A Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into a contract with MWH
Americas, Inc.', in the amount of $683,713.60, for professional services
associated with the performance of Preliminary Engineering Services for
the Expansion of the Barry Rose Wastewater Treatment Plant.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and MWH
Americas, Inc.', a copy of which is attached hereto as Exhibit "A" and made a part hereof for all
purposes, is hereby authorized and approved.
Section 2. That the City Manager or his designee is hereby authorized to execute
and the City Secretary to attest a contract with MWH Americas, Inc.', for professional services
associated with the performance of Preliminary Engineering Services for the Expansion of the
Barry Rose Wastewater Treatment Plant.

Exhibit "A"
CONTRACT FOR PROFESSIONAL SERVICES
THIS CONTRACT is entered into upon final execution by and between the City of Pearland
("CITY") and MWH Americas, Inc'. ("CONSULTANT").
The CITY engages the CONSULTANT to perform professional services for a project known and
described as Barry Rose Wastewater Treatment Plant Expansion ("PROJECT"). (Project #
WW1 502)
SECTION I - SERVICES OF THE CONSULTANT
The CONSULTANT shall perform the following professional services to CITY standards and in
accordance with the degree of care and skill that a professional in Texas would exercise under
the same or similar circumstances:
A. The CONSULTANT shall perform Preliminary Engineering Services. See
Exhibit A, attached, for a detailed SCOPE OF WORK and PROJECT schedule.
The PROJECT schedule shall be submitted in digital and hard copy form in the
Microsoft Project for Windows format.
B. The CONSULTANT shall prepare and submit a detailed opinion of estimated cost
of the PROJECT.
C. The CONSULTANT acknowledges that the CITY (through its employee
handbook) considers the following to be misconduct that is grounds for
termination of a CITY employee: Any fraud, forgery, misappropriation of funds,
receiving payment for services not performed or for hours not worked,
mishandling or untruthful reporting of money transactions, destruction of assets,
embezzlement, accepting materials of value from vendors, or consultants, and/or
collecting reimbursement of expenses made for the benefit of the CITY. The
CONSULTANT agrees that it will not, directly or indirectly; encourage a CITY
employee to engage in such misconduct.
D. The CONSULTANT shall submit all final construction documents in both hard
copy and electronic format. Plans shall be AutoCAD compatible and all other
documents shall be Microsoft Office compatible. The software version used shall
be compatible to current CITY standards. Other support documents, for example,
structural calculations, drainage reports and geotechnical reports, shall be
submitted in hard copy only. All Record Drawings electronic files shall be
submitted to the CITY in TIF format.
E. The CONSULTANT recognizes that all drawings, special provisions, field survey
notes, reports, estimates and any and all other documents or work product
generated by the CONSULTANT under the CONTRACT shall be delivered to the
CITY upon request, shall become subject to the Open Records Laws of this State.

F. The CONSULTANT shall procure and maintain for the duration of this
Agreement, insurance against claims for injuries to persons, damages to property,
or any errors and omissions relating to the performance of any work by the
CONSULTANT, its agents, employees or subcontractors under this Agreement,
as follows:
(1) Workers' Compensation as required by law.
(2) Professional Liability Insurance in an amount not less than $1,000,000 in
the aggregate.
(3)
Comprehensive General Liability and Property Damage Insurance with
minimum limits of $1,000,000 for injury or death of any one person,
$1,000,000 for each occurrence, and $1,000,000 for each occurrence of
damage to or destruction of property.
(4) Comprehensive Automobile and Truck Liability Insurance covering
owned, hired, and non -owned vehicles, with minimum limits of
$1,000,000 for injury or death of any one person, $1,000,000 for each
occurrence, and $1,000,000 for property damage.
The CONSULTANT shall include the CITY as an additional insured under the
policies, with the exception of the Professional Liability Insurance and Workers'
Compensation. Certificates of Insurance and endorsements shall be furnished to
the CITY before work commences. Each insurance policy shall be endorsed to
state that coverage shall not be suspended, voided, canceled, and/or reduced in
coverage or in limits ("Change in Coverage") except with prior written consent of
the CITY and only after the CITY has been provided with written notice of such
Change in Coverage, such notice to be sent to the CITY either by hand delivery to
the City Manager or by certified mail, return receipt requested, and received by
the City no fewer than thirty (30) days prior to the effective date of such Change
in Coverage. Prior to commencing services under this CONTRACT,
CONSULTANT shall furnish CITY with Certificates of Insurance, or formal
endorsements as required by this CONTRACT, issued by CONSULTANT'S
insurer(s), as evidence that policies providing the required coverage, conditions,
and limits required by this CONTRACT are in full force and effect.
G. The CONSULTANT shall indemnify and hold the CITY, its officers, agents, and
employees, harmless from any claim, loss, damage, suit, and liability of every
kind for which CONSULTANT is legally liable, including all expenses of
litigation, court costs, and attorney's fees, for injury to or death of any person, for
damage to any property, or errors in design, any of which are caused by the
negligent act or omission of the CONSULTANT, his officers, employees, agents,
or subcontractors under this CONTRACT.

