1997-12-15 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON DECEMBER 15, 1997, AT 6:00 P. M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. The meeting was called to order with the following present: Mayor Mayor Pro -Tem Councilmember Councilmember Councilmember Councilmember City Attorney City Secretary CALL TO ORDER OTHER BUSINESS: Tom Reid Helen Beckman Kevin Cole William Berger Richard Tetens Larry Wilkins Amy McCullough Young Lorfing Council adjourned into Executive Session under Texas Government Code at 6:02 p.m. to discuss the following: EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE 1. SECTION 551.074 - PERSONNEL MATTERS: DISCUSSION CONCERNING THE REPORTING FUNCTIONS OF THE CITY ATTORNEY AND THE HOUSING OF THE CITY ATTORNEY. NEW BUSINESS: Council returned from Executive Session at 7:18 p.m. COUNCIL ACTION - INSTRUCTION TO THE CITY ATTORNEY REGARDING THE REPORTING FUNCTIONS OF THE CITY ATTORNEY AND THE HOUSING OF THE CITY ATTORNEY. Councilmember Berger made the motion, seconded by Councilmember Wilkins for the City Attorney and Assistant City Attorney's formal reporting structure and their supervision to be directly to the City Council and for them to work closely with the City Manager. There was discussion among the Councilmembers regarding the reporting duties and supervision of the City Attorney and the Assistant City Attorney. Page 1 of 3 - 12/15 City Manager Paul Grohman addressed Council regarding the City Charter and the duties of City Council insofar as the administration of the City Attorney's Office. Discussion with Council ensued. After the lengthy discussion concluded, Mayor Reid called for the vote. Voting "Aye" Councilmembers Wilkins, Beckman, Tetens, and Berger. Voting "No" Councilmember Cole. Motion passed 4 to 1. Mayor Reid stated that we have one more item under new business that pertains to the housing of the City Attorney which could be left to a future agenda or to the Council Retreat. City Manager Paul Grohman asked if the City Attorney's housing could be addressed because we are having real space problems. City Attorney Amy McCullough addressed Council regarding her reasons why the legal department could be more efficient in another location. City Manager Paul Grohman addressed Council giving his reasons why the legal department should remain in their current location. There was discussion among Council, City Manager, and the City Attorney regarding office space in city hall and the relocation of the legal department. Mayor Pro -Tem Beckman made the motion, seconded by Councilmember Cole to allow the City Manager to rearrange the offices in the best and most efficient manner as he sees fit. There was discussion between the City Manager and Council regarding the possible installation of an outside door to the City Attorney's Office. After the lengthy discussion concluded Mayor Reid called for the vote. Voting "Aye" Councilmembers Cole, Berger, Beckman, Tetens, and Wilkins. Voting "No" None. Motion passed 5 to 0. OTHER BUSINESS (CONTINUED): Page 2 of 3 - 12/15 q L Council adjourned into Executive Session under Texas Government Code at 8:35 p.m to discuss the following: EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE 2. SECTION 551.074 - PERSONNEL MATTERS: DISCUSSION CONCERN- ING THE EVALUATION OF THE PERFORMANCE OF THE CITY ATTORNEY. NEW BUSINESS (CONTINUED): Council returned from Executive Session at 8:58 p.m. COUNCIL ACTION - ADDRESS THE EVALUATION OF THE CITY ATTORNEY'S PERFORMANCE. Councilmember Berger made the motion, seconded by Councilmember Wilkins, that Councilmember Berger would research what other city's do as far as an evaluation tool for the City Attorney and will have it ready for the next regular scheduled performance review which will be at the same time as the performance review of the City Manager. Voting "Aye" Councilmembers Wilkins, Tetens, Beckman, Berger, and Cole. Voting "No" None. Motion passed 5 to 0. ADJOURNMENT: The special meeting adjourned at 9:00 p.m..
