of the Comprehensive Plan designates the properties along
State Highway 288 corridor as .Business Park uses for the coordinated development of
offices, industrial facilities, and commercial developments. Smith Ranch Road is
designated as a secondary thoroughfare in order to accommodate traffic from these types
of business park uses.
Residential developments along Smith Ranch Road are sparse. There are several non-
residential developments along Smith Ranch Road, including a convenience store with
gasoline sales and a manufactured home facility at the intersection of Smith Ranch Road
and Hughes Ranch Road to the north. There is an existing Tight industrial facility to the
north of the subject property. At Broadway Street, there are several commercial type uses
already developed. Many of the vacant tracts along the west side of Smith Ranch Road
are planned for retail, commercial, and restaurant developments.
Although the area currently may seem appropriate for residential uses, the subject area
will continue to grow and develop. However, in the future, the area would not be well
suited for a mixed use corridor of single family residential and business park uses due to
its proximity to State Highway 288, the emerging medical corridor along the west side of
State Highway 288, and other non-residential uses planned for Smith Ranch Road.
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends denial of the zone change for R-1, as
proposed by the applicant, for the following reasons:
1. The proposed zone change is not in conformance with the. Comprehensive .Plan
designation of Business Park for the subject area.
2. The proposed zone change is located along a secondary thoroughfare that was
designated to carry traffic associated with Business Park uses. .
3. The subject area is not appropriate for a mixed use corridor of single family
residential uses and business park uses.