H. All parties intend that the CONSULTANT, in performing services pursuant to this
CONTRACT, shall act as an independent contractor and shall have control of its
own work and the manner in which it is performed. The CONSULTANT is not to
be considered an agent or employee of the CITY.
SECTION II - PERIOD OF SERVICE
This CONTRACT will be binding upon execution and end December 2017.
SECTION III - CONSULTANT'S COMPENSATION
A. The total compensation for the services performed shall not exceed the total noted
in Section B.
B. The CITY shall pay the CONSULTANT in installments based upon monthly
progress reports and detailed invoices submitted by the CONSULTANT based
upon the following:
1. Basic Services Tasks 1-7 (Lump Sum) $588,900.00
2. Additional Services, Surveying Lump Sum $41,377.60
3. Additional Services, Time & Material Allowance $29,880.00
4. Reimbursables Not to Exceed $23,556.00
5. Total: $683,713.60
C. The CITY shall make payments to the CONSULTANT within thirty (30) days
after receipt and approval of a detailed invoice. Invoices shall be submitted on a
monthly basis.
SECTION IV - THE CITY'S RESPONSIBILITIES
A. The CITY shall designate a project manager during the term of this CONTRACT.
The project manager has the authority to administer this CONTRACT and shall
monitor compliance with all terms and conditions stated herein. All requests for
information from or a decision by the CITY on any aspect of the work shall be
directed to the project manager.
B. The CITY shall review submittals by the CONSULTANT and provide prompt
response to questions and rendering of decisions pertaining thereto, to minimize
delay in the progress of the CONSULTANT'S work. The CITY will keep the
CONSULTANT advised concerning the progress of the CITY'S review of the

work. The CONSULTANT agrees that the CITY'S inspection, review,
acceptance or approval of CONSULTANT'S work shall not relieve
CONSULTANT'S responsibility for errors or omissions of the CONSULTANT or
its sub-consultant(s) or in any way affect the CONSULTANT'S status as an
independent contractor of the CITY.
SECTION V - TERMINATION
A. The CITY, at its sole discretion, may terminate this CONTRACT for any reason -
- with or without cause -- by delivering written notice to CONSULTANT
personally or by certified mail at 13100 Northwest Freeway, Suite 340 Houston,
TX 77040. Immediately after receiving such written notice, the CONSULTANT
shall discontinue providing the services under this CONTRACT.
B. If this CONTRACT is terminated, CONSULTANT shall deliver to the CITY all
drawings, special provisions, field survey notes, reports, estimates and any and all
other documents or work product generated by the CONSULTANT under the
CONTRACT, entirely or partially completed, together with all unused materials
supplied by the CITY on or before the 15`h day following termination of the
CONTRACT.
C. In the event of such termination, the CONSULTANT shall be paid for services
performed prior to receipt of the written notice of termination. The CITY shall
make final payment within sixty (60) days after the CONSULTANT has delivered
to the CITY a detailed invoice for services rendered and the documents or work
product generated by the CONSULTANT under the CONTRACT.
D. If the remuneration scheduled under this contract is based upon a fixed fee or
definitely ascertainable sum, the portion of such sum payable shall be
proportionate to the percentage of services completed by the CONSULTANT
based upon the scope of work.
E. In the event this CONTRACT is terminated, the CITY shall have the option of
completing the work, or entering into a CONTRACT with another party for the
completion of the work.
F. If the CITY terminates this CONTRACT for cause and/or if the CONSULTANT
breaches any provision of this CONTRACT, then the CITY shall have all rights
and remedies in law and/or equity against CONSULTANT. Venue for any action
or dispute arising out of or relating to this CONTRACT shall be in Brazoria
County, Texas. The laws of the State of Texas shall govern the terms of this
CONTRACT. The prevailing party in the action shall be entitled to recover its
actual damages with interest, attorney's fees, costs and expenses incurred in
connection with the dispute and/or action. CONSULTANT and CITY desire an
expeditious means to resolve any disputes that may arise between under this
CONTRACT. To accomplish this, the parties agree to mediation as follows: If a
dispute arises out of or relates to this CONTRACT, or the breach thereof, and if

the dispute cannot be settled through negotiation, then the parties agree first to try
in good faith, and before pursuing any legal remedies, to settle the dispute by
mediation of a third party who will be selected by agreement of the parties.
SECTION VI — ENTIRE AGREEMENT
This CONTRACT represents the entire agreement between the CITY and the CONSULTANT
and supersedes all prior negotiations, representations, or contracts, either written or oral. This
CONTRACT may be amended only by written instrument signed by both parties.
SECTION VII — COVENANT AGAINST CONTINGENT FEES
The CONSULTANT affirms that he has not employed or retained any company or person, other
than a bona fide employee working for the CONSULTANT to solicit or secure this
CONTRACT, and that he has not paid or agreed to pay any company or person, other than a
bona fide employee, any fee, commission, percentage brokerage fee, gift, or any other
consideration, contingent upon or resulting from the award or making of the CONTRACT. For
breach or violation of this clause, the CITY may terminate this CONTRACT without liability,
and in its discretion, may deduct from the CONTRACT price or consideration, or otherwise
recover, the full amount of such fee, commission, percentage brokerage fee, gift, or contingent
fee that has been paid.
SECTION VIII- SUCCESSORS AND ASSIGNS
This CONTRACT shall not be assignable except upon the written consent of the parties hereto.

Scope of Work
PROJECT SUMMARY
The City of Pearland (CITY or CLIENT) has requested preliminary engineering services from
MWH (CONSULTANT) for improvements to the Barry Rose Water Reclamation Facility
(BRWRF). The preliminary engineering services (the "PROJECT") will include: analysis of the
existing BRWRF service area; analysis of portions of the Longwood WRF service area that may
be transferred to BRWRF; determination of the ultimate BRWRF plant inflows; analysis of the
existing treatment plant process, equipment conditions and life expectancies; and
recommendations for improvements and/or replacement of existing equipment and to expand the
treatment capacity of BRWRF in accordance with current design standards, regulatory
requirements, and end of service life improvements.
Additionally, CITY plans include the option to move an existing 1 million gallon per day (MGD)
package treatment plant, currently located at the Reflection Bay WRF, to the BRWRF as a means
of augmenting capacity at the facility. The package plant is composed of a flow splitter box, 16
aeration basins, four clarifiers, RAS/WAS basin & pumps, filter modules, and other ancillary
equipment.
PURPOSE AND ORGANIZATION OF THIS DOCUMENT
This project will be executed in two phases. Phase 1, Preliminary Engineering Services and
Additional Service, is included herein. Phase 2 will include services for Final Design, Bid/Award,
and Construction Phase Support Services. Upon the completion of Phase 1, a scope, schedule, and
fee estimate for Phase 2 services will be provided for negotiation and future approval by the
CITY. The Phase 1 tasks are summarized below in Table 1.

The scope of work (SOW) is organized by a work breakdown structure (WBS) that applies
numeric codes to represent hierarchical relationships of work and work products. The services are
categorized by project phase and service (or function) to allow for consistent references and to
provide continuity as the PROJECT progresses through the two development phases. Tasks are
defined within each phase and service and each may have multiple subtasks, project element,
activities, disciplines, or other work actions.
A five digit numerical code is used to indicate the hierarchy of work actions throughout this scope
of work. The codes will be applied in the WBS, schedule, budget and cost tracking, and document
management systems. A general summary of the project organization hierarchy is provided in
Table 2.

DOCUMENT VERSION CONTROL AND REVISIONS
This SOW document will be maintained throughout the duration of the contract, and will be
modified to reflect changes authorized through contract amendments. Each modification will
apply a track -changes mode to identify deletions (strikethrough) or additions (underline) in

PROJECT ASSUMPTIONS
The following are project assumptions:
• Existing model for the new Barry Rose service area is dry and wet weather calibrated to
old data based on the old configuration, and will require calibration to current flows and
conditions.
• Geographical Information System (GIS) data including topographic data for both the
BRWRF and Longwood service areas is assumed available and sufficiently populated to
construct the extended InfoWorks model. Field data retrieval is assumed not to be
required.
• Assumptions are that the data is available and in sufficient detail to update the InfoWorks
model. A review of the data will be undertaken, the result of which will be reported to the
CITY.
• CLIENT shall assign a single point of contact to serve as the Project Manager.
• Unless stated otherwise below, a standard review period of 10 business days by the
CLIENT is assumed for each submittal. CLIENT shall meet with CONSULTANT within
10 business days after issuing each design deliverable to discuss comments. Delays by
the CLIENT in its review may result in a day -for -day extension of the CONSULTANT
schedule.
• Coordination and collation of comments will be managed through the CLIENT'S project
management software, referred to as ProTrak. Differences among CLIENT comments
and CONSULTANT understanding will be resolved at the review meetings. Concepts
reviewed and determinations made at these meetings will not be subject to further review
or change without contract amendment.
• No Geotechnical Investigations nor trial excavations will be completed as part of Phase 1.
CONSULTANT will provide a Geotechnical Plan that will be executed as part of Phase 2
of PROJECT.
• CITY will provide all existing survey, geotechnical, and other reports, data, and studies
to CONSULTANT. CONSULTANT is not responsible for subsurface conditions or the
accuracy or completeness of reports, data, or studies completed by others.
CONSULTANT has the right to rely upon previously completed documents as a basis for
performance of work. Information provided by CITY that is used by CONSULTANT and
then later deemed incorrect will require in additional contract funding to fix.
• CONSULTANT will develop two (2) alternative plant component layouts.
• Tasks 1 through 7 will be completed on a lump sum basis, and invoiced based on the
percent complete of each task. "Task 8 Additional Services" will be completed on a Time
and Materials basis to the extend funding is available. Task 8 activities will likely
transition into Phase 2 of the project, and the funding provided in the Phase 1 fee
schedule under OWNER'S ALLOWANCE for Task 8 scope item is not anticipated to be
enough to complete the entire scope of work for those items, but rather to begin the work
during Phase 1. Additional funding for Task 8 efforts may be required during Phase 2 to
complete those services.
• The condition assessment activity is assumed to not require confined space entry.

This task includes project management, control systems and tools, and coordination activities
required to execute services to be provided. Activities include project setup and planning,
establishment and maintenance of project controls tools, development of the project schedule,
coordination of internal and CLIENT meetings, sub -consultant management, review of project
schedule and budget, invoicing, and CLIENT communications. Project management activities
also will involve coordination of the production of deliverable work items.
11100 Project Management
This task includes activities to establish project management processes, protocols, and systems;
coordinate with the CLIENT; coordinate the activities of the CONSULTANT team, and
administer project management functions.
11110 Project Execution Plan
CONSULTANT will develop a Project Execution Plan (PXP) that will guide the project work.
The PXP will include a detailed work breakdown structure (WBS) that used as the basis for the
development of the project schedule and identification of the critical path. Communications
protocols will be developed as part of the PXP and will identify key communication pathways
and serve to facilitate effective communications amongst key team members and stakeholders.
The PXP will establish project management policies and procedures to guide the project team
through successful execution of project activities. The majority of the PXP input will be
developed as part of the PXP subtask. The PXP will include the following sections:

by CONSULTANT to CLIENT a minimum of 24 hours in advance of the meeting, and
CONSULTANT will provide meeting summaries within five (5) working days of meetings.
The PXP will be provided to the CLIENT, and updated as needed throughout the life of the
project. The CONSULTANT will load and maintain the most current PXP on the Project
Collaboration Portal site.

This task includes coordination within the CONSULTANT team and coordination with CLIENT.
11121 Project Kickoff Meeting
CONSULTANT will conduct a project initiation meeting with CLIENT Staff within 15 working
days following notice to proceed. The purpose of the kick-off meeting will be to identify critical
success factors, obtain equipment and process preferences, brainstorm potential design solutions,
and establish a clear set of objectives for the project based on client input and consultation with
senior technical experts. In addition, the Project Kick-off meeting will address the following
items:
• WBS review
• Project deliverables
• Project schedule
• Project team member responsibilities and authorities
• Project management protocols
• Communications protocols
• Initial Project Delivery Framework
• Project Working Groups composition, charters, and meeting schedules
• Initial technical tasks to be accomplished
• Coordination needs between CONSULTANT and CLIENT
• Guidelines to be applied during field activities
• Other topics identified by CONSULTANT or CLIENT
The CONSULTANT Project Manager will facilitate the Project Kick-off meeting.
CONSULTANT will prepare and distribute a meeting agenda and information 24 hours in
advance of the meeting and prepare a meeting summary. A project responsibility assignment
matrix (RAM) will be prepared that documents who is responsible and authorized to make
PROJECT decisions.

11122 Regular Progress Meetings
CONSULTANT will attend monthly progress meetings with the CLIENT for the duration of the
project (i.e., 9 1 nine] meetings, one per month based on the project schedule). Regular progress
meetings will include review and discussion of information regarding progress on project tasks,

as presented in the progress reports prepared in Task 11240, with a focus on issues that may
require CLIENT input or decisions. Appropriate members of the CONSULTANT's team and
CITY's plant and engineering/management staff shall attend the meetings and/or participate via
conference call, as required, based on the meeting agendas. CONSULTANT will prepare
supporting materials to provide additional background and context for issues identified in the
regular progress reports to be discussed at the monthly progress meetings. CONSULTANT will
prepare and distribute a meeting agenda and materials 24 hours in advance of each meeting,
facilitate the meetings, and prepare meeting summaries.

11123 Quality Control and Client Reviews
CONSULTANT shall perform intra -discipline, inter -discipline, and QA/QC team reviews at each

11130 Develop and Maintain Project Schedule
CONSULTANT will develop the PROJECT schedule. The schedule will be developed using
Primavera P6 or a mutually agreed upon alternative as the software platform. The schedule will
be developed using Critical Path Method (CPM) to provide a sequenced inter -related set of
project activities. CONSULTANT will resource -load the project schedule at the WBS Summary
level to accumulate planned, actual and forecast project costs.

Use existing BRWRF flow data along with concepts developed in the "Wastewater Planning for
Longwood Service Area" study for inclusion into the expanded or ultimate flows to the BRWRF
depending on anticipated timing provided by the CITY.
Flow quantities for any undeveloped area are to be in accordance with the planning densities
shown in the zoning map for ten year and ultimate build out as provided by the CITY to
CONSULTANT.
Based on the analysis of the current flow conditions future I/I contributions will be included on a
pro rata basis assigned to the total development area assigned by the zoning map.
12122 Perform Modeling Runs
Perform InfoWorks modeling runs for the following scenarios based on expected growth
(provided by the CITY) and modeling assumptions approved by the CITY including the
Longwood Service Area Planning Study, June 2012:
1. Baseline of existing flows for both BRWRF and Longwood WRF service areas. Although
unanticipated, any areas of existing gravity line, pump station or force main found
insufficient to convey the existing flows are to be noted and generally upsized to allow
the projected flow to reach the treatment plant unimpeded in order to determine the actual
flow rates for the planning period.
2. Ten year growth projection for the BRWRF and Longwood service areas. Any areas of
existing gravity line found insufficient to convey the projected flows are to be noted and
generally upsized to allow the projected flow to reach the treatment plant unimpeded in
order to determine the actual flow rates for the planning period.
3. Ultimate CITY build -out growth projection and improvements (combining all portions of
Longwood WWTP service area identified for incorporation into BRWRF service area).
4. A windshield survey of the alternatives routes will be undertaken in conjunction with a
desk top review of utilities and crossings to identify major issues. No trial excavations
and / or subsurface planning including geotechnical review will be undertaken for the
route alternatives under this contract.
The results of the modeling effort are to be documented in summary form within the Preliminary
Engineering Report. All other pertinent data will be saved to be used in future modeling
activities.

CITY will provide all existing survey, geotechnical, and other reports, data, and studies to
CONSULTANT. CONSULTANT is not responsible for subsurface conditions or the accuracy or
completeness of reports, data, or studies completed by others. CONSULTANT has the right to
rely upon previously completed documents as a basis for performance of work. Information
provided by CITY that is used by CONSULTANT and then later deemed incorrect will require in
additional contract funding to fix.
The CONSULTANT shall review and evaluate available background information, and conduct
interviews with CITY staff from Engineering and Operations to confirm existing documentation
and to develop a full understanding of the existing operational/system limitations and the ultimate
design requirements. Additional data may be requested as the project proceeds. CITY shall use
best effort to provide all requested data within five (5) working days whenever possible.
13120 Develop 3D Model of Existing Facilities
CONSULTANT shall develop a base model of the existing site, facility, and utilities using 3D
BIM. The interior of structures will not be included in this base model. The base model will be
used to develop conceptual alternatives for the Preliminary Design Report and will be used as the

CONSULTANT shall develop preliminary design criteria for the analysis of SBR and MBR
treatment processes, including the identification of the existing design conditions, current flow,
10 year projected flow, and projected ultimate capacity needs of the plant service area. While
unknown at this point and subject to future regulatory conditions, CONSULTANT shall consult
with City and provide consideration of potential future nutrient requirements, and how those may
impact the preliminary design criteria. The work will culminate in the preparation of the Project
Preliminary Engineering Report, which will contain the following information:
1. Civil and Site Development
a. Confirm adequacy of topographical and boundary mapping. Evaluate legal,
ownership, permitting and zoning constraints. Identify environmentally sensitive
areas such as wetlands, flood plains, and known hazardous waste areas.
b. Development of two (2) altemative plant component layouts. This will consist of
the following activities: (1) determine approximate structure size, location, and
orientation; (2) approximate size and locate parking lots for employees and

13140 Evaluation of Alternatives
Evaluation of alternatives for improvements that may be included in detail design and
construction to include:
1. Preliminary designs for a new lift station structure to increase capacity and address ease
of operation and maintenance, and condition assessment of existing pump station to
include safety concerns as well as condition of the existing wet well piping.
2. Analysis of the existing influent lift stations to be reused and/or modified to increase
system capacity and ability to accommodate expansion of plant capacity.
3. Analysis of the existing bar screen structure and headworks to be reused and/or modified
to include grit removal, increased capacity and ability to accommodate expansion of plant
capacity, improved screenings equipment, including analysis for ultimate flows and the
temporary installation and operation of a temporary package plant. Analysis of new bar
screen structure with integral grit removal in lieu of reusing existing and for cost and
constructability comparison.
4. Secondary treatment alternatives will include options to accommodate potential future
nutrient limits. The criteria for near and long term effluent nutrient goals will be
established in coordination with CITY Staff.
5. Increased capacity of chlorine disinfection system, or potential preliminary layout of a
new UV disinfection system, as well as post- aeration system and flow measurement.
6. Improvements to sludge handling processes to handle future increase in plant loading,
including expansion of sludge holding capacity and considerations for changing from
centrifuge dewatering to belt press dewatering including polymer system and conveyor
modifications. Sludge disposal will be by the current method of hauling to the existing
landfill, and no change in sludge class/classification will be required with the new design.
7. Improvements to ancillary systems and processes such as non -potable water system and
existing equalization basin and intermediate lift station.

8. Other site and maintenance improvements as identified during preliminary evaluation of
existing conditions.

10. Electrical and Instrumentation requirements to accommodate proposed process
expansions and technology changes, including additional generator capacity.
11. Facility preliminary design criteria recommendations based on available plant data and
data analyses, which include determining the capacity of each process unit based on
current regulatory criteria and industry standards.
12. Evaluate the option of moving the existing 1 MGD package treatment plant from the
Reflection Bay WRF to the BRWRF as a means of temporarily augmenting capacity at
the BRWRF.
The alternatives, evaluation process, and recommendations will be documented in the PER. The
evaluation process will include preliminary AACE Class 5 capital cost, and preliminary
operations and maintenance costs. Additional selection criteria will be developed during the
project kickoff meeting.
13150 Process Modeling
Conduct process modelling of two treatment processes using either Biowin or GPS -X for process
design.
13160 Develop Construction Cost Estimate
CONSULTANT shall develop an engineer's opinion of probable construction cost (OPCC) for
the recommended improvements including scope and estimating contingency appropriate for the
level of design. An AACE International Class 5 cost estimate is assumed for this level of design.
13190 Draft PER Workshop
CITY will attend a one day design review workshop session conducted by CONSULTANT upon
completion of the draft PER and provide comments and feedback on the draft PER for
consideration by the CONSULTANT. It is expected that all CITY comments and suggestions will
be received within five (5) working days from the workshop in accordance with the agreed upon
Project schedule. CONSULTANT shall document the results of the workshop and provide
responses in writing to the CITY's comments and suggestions within ten (10) working days from
receipt. Results and conclusions reached during this workshop and follow up will be used to
produce a final PER.

• CONSULTANT shall deliver the Draft Preliminary Engineering Report within 90 days

CONSULTANT shall visually inspect the existing wastewater and biosolids treatment
infrastructure, document conditions, and identify areas for improvement to efficiency,
performance, or reliability of the facility. The field inspections are anticipated to be performed by
discipline engineers for the major (liquid and solids) process areas at the BRWRF.
14110 Visual Inspections
Visual inspections will be performed with the assistance of CITY operational staff using support
structures (e.g., ladders, lifts, etc.) that will be provided by CITY. It is anticipated that
CONSULTANT will perform a visual inspection of the electrical and instrumentation, HVAC,
Civil Utilities (excluding underground components, such as buried piping) and mechanical
equipment (over 5 -horsepower) by documenting equipment status and physical condition. A
photographic record will be created for each piece of equipment inspected. The electrical
inspection will include working closely with BRWRF operation's staff to open panels and
cabinets testing to document the operation, deficiencies and limitations of these facilities. In
addition, the existing power feeds and transformers will be documented to determine if there are
any limitations or deficiencies associated with these components. Structural inspections will
record visual evidence of cracks, spalling, delamination, and corroded rebar in the concrete, and
recommend any non-destructive testing that may be necessary to further document the integrity of
the structure(s). Existing structures that contain wastewater and/or sludge will be inspected only
at and above the wastewater/sludge air/water interface. Where feasible and critical to the
assessment, CONSULTANT may request that operational staff drain certain tankage, as long as
maintaining compliance with permit requirements will not be jeopardized. CONSULTANT will
also visually inspect existing aboveground structures, structural steel and miscellaneous metals
and record corrosion, delamination, and exfoliation. The anticipated facilities at the BRWRF that
will be inspected are:

16200 Subsurface Utility Engineering
Location of all subsurface utilities within the BRWRF site. CONSULTANT shall be responsible
for determining the location of all buried utilities and shall also be responsible for recording all
contact information associated with these utilities, including utility affiliation, contact name,
address, and phone number. Utilities that cannot be directly observed shall have their locations
determined by record drawings or from utility locate marks supplied by the utility owner or by a
3rd party locate service. Specific subsurface utilities to identify in the survey include the
following:
1. Existing water mains, fittings and services. Include both pipe and appurtenances that
cannot be directly observed (bends, tees, etc.) as well as observable appurtenances such
as fire hydrants and water valve boxes. The elevation of the top of valve operator nuts
shall also be recorded.
2. Existing storm and sanitary sewers, manholes, force mains, storm inlets, culverts, and
associated items. Manhole and storm drain inlet information shall include manhole lid
center location and elevation of all pipe inverts. Manholes outside of the survey
boundary shall also be surveyed if pipes are suspected to be within the survey boundaries.
3. Fiber optic, phone, and other communication utilities.
4. Buried power (including duct banks), traffic signal, and traffic loops.
5. Natural gas and other petroleum transmission and distribution systems.

Penetrating Radar (GPR), designate and mark with paint and/or flags the horizontal
location of found underground utilities (larger than 2" in diameter).
10. Survey collected utility information will be used to develop the Civil 3D model.
11. Based upon Engineering considerations including above information and proposed
design, CONSULTANT shall provide a Utility Conflict Matrix containing up to 21
potential utility conflicts by appropriate coordinates.
12. Utilizing the Utility Conflict Matrix described above, survey and pre -stake each of the
utility conflicts.
All active utilities that cannot be accurately located shall be recorded according to the best
available information and shall be labeled "LOCATION NOT KNOWN. FIELD VERIFY".
Abandoned utilities whose locations are not known shall be recorded to the best available
information and shall be labeled as abandoned and that the location is not known. A note
indicating that the utility is abandoned shall also be recorded.
After review of the survey data, CONSULTANT and/or CITY may require that buried utilities
that cannot be located accurately be potholed for verification. If potholing is required,
CONSULTANT will coordinate this task with subconsultant, who shall be at the site during the
potholing and will gather location and elevation data as the utility is exposed.
Schedule:
CONSULTANT shall begin the preliminary survey field work within 30 calendar days of notice-
to- proceed assuming favorable weather conditions. Final survey shall be completed during
production of Preliminary Engineering Report and delivered with the Draft Preliminary
Engineering Report.
Deliverables:
• Draft Site Survey with utility locates, submitted in AutoCAD Civil 3D and PDF
• Final Site Survey with utility locates (Signed and Sealed by a P.S.); AutoCAD Civil 3D,
PDF, and three (3) hardcopies
17000 Task 7 Permitting and TWDB Funding
17100 TCEQ Permitting
CONSULTANT shall meet with TCEQ personnel up to two times as part of the Phase 1 effort to
discuss with regulators the requirements for the major amendment application that will likely be

submitted as part of Phase 2. For Phase 1, CONSULTANT shall simply document the permit
requirements for execution as part of Phase 2.
18000 Task 8 Additional Services
As stated above, Tasks 1 through 7 will be completed on a lump sum basis and invoiced based on
the percent complete of each task. This "Task 8 Additional Services" will be completed on a
Time and Materials basis to the extend funding is available. Task 8 activities will likely transition
into Phase 2 of the project, and the funding provided in the Phase 1 fee schedule under
OWNER'S ALLOWANCE for Task 8 scope item is not anticipated to be enough to complete the
entire scope of work provided below, but rather to begin the Task 8 work during Phase 1.
Additional funding for Task 8 efforts may be required during Phase 2 to complete those services.
18100 Texas Water Development Board (TWDB) Funding Assistance
CONSULTANT shall prepare an application for funding assistance from the Texas Water
Development Board (TWDB). This scope item will only be utilized if specifically authorized by
the CITY should they decide to apply for TWDB funding. Otherwise, this scope item will not be
utilized and no work or subsequent invoices will be accrued towards this task item. Specific scope
items include the following:
1. Attendance at TWDB Pre -Application Meeting
2. Preparation of Financial Assistance Application
3. Assistance with preparation of Closing Documents (if applicable)
4. Incorporation of Davis -Bacon Act wage rates into the Contract Documents (SRF loans)
5. Incorporation of EPA's Disadvantaged Business Enterprise documents into the Contract
Documents (SRF loans)
6. Clarifications /Limitations and Assumptions
7. Assumes CITY already has an approved Water Conservation and Drought Contingency
Plan required by TWDB
18110 TWDB Funding NEPA Compliance
Should the CITY elect to apply for Federal SRF, NEPA compliance will be required. This scope
item will only be utilized if specifically authorized by the CITY should this task be required by
the terms and conditions of the TWDB funding. Otherwise, this scope item will not be utilized
and no work or subsequent invoices will be accrued towards this task item. Because the history
and extent of the current site conditions are not completely known, CONSULTANT proposes to
begin providing the following services, as authorized by the CITY, up to the allowance not -to -
exceed amount specified in fee schedule. Specific scope items may include the following:
1. Documentation necessary for Categorical Exclusion (CE); or
2. Performance and submittal of an Environmental Assessment (EA); or
3. Preparation of an Environmental Impact Statement (EIS)
4. Preparing, presenting and attending public meetings as may be required by the Texas
Water Development Board process.
If the above services are authorized, a full budget estimate for each task will be prepared,
submitted and authorized prior to commencement of work. Should the proposed budget exceed

the remaining allowance, CONSULTANT shall perform work (if authorized) up to the maximum
allowance and pause work until additional funding is authorized to complete the task.
18200 Materials Testing
If determined by CONSULTANT, certain non-destructive or other testing of equipment and
structures may be required to adequately perform a condition assessment for facilities and
equipment that may be re -purposed or re -used for the new treatment process. If additional testing
or analysis is needed for this purpose, a full budget estimate for each task will be prepared,
submitted and authorized prior to commencement of work. Should the proposed budget exceed
the remaining allowance, CONSULTANT shall perform work (if authorized) up to the maximum
allowance and pause work until additional funding is authorized to complete the task.
